Download or read book Debating Islam in the Jewish State written by Alisa Rubin Peled and published by State University of New York Press. This book was released on 2012-02-01 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: Using declassified documents from Israeli archives, Alisa Rubin Peled explores the development, implementation, and reform of the state's Islamic policy from 1948 to 2000. She addresses how Muslim communal institutions developed and whether Israel formulated a distinct "Islamic policy" toward shari'a courts, waqf (charitable endowments), holy places, and religious education. Her analysis reveals the contradictions and nuances of a policy driven by a wide range of motives and implemented by a diverse group of government authorities, illustrating how Israeli policies produced a co-opted religious establishment lacking popular support and paved the way for a daring challenge by a grassroots Islamist Movement since the 1980s. As part of a wider debate on early Israeli history, she challenges the idea that Israeli policy was part of a greater monolithic policy toward the Arab minority.

Book excerpt: This title presents twenty-nine topics, prepared by leading scholars in more than 20 countries, providing a comparative analysis of cutting-edge legal topics of the 21st century. Considering topics of vital moment to contemporary legal scholars, the title includes pieces on Surrogate Motherhood, The Balance of Copyright in Comparative Perspective, International Law in Domestic Systems, Constitutional Courts as "Positive Legislators," Same-sex Marriage, Climate Change and the Law, The Regulation of Private Equity, Hedge Funds, and State Funds, and Regulation of Corporate Tax Evasion. Each chapter surveys legal developments in the U.S. and Canada, Europe, Asia, Latin and South America, Africa, and the Middle East in a format that permits the reader easy access to similarities and differences in the approaches of the selected national regimes. This comprehensive volume tells the story of parallel trends in the evolution of legal doctrine despite jurisdictional, cultural, and political barriers. While each of the covered countries stands alone as a sovereign, in a technologically advanced world their disparate systems nonetheless have converged to adopt comparable strategies in dealing with complex legal issues. The volume is a critical addition to the library of any scholar hoping to keep abreast of the major trends in contemporary law.

For analysis of the facts this volume excels. A well-crafted introduction describes current debate about human rights theory and practice, traces the development of human rights instruments, and discusses problems of implementation. Strongly recommended. Library Journal The bulk of the scholarly literature on human rights deals with international law and politics. In contrast, this volume offers nineteen case studies of national human rights practices. Although international factors cannot be ignored, most human rights violations are perpetrated by states against their own citizens; the principal causes of the respect for and violation of human rights lie in national social and political structures.

Download or read book A Threshold Crossed written by Omar Shakir and published by . This book was released on 2021 with total page 217 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The widely held assumption that the Israeli occupation of Palestinian territory is a temporary situation and that the 'peace process' will soon bring an end to Israeli abuses has obscured the reality on the ground today of Israel's entrenched discriminatory rule over Palestinians. A single authority, the Israeli government, rules primarily over the area between the Jordan River and Mediterranean Sea, populated by two groups of roughly equal size, methodologically privileging Jewish Israelis while repressing Palestinians, most severely in the Occupied Palestinian Territory (OPT), made-up of the West Bank, including East Jerusalem, and Gaza. Drawing on years of human rights documentation, case studies and a review of government planning documents, statements by officials and other sources, [this report] examines Israel's treatment of Palestinians and evaluates whether particular Israeli policies and practices in certain areas amount to the crimes against humanity of apartheid and persecution."--Page 4 of cover.
