Employing a combination of traditional historical sources and cutting-edge quantitative analyses of county voting returns, Dale Baum painstakingly explores the double collapse of Texas unionism—first as a bulwark against secession in the winter of 1860–1861 and then in the late 1860s as a foundation upon which to build a truly biracial society. By carefully tracing the shifting alliances of voters from one election to the next, Baum charts the dramatic assemblage and subsequent breakup of Sam Houston’s coalition on the eve of the war, evaluates the social and economic bases of voting in the secession referendum, and appraises the extent to which intimidation of anti-secessionists shaped the state’s decision to leave the Union. Book excerpt: For many of the forty years of her life as a slave, Azeline Hearne cohabitated with her wealthy, unmarried master, Samuel R. Hearne. She bore him four children, only one of whom survived past early childhood. When Sam died shortly after the Civil War ended, he publicly acknowledged his relationship with Azeline and bequeathed his entire estate to their twenty-year-old mulatto son, with the provision that he take care of his mother. When their son died early in 1868, Azeline inherited one of the most profitable cotton plantations in Texas and became one of the wealthiest ex-slaves in the former Confederacy. In Counterfeit Justice, Dale Baum traces Azeline's remarkable story, detailing her ongoing legal battles to claim and maintain her legacy. As Baum shows, Azeline's inheritance quickly made her a target for predatory whites determined to strip her of her land. A familiar figure at the Robertson County District Court from the late 1860s to the early 1880s, Azeline faced numerous lawsuits -- including one filed against her by her own lawyer. Samuel Hearne's family took steps to dispossess her, and other unscrupulous white men challenged the title to her plantation, using claims based on old Spanish land grants. Azeline's prolonged and courageous defense of her rightful title brought her a certain notoriety: the first freedwoman to be a party to three separate civil lawsuits appealed all the way to the Texas Supreme Court and the first former slave in Robertson County indicted on criminal charges of perjury. Although repeatedly blocked and frustrated by the convolutions of the legal system, she evolved from a bewildered defendant to a determined plaintiff who, in one extraordinary lawsuit, came tantalizingly close to achieving revenge against those who defrauded her for over a decade. Due to gaps in the available historical record and the unreliability of secondary accounts based on local Reconstruction folklore, many of the details of Azeline's story are lost to history. But Baum grounds his speculation about her life in recent scholarship on the Reconstruction era, and he puts his findings in context in the history of Robertson County. Although history has not credited Azeline Hearne with influencing the course of the law, the story of her uniquely difficult position after the Civil War gives an unprecedented view of the era and of one solitary woman's attempt to negotiate its social and legal complexities in her struggle to find justice. Baum's meticulously researched narrative will be of keen interest to legal scholars and to all those interested in the plight of freed slaves during this era.

In the eighteenth and early nineteenth centuries, those below the Potomac River, for all their cultural and economic similarities, did not hold a separate political identity. How this changed, and how the South came to be a political entity that coheres to this day, emerges clearly in this book—the first comprehensive account of the Civil War Era and late nineteenth century state constitutional conventions that forever transformed southern politics. From 1860 to the turn of the twentieth century, southerners in eleven states gathered forty-four times to revise their constitutions. Framing the Solid South traces the consolidation of the southern states through these conventions in three waves of development: Secession, Reconstruction, and Redemption. Secession conventions, Paul Herron finds, did much more than dissolve the Union; they acted in concert to raise armies, write law, elect delegates to write a Confederate Constitution, ratify that constitution, and rewrite state constitutions. During Reconstruction, the national government forced the southern states to write and rewrite constitutions to permit re-entry into the Union—recognizing federal supremacy, granting voting rights to African Americans, enshrining a right to public education, and opening the political system to broader participation. Black southerners were essential participants in democratizing the region and reconsidering the nature of federalism in light of the devastation brought by proponents of states’ rights and sovereignty. Many of the changes by the postwar conventions, Herron shows, were undermined if not outright abolished in the following period, as “Redeemers” enshrined a system of weak states, the rule of a white elite, and the suppression of black rights. Southern constitution makers in all three waves were connected to each other and to previous conventions unlike any others in American history. These connections affected the content of the fundamental law and political development in the region. Southern politics, to an unusual degree, has been a product of the process Herron traces. What his book tells us about these constitutional conventions and the documents they produced is key to understanding southern history and the South today.

An electorate composed of newly enfranchised former slaves, native southern whites (minus significant numbers of disenfranchised former Confederate officials), and a small contingent of "carpetbaggers," or outside whites, sent delegates to ten constitutional conventions. Derogatorily labeled "black and tan" by their detractors, these assemblies wrote constitutions and submitted them to Congress and to the voters in their respective states for approval. Blacks, Carpetbaggers, and Scalawags offers a quantitative study of these decisive but little-understood assemblies -- the first elected bodies in the United States to include a significant number of blacks. Richard L. Hume and Jerry B. Gough scoured manuscript census returns to determine the age, occupation, property holdings, literacy, and slaveholdings of 839 of the conventions' 1,018 delegates. Carefully analyzing convention voting records on certain issues -- including race, suffrage, and government structure -- they correlate delegates' voting patterns with their racial and socioeconomic status. The authors then assign a "Republican support score" to each delegate who voted often enough to count, establishing the degree to which each delegate adhered to the Republican leaders' program at his convention. Using these scores, they divide the delegates into three groups -- radicals, swing voters, and conservatives -- and incorporate their quantitative findings into the narrative histories of each convention, providing, for the first time, a detailed analysis of these long-overlooked assemblies. Hume and Gough's comprehensive study offers an objective look at the accomplishments and shortcomings of the conventions and humanizes the delegates who have until now been understood largely as stereotypes. Blacks, Carpetbaggers, and Scalawags provides an essential reference guide for anyone seeking a better understanding of the Reconstruction era.
