Book excerpt: The European Union will be a much more diversified entity after the forthcoming eastward enlargement. The applicant states from Eastern Europe are much poorer than the current member states from Western Europe. Their democracy and in some cases even their statehood is newly established and presumably more fragile. Their economic, legal and administrative structures are less developed. This collection of essays will try to examine the origin, nature, scale and implications of this divergence. How much divergence is likely to be imported by the Union and will it hamper the process of European integration? This volume looks at differences and similarities in the field of macro-economics, welfare systems, democracy, institutional infrastructure, civic orientations and popular culture. The book shows that the map of convergence and divergence in the future EU will be very complex and will not correspond exactly with the old east-west divide. Moreover, the division lines are constantly changing with the enlargement process representing an important factor pushing individual states into a single regulatory frame, if not in a common political direction. However, there are other "unifying" factors at play: globalization produces different models and loyalties than Europeanization. Moreover, the European pulling effect works unevenly in different functional fields and in different countries. There are also many factors that produce greater divergence rather than convergence across the European Union; a certain degree of divergence is thus unavoidable. The book shows, in particular, that certain types of divergence can be beneficial rather than merely detrimental in the process of Europeanintegration.

Book excerpt: Published in 1999, this text investigates whether FDI caused spill over effects which have led to the economic growth of the ASEAN-5 economies, and if that it so, whether the ASEAN Preferential Trade Agreement (APTA) had a significant effect in attracting FDI to the region. It takes into account the different levels of economic development of the countries under analysis. The results from the structural (static) model suggest that FDI has stimulated economic growth through the human factors followed by technology transfer, international trade, and learning by doing, and that the formation of APTA had a lagged influence on FDI inflows into the advantage of the more developed member countries and the disadvantage of the less developed countries. Those from the multiplier (dynamic) effects analysis demonstrate that whereas the impact is immediate in the more developed, politically stable and foreign investment friendly economies, there is a time lag in those economies which are less developed and more hostile to FDI. The analysis presents an empirical comparison of how the level of economic development affects the interaction of FDI, regionalism and economic growth.

The book argues that the Commission used these trade agreements, signed primarily with countries in Asia and Latin America, to advance European integration by ensuring that they became wider in scope and institutionally deeper by establishing ‘joint bodies’ – even in the face of resistance from member states in the Council of the European Union. Drawing upon principal–agent theory to explain Commission autonomy and Council control as well as extensive archival material and other sources across six in-depth case studies, it shows that the Commission primarily relied on asymmetric information to shape trade agreements in earlier negotiations. In later negotiations, the Commission harnessed its agenda-setting power to submit agreements that the Council could only accept or reject. Overall, the book argues that these 50 trade agreements significantly impacted European integration by increasing the Commission’s external action capability, transforming it into a truly global political actor – one trade agreement at a time. It examines the meaning and relevance of the concept of efficiency for the operation of courts and court systems,seeking to answer questions such as: in what sense can we say that the adjudicative process works efficiently? What are the relevant criteria for the measurement and assessment of court efficiency? Should the courts try to operate efficiently and to what extent is this viable? What is the proper relationship between 'efficiency' and 'justice' considerations in a judicial proceeding? To answer these questions, a conceptual framework is developed on the basis of empirical studies and surveys carried out mainly in the United States, Western Europe and Latin America. Two basic ideas emerge from it. First, economic rationality has penetrated the legal and judicial systems at all levels and dimensions, from the level of society as a whole to the day-to-day operation of the courts, from the institutional dimension of adjudication to the organizational context of judicial decisions. Far from being an alien value in the judicial process, efficiency has become an inseparable part of the structure of expectations we place on the legal system. Second, economic rationality is not the prevalent value in legal decision-making, as it is subject to all kinds of constraints, local conditions and concrete negotiations with other values and interests.
