Book Japan s Early Experience of Contract Management in the Treaty Ports

Download or read book Japan s Early Experience of Contract Management in the Treaty Ports written by Yuki Allyson Honjo and published by Routledge. This book was released on 2013-12-19 with total page 263 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first in-depth study of the early trial-and-error experiences of contracting between Japanese and western merchants trading in the Japanese Treaty Ports in the eighteen year period immediately following the opening of the ports in 1859. Fundamental to the equation were the inevitable east-west cultural and legal ambiguities that impacted on the traders. The learning curve for both westerners and Japanese regarding the nature and application of western contracting law was predictably difficult, tortuous and open to constant misunderstanding. Nevertheless, it was within such a framework that the principal benchmarks for trade with Japan were set down and which, in essence, have lasted to the present day.

Book Life in Treaty Port China and Japan

Download or read book Life in Treaty Port China and Japan written by Donna Brunero and published by Springer. This book was released on 2018-03-30 with total page 300 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edited volume moves beyond the traditional examination of the treaty ports of China and Japan as places of cultural interaction. It moves ‘beyond the Bund’, presenting instead the history of material culture, the everyday life of the residents of the treaty ports beyond the symbology of Shanghai's waterfront. Bringing for the first time together scholars of China and Japan, museum curators, legal, economic and architectural historians, it studies the treaty ports not only as sites of cultural exchange, but also as sites of social contestation, accommodation and mobility, covering topics as varied as day to day life itself, such as family, property and law, health and welfare, travel, visual culture and memory. The call of this volume is to peel the multiple layers of the encounter between East and West in the treaty ports of China and Japan.

Book Justice and International Law in Meiji Japan

Download or read book Justice and International Law in Meiji Japan written by Giorgio Fabio Colombo and published by Taylor & Francis. This book was released on 2023-02-10 with total page 138 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book carries out a comprehensive analysis of the María Luz incident, a truly significant episode in Japanese and world history, from a legal perspective. In July 1872, the María Luz, a barque flying the Peruvian flag, carried Chinese indentured servants from Macau to Peru. After the ship stopped for repairs in Kanagawa Bay, a number of legal issues arose that were destined to change the perception and use of the law in Japan forever. The case had a tremendous impact on the collective imagination, both Japanese and international: it is one of the first occurrences in which an Asian country decided to resist the pressure of a Western nation, and responded using the most refined tools of domestic and international law. Moreover, the final outcome of the case (arbitration in front of the Czar of Russia) marks the debut of Japan on the stage of international arbitration. While historians have written widely on the subject, the legal importance of this event has been relatively neglected. This book uses the case to explore the technical legal issues Japan was facing in its transition from pre-modernity to modernity. These include unequal treaties, extraterritoriality clauses, the need to establish an updated judicial system, and a delicate balance between asserting sovereignty and resorting to diplomacy in solving disputes involving foreigners. Based on original documents, this book is an invaluable resource for researchers and academics in the fields of legal history, dispute resolution, international law, Japanese history and Asian studies.
