Download or read book The Hague Trusts Convention written by Jonathan Harris and published by Bloomsbury Publishing. This book was released on 2002-05-04 with total page 578 pages. Available in PDF, EPUB and Kindle. Book excerpt: Trusts cross borders. When they do,real difficulties may arise. Will the understanding of what a trust is be different in a foreign state? Will the rights, powers and duties of the trustee and settlor be the same? What rights will the beneficiary be able to assert? To what extent will the trust assets be safe from the claims of creditors, forced heirs, or third parties? Which legal system will be applied to the trust? Within what limits? What if the trust needs to be recognised in a state which does not have the institution of the trust in its domestic law? The Hague Trusts Convention, enacted into English law by the Recognition of Trusts Act 1987, seeks to ameliorate the situation by providing harmonised choice of law rules for “trusts created voluntarily and evidenced in writing.” It also provides for the recognition of trusts in Contracting States. Those Contracting States should recognise the trust, even if they do not have the institution in their domestic law. This book is the first published in England to devote itself to a detailed analysis of the Convention. It is aimed at academics and practitioners; at private international lawyers and at trust lawyers. Frequent reference is made to the position in civil law states (especially in the Contracting States of Italy and the Netherlands) and in other trust states, both offshore and onshore. The Hague Trusts Convention deals with the operation of the trust itself. It does not deal with the preliminary steps needed to create a trust. These preliminary matters raise highly complex and uncharted choice of law issues. Detailed discussion of these matters is also provided, and appropriate solutions suggested.

Available in PDF, EPUB and Kindle. Book excerpt: Liber Amicorum Samir Saleh Reflections on Dispute Resolution with Particular Emphasis on the Arab World Edited by Nassib G. Ziadé This welcome volume upturns the widespread perception that the Islamic and Arab worlds fail to conform to today’s internationalized approach to dispute resolution. With contributions from nineteen eminent authors – judges, arbitrators, academics, practicing lawyers, representatives of international arbitral institutions – this collection of essays and analyses manifests the salutary worldwide influence of Arab law and its intersection with the common law and civil law traditions. Conceived to honor Mr. Samir Saleh, one of the leading scholars and international lawyers in the Arab world, the book offers work in English and French that focuses on the fields of law to which Mr. Saleh has made his most significant contributions, namely, arbitration and mediation in different types of international disputes. Among the issues and topics covered are the following: the position of Islamic and Middle Eastern law on alternative dispute resolution; dichotomy between confidentiality and enforcement; Shari’a applicable to the merits in international commercial arbitration; oil and gas agreements; State submission to arbitration in the Arab world; the role of arbitral institutions in the Middle East and North Africa; and interaction between public and private law concepts and practices. The authors highlight the ongoing challenges and outlook for dispute resolution in the region, discussing case law, evolving legislation, and changes in the practice of international arbitration and mediation in several Arab countries. Mr. Saleh’s work in strengthening international law while bridging the legal and cultural divides between the Arab region and the rest of the world will undoubtedly continue to inspire generations to come. Given recent developments in Arab and Islamic law and the resulting focus on Arab scholarship and jurisprudence, along with Mr. Saleh’s unparalleled influence on dispute resolution in the Arab world and beyond, the wide-ranging expertise revealed in this Liber Amicorum is sure to be of great practical value to international law practitioners and law firms, alternative dispute resolution scholars, and arbitral institutions worldwide.

Book Jews and Gender in Liberation France

Download or read book Jews and Gender in Liberation France written by K. H. Adler and published by Cambridge University Press. This book was released on 2003-08-07 with total page 291 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book takes a new look at occupied and liberated France through the dual prism of race, specifically Jewishness, and gender - core components of Vichy ideology. The imagining of liberation and the potential post-Vichy state, lay at the heart of resistance strategy. Their transformation into policy at liberation forms the basis of an enquiry that reveals a society which, while split deeply at the political level, found considerable agreement over questions of race, the family and gender. This is explained through a new analysis of republican assimilation which insists that gender was as important a factor as nationality or ethnicity. A new concept of the 'long liberation' provides a framework for understanding the continuing influence of the liberation in post-war France, where scientific planning came to the fore, but whose exponents were profoundly imbued with reductive beliefs about Jews and women that were familiar during Vichy.

