With these thoughts in mind, why do both the United States and Israel continue to support them? This article will explore the historical background of the settlements; the reason this issue is so important, the policies of the United States and Israel; the current situation of the settlements; and finally some possible solutions and recommendations for potential U.S. foreign policy changes.

Book excerpt: "This book is an updated and expanded study of the manner in which the Supreme Court of Israel has related to petitions challenging actions of the Israeli authorities in the territories occupied by Israel during the 1967 War. The first edition of the study was published two decades ago by one of the present authors, David Kretzmer. The original work was completed just before the second intifida began in September 2000. It covered decisions of the Supreme Court both during the formative years of the Court's jurisprudence on the occupation, and during the first intifada that broke out in December 1987. As stated in the preface to the first edition, the beginning of the second intifada proved that the hopes that the historic Oslo Accords between Israel and the PLO (1993-1995) would lead to peace between Israel and the Palestinians and to the end of the occupation were premature. At the present time (2020) an end to direct Israeli control over the West Bank and restrictions on life in Gaza does not seem to be in sight. The so-called peace plan published by the Trump Administration in February 2020, as we were completing the manuscript, does not alter that picture, although it may contribute to changes in the regime in the West Bank. Much that has happened since the first edition was published has affected the type of cases that reach the Supreme Court, and consequently the topics covered in this study. After a wave of suicide bombings in Israel in 2001 and 2002 the IDF embarked on a military operation in the West Bank. This operation and subsequent hostilities between the IDF and armed Palestinian groups yielded a host of petitions relating to means and methods of warfare and to judicial review during active hostilities. In 2002 the Israeli government began the construction of a separation barrier in the West Bank, the declared purpose of which was to make it more difficult for potential Palestinian terrorists to enter Israel itself. The barrier's route not only spurred close to two hundred petitions to the Supreme Court; it was also the subject of an advisory opinion by the International Court of Justice. In August 2005 Israel withdrew its armed forces and civilian settlements from the Gaza Strip under the Disengagement Plan, and the government announced that Israel no longer had responsibility for Gaza. Controversy arose whether Gaza remained occupied territory. In 2006 the Hamas movement gained control over Gaza and the Government of Israel declared Gaza to be 'hostile territory.' The relations between Israel and Gaza have been tense ever since, with firing of rockets and bombs on Israeli towns and villages, severe restrictions on supply of goods to Gaza and movement of people between Gaza and the West Bank, and periods of active hostilities between Israel and Gaza. Since the first edition of this study was completed there has been a dramatic expansion in the number of Israeli settlements and settlers in the West Bank. This expansion has had various legal and practical consequences, including the emergence of two different legal regimes applicable to Israelis and to Palestinians resident in the West Bank"--

If one accepts the premise that Israel is occupying some areas, and as an occupying force is forbidden to change laws from previous sovereign, it becomes relevant as to what the laws are and how are they being followed. The aim with this book is to go deeper to understand the rationale behind Israeli land policies. This book is not necessarily a full rejection of the arguments that have been advocated by different scholars that seek to brand Israel’s settlement enterprise as illegal, nor is it to be understood as a full acceptance of those arguments at hand. Rather, I want this book to show nuances in an infective question. The idea is to give the reader an insight into the arguments made by Israel and its judiciary which has not been properly addressed nor researched about through earlier scholars. By including stories about personalities such as Rabbi Menachem Froman & Shabtay Bendet, this book aims to fulfill its purpose of not politicizing the Israeli settlement enterprise through one particular understanding.

It contains a case study on Israeli settlements in the Occupied Palestinian Territory and the recent Advisory Opinion on the Separation Wall, and addresses such issues as humanitarian assistance for displaced persons, the treatment of refugees in the hands of a party to a conflict and the militarisation of refugee camps. Secondly, it examines the issue of displacement within the broader context of civilian war victims and identifies and addresses the normative gaps of international humanitarian law, including the inadequacy of concepts such as 'protected persons' and the persistence of the dichotomy between international and non-international armed conflicts, which is at odds with the realities of contemporary armed conflicts.

Book excerpt: The hundred-year conflict in Israel/Palestine is, at its core, a struggle over competing territorial claims and narratives. But this is not just an asymmetrical territorial conflict between two competing national groups--it is a settler colonial struggle between colonizer and colonized. Since 1967, the conflict has centered on the occupied Palestinian territories (oPt), which include the West Bank, Gaza Strip, and East Jerusalem. Israeli settlement in the occupied territories began in 1967 following the Arab-Israeli War, despite the fact that the occupation and transfer of civilian population into the Palestinian territories is illegal according to the Fourth Geneva Convention and often criticized under international law. Since the beginning of the military occupation of the West Bank (or "Judea and Samaria") in 1967, the settler population there and in East Jerusalem has risen to well over half a million Israeli Jews. Despite the fact that this territory remains contested and in a constant state of war and violence, settlement residents describe their communities as safe, desirable places to live. My dissertation analyzes the considerable discursive and material work required to construct and maintain settlements as desirable places to live; the ways in which territorial control is utilized to make the occupation possible and sustainable; and how settlers are responding to and shaping their physical and social environment in relation to the Palestinian "other." In three substantive chapters, in addition to a chapter examining the history of settler colonialization, I deal with various contradictions of settler life in the West Bank. This research is based on seven months of ethnographic fieldwork in the occupied West Bank, over 100 in-depth interviews with settlement residents and local council officials, participant observation at community events, and document analysis of settlement periodicals, literature by and about settlers, newspaper articles, and marketing materials. In my research I am interested in the conceptual frameworks that settlement residents use to make sense of their lifestyle in a military-occupied, contested area, and also in critiquing their interpretation of the world and in understanding how it is linked to geopolitics, settler colonialism, and unequal relations of power.
