An instruction that the jury must convict of murder in the second degree, if they were left in doubt as to whether the deceased, at the time he was slain, was making a felonious assault upon the prisoner, and as to whether the defendant at the time believed, or had reasonable ground for believing, that deceased was making such assault upon him, is erroneous, since the instruction not only requires the prisoner to show mitigation beyond a doubt, which is erroneous, but also makes it incumbent on the prisoner to show that deceased was actually making the assault and also that the prisoner believed or had reason to believe deceased was making such assault.
