Book excerpt: Ii his work contains the papers of the Fifth Conference on "Antitrust between EC law and national law", organised by the European Lawyers Union - Union des Avocats Européens (UAE) in co-opération with the Associazione Italiana per la Tutela della Concorrenza, the Italian section of the Ligue Internationale du Droit de la Concurrence (LIDC), which took place in Treviso on May 16 and 17, 2002. Some of the papers have been substantially reviewed and updated by their Authors just before the publication. Each paper deals with topical issues of competition law, in light of the most recent European and national administrative and judicial case-law. In particular, contributors to this publication have focused their remarks on the wide reform of EC competition law concerning merger control regulation and the "modernisation" of the rules for the implementation of articles 81 and 82 of the EC Treaty, and have also dealt with other specific topics such as collective dominant position, procedural rules, judicial review, exchange of information, IP rights and new technologies. The final section of this publication deals with antitrust issues of specific sectors such as pharmaceuticals, payment systems and telecommunications.

It includes the analysis of the effects of the "modernization" after two years from its enforcement, and focuses on relevant aspects of interim measures, commitments and leniency programs. Contributions aiso analyze and explain the Commission Discussion paper on Article 82, as well as all current issues concerning private enforcement and the application of antitrust law in regulated markets, such as the pharmaceutical, energy, banking and telecommunications ones.