Book Financial Information and Brand Value

Download or read book Financial Information and Brand Value written by Sandra Rmadi-Saïd and published by John Wiley & Sons. This book was released on 2020-12-03 with total page 192 pages. Available in PDF, EPUB and Kindle. Book excerpt: The brand is the companyÂs most important asset. In their financial statements, companies are faced with a lack of accounting recognition for the brands they have created, and value recognition for the brands they have acquired. This book studies the nature, characteristics and determinants of brand information published in companies annual and financial reports. It presents case studies on the methods of evaluating and developing brands, and analyzes annual reports published by listed companies, whose brands appear in international rankings. It reflects on the inadequacy of information and disclosed data to demonstrate the value of brands and the need to ensure that more reliable and relevant financial information is available to investors. Financial Information and Brand Value goes beyond the simple application of conceptual frameworks in order for the reader to master the practices related to brand valuation.

Book Bank Guarantees in International Trade

Download or read book Bank Guarantees in International Trade written by Roeland F. Bertrams and published by Kluwer Law International B.V.. This book was released on 2013-01-06 with total page 585 pages. Available in PDF, EPUB and Kindle. Book excerpt: For decades, this remarkable book – now in its updated fourth edition – has served practitioners in international trade and banking law as a thorough ‘codification’ of the law and practice of bank guarantees. The new edition has been thoroughly revised, updated, and amended in the light of new developments in the law and changing patterns in practice. Bertrams uses case law, arbitral decisions, and legal writing from five European jurisdictions – The Netherlands, Germany, France, Belgium, and England – to build an analysis of how the practical applications of bank guarantees have established a pattern of law. The new edition takes into account all legal and arbitral decisions and relevant legal writing through 2012 from these countries, as well from other European countries and the United States. Written from a transnational perspective, Bank Guarantees in International Trade can be used in both civil and common law jurisdictions and it has been cited as an authoritative source of case law in several jurisdictions from each system. With reference throughout to the effect and significance of the Uniform Rules for Demand Guarantees (URDG) of the International Chamber of Commerce, International Standby Practices (ISP), and the UNCITRAL Convention on Independent Guarantees and Stand-by Letters of Credit, the author continuously elucidates the way guarantees function in actual practice and the numerous practical aspects and issues to which they give rise. The analysis covers the following subjects and much else: types of guarantee (tender, performance, maintenance, repayment, retention); payment mechanisms (first demand, third-party documents, arbitral or court decision); risks and negotiations, drafting and clauses; bank guarantees as a financial service, the bank’s perspective; direct and indirect guarantees, counter-guarantees; formation, enforceability of expiry dates, assignment and transfer; demand for payment and the rule of strict compliance; fraud and restraining orders; applicable law and jurisdiction; reference to URDG 2010 revision and ISP98 throughout the text. In addition to his thorough coverage of law and legal writing, the author has drawn on intensive contacts with the banking community, construction firms, export credit insurance companies, and local lawyers. His insight into ‘the daily life’ of the world of independent (first demand) guarantees and the practices, difficulties, and peculiarities in a great number of countries and regions, including the Middle East and North Africa, cannot be matched in any other source. Bank guarantees can present major difficulties, and this book is the lawyer’s best guide in any situation likely to arise. As a comprehensive study of the legal and practical aspects of bank guarantees and standby letters of credit, it offers practitioners in international trade law the most complete analysis of banking law in the field. In its wealth of practical detail, it is unlikely to be surpassed.

Book Judicial Protection in the European Communities

Download or read book Judicial Protection in the European Communities written by Henry Schermers and published by Springer. This book was released on 2013-11-11 with total page 510 pages. Available in PDF, EPUB and Kindle. Book excerpt: I. Purpose of the book § 1. The Court of Justice plays a significant role in the development of the European Communities, to some extent comparable with the role of the Supreme Court in the early years of the United States of America. Both are constitutional courts charged with the preservation and the development of the law in a new society. The powers of both are in fact limited by the 1 existing political situation. Each court plays a vital role in the protection of the individual against a vast and increasingly influential administration. In the present book the attempt is made to describe the nature of the ju dicial protection within the sphere of European Community law, that is available to individuals and undertakings as well as to the Member States. The study is heavily based on the case-law of the Court of Justice, which in principle is described rather than criticized, mainly for three reasons. (I) The author has great admiration for the Court of Justice and for the manner in which it operates. He considers that a detailed description of the Court's case-law portrays a fine legal system that is not susceptible to a great amount of fundamental criticism.
