Download or read book Money Awards in Contract Law written by David Winterton and published by Bloomsbury Publishing. This book was released on 2015-06-18 with total page 370 pages. Available in PDF, EPUB and Kindle. Book excerpt: The quantification of contractual money awards is a topic of both significant theoretical interest and immense practical importance. Recent debates have ranged from the availability of gain-based relief to the basis for principles of remoteness and mitigation. While these and other important issues, such as the recovery of damages for non-pecuniary loss, are touched upon, the book's principal objective is to challenge the conventional interpretation of the principle generally acknowledged to govern this area of the law, which Parke B famously laid down in Robinson v Harman. According to this conventional interpretation, the objective of all money awards given in accordance with the Robinson v Harman principle is simply to 'compensate' the promisee for the 'loss' that can be attributed to the promisor's failure to perform as promised. After challenging this orthodoxy, Dr Winterton proposes a new understanding of the Robinson v Harman principle, which draws an important distinction between money awards that substitute for the performance promised and money awards that aim to make good certain detrimental factual consequences that can be attributed to a promisor's breach. In exploring the significance of this distinction, the different principles underpinning the quantification and restriction of each kind of award are explored in addition to some important theoretical issues such as the effect that the occurrence of a breach has on the rights generated by contract formation. The book's unifying objective is to outline a coherent picture of the law of contractual money awards. It will be of interest to judges, practitioners and academics alike. Download or read book The Law of Estoppel written by Michael Barnes KC and published by Bloomsbury Publishing. This book was released on 2020-02-20 with total page 981 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work contains within a single book an account of all the forms of estoppel in operation today, including estoppel by record (res iudicata), as well as of the associated doctrine of election. There can be few practitioners who do not at some time have to engage with estoppel. Estoppel applies across all, or nearly all, English civil law. In explaining each form of estoppel an attempt is made to state the main elements which have to be proved to establish the estoppel and then to detail each element with its various components. At the end of each chapter a brief summary of the estoppel is included so as to guide practitioners and others to any question important in any particular case. The law of estoppel has considerably advanced over recent decades, and over the last 10 years alone there have been major changes, such as the clarification of the previously uncertain boundaries of proprietary estoppel, a statement of the exceptions to the principles of res iudicata, and the extension law as well as of fact. These and other subjects are explained in full.
Download or read book Mechanosensitivity of the Nervous System written by Andre Kamkin and published by Springer Science & Business Media. This book was released on 2008-09-22 with total page 355 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents the latest findings in mechanosensitivity of the nervous system. The nervous system stands out from a number of tissues because besides reacting to the mechanical stress it is transmitting its own response to other organs and tissues, which are located downstream of its signaling pathway. For this reason any type of mechanical stimulation of the nervous system, which is capable of triggering a physiological response, has high scientific and practical significance, since it allows its use beyond a particular experimental model anywhere where it is contributing to a particular pathological condition. This book is a unique collection of reviews outlining the current knowledge and the future developments in this rapidly growing field. Currently, investigations of the effects of mechanical stress on the nervous system are focused on several issues. The majority of studies investigate the effects of mechanical stimulation on mechanosensitive channels, as its primary target and interactive agent, and aim on description of downstream intracellular signaling pathways together with addressing general issues of biomechanics of the nervous system. Knowledge of biomechanics, and mechanisms, which underlie it on organism, organ, tissue and cellular level, is necessary for understanding of the normal functioning of living organisms and allows to predict changes which arise due to alterations of their environment, and possibly will allow to develop new methods of artificial intervention. The book brings up the problem closer to the experts in related medical and biological sciences as well as practicing doctors besides just presenting the latest achievements in the field.
