Unsere heutige zweite Arbeitsge­ meinschaft betrifft eine offizielle Methode der Rechtsbegründung, nämlich dieje­ nige aus staatlich anerkannten Grundrechten. Daß zu so offiziellem Anlaß neben Vertretern der Rechtswissenschaften auch die Vertreter der Sozial- und Verhal­ tenswissenschaften zu Wort kommen sollen und in vorbereitenden Beiträgen auch schon zu Wort gekommen sind, ist leider noch immer keineswegs selbstverständ­ lich - so wenig, daß es seinerseits wiederum einer Begründung bedarf. Ich will daher in meinen einleitenden Bemerkungen diese Begründung zu geben versu­ chen. Dabei will ich zunächst hypothetisch bleiben: Eine Teilnahme von Erfahrungs­ wissenschaftlern am Rechtsgespräch rechtfertigt sich jedenfalls dann, wenn die Gestalt der Rechtsordnung auch von Erfahrungen bestimmt wird. Möglich ist das in doppelter Hinsicht: zum einen kann durch Erfahrungswissen die soziale Wirk­ samkeit der Rechtsordnung begründet oder verstärkt werden, zum andern kann das Erfahrungswissen der inhaltlichen Richtigkeit des Rechts, seiner Gerechtig­ keit, zugute kommen. In der ersten Hinsicht ist die Bedeutung von Erfahrungwis­ sen und damit die Berechtigung der Erfahrungswissenschaftler, zum Thema mitzureden, seit längerem außer Streit. Dagegen ist noch immer nicht ausdisku­ tiert, ob Erfahrungswissenschaftler auch in der zweiten Hinsicht, d. h. hinsichtlich der Gerechtigkeit des Rechts, etwas beizutragen haben.

As more and more countries adopt Human Rights legislation and accede to international human rights agreements, and as the European Union introduces its own Bill of Rights, judges struggle to implement these rights consistently and sometimes the reasoning behind them is lost. Examining the practice in other jurisdictions can be a valuable guide. Robert Alexy's classic work reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication.
