Book excerpt: In Reinvigorating workplace pensions1 published last November, the Government set out to explore whether there was scope for a new category of defined ambition (DA) pensions that would complement the defined benefit (DB) and defined contribution (DC) structures that currently dominate the market. Automatic enrolment and the single-tier State Pension will provide a firm foundation for saving for retirement. But if the current forms of DC pension saving become the default alternative to traditional DB, the pension income of future generations from workplace pensions will be more uncertain than for past generations. Over the last 12 months the DA project - a joint project between DWP and the pensions industry - has been exploring options in a middle ground. The Government proposes that the regulation of workplace pension schemes should not focus on the detail of benefit design but on what is important to the member: ensuring that any promise or guarantee, whether from the sponsoring employer or scheme, provider is delivered. This Government proposes to make it easier for employers to sponsor new pension schemes where benefits accrue on a specified basis (e.g. related to salary); and also to allow additional flexibilities for future accruals only within existing DB schemes, including the possibility of allowing a statutory override to facilitate these changes. The new flexibility will remove constraints from the existing legislative framework while still giving employees the certainty of a pension scheme where the benefits are defined (such as in relation to their salary) with the security of the promise being sponsored by their employer

The majority of people being automatically enrolled are likely to join the default fund in defined contribution (DC) schemes. It is, therefore, important to ensure that these schemes deliver the best possible value for money. The impact of the charges levied on people's pensions savings over their lifetime can be significant - seemingly small variations in charges can result in a considerable difference in people's final retirement savings. A number of voluntary industry initiatives seeking to improve disclosure of charges information to scheme members and employers have been launched in an effort to reduce the complexity of the product. The Government welcomes these initiatives, but is interested in views on whether further action is required. There are a number of potential options: mandating disclosure to members by widening the disclosure requirements, to include information about charges; standardising disclosure to employers; or disclosure of transaction costs - require disclosure to members, employers, as well as trustees, and independent governance committees (as recommended by the OFT). The Government is also interested in hearing views on whether: a cap on pension scheme charges should be introduced; differential charging between active and deferred members should be banned in DC qualifying schemes; the ban on consultancy charges should be extended from AE schemes to all qualifying DC schemes; adviser commissions set up prior to the introduction of the Retail Distribution Review should be banned in qualifying schemes

Private actors are increasingly allowed by legislatures and regulatory bodies to take part in (and in some cases assume responsibility for) the formation of legally binding rules, for example in the US, UK, Australia and the EU. Departing from traditional forms of rule-making by involving private actors may enhance the ability of regulatory systems to achieve social goals, as regulatory scholars argue. However, because private actors are permitted to act in their own best interests, their involvement also raises doubts about the legitimacy of the underlying rule-making processes and the rules that are formulated. The principal aim of this book is to highlight that the tension between the responsiveness that leading international regulatory scholars advocate in order to improve regulatory effectiveness, and the law and its formal, substantive, procedural and institutional values, is not as great as may first appear. Drawing on three in-depth case studies of the experience of the Australian telecommunications industry with self-regulatory rule-making – a form of rule-making that bears the hallmarks of 'responsive regulation', 'democratic experimentalism', 'smart regulation' and other strategies of proceduralization – it is argued that industry rule-making can, as a matter of practice, be responsive and legitimate at the same time. In doing so, the book formulates and applies criteria against which industry rule-making should be evaluated and identifies a number of indicia that point to when industry rule-making is likely to be simultaneously legitimate and responsive.

Book excerpt: Since the International Labour Organisation's Maritime Labour Convention, 2006 (MLC) came into force internationally on 20 August 2013, it has already been amended, and a further two sets of amendments have been agreed and are expected to come into force in 2019 and 2020. Maritime Labour Convention, 2006 – UK and REG Implementation sets out in detail how the UK, Bermuda, Cayman Islands, Gibraltar and the Isle of Man (being the members of the Red Ensign Group (REG) which are subject to the MLC) have implemented the Convention. Specific references are given to the laws, merchant shipping notices and guidance, as well as identifying the areas where implementation is permitted by way of collective agreements. As the MLC sits in the context of the wider international regulatory regime, it expressly endorses the application of other international instruments and standards, particularly those of the International Maritime Organisation. Furthermore, many of the MLC's mandatory provisions have been incorporated into EU Directives, which are relevant to the UK and Gibraltar. These international and regional provisions are also referenced. Chapter 1 sets out an introduction to the ILO and the MLC. Chapter 2 describes the general approach of how the UK applies its legislation to UK ships and, while they are in UK waters, non-UK ships without MLC documentation, and non-UK ships with MLC documentation. Chapters 3-22 describe the UK provisions in more detail as the other REG members' laws are influenced by those to a significant extent. The specific provisions for Bermuda, the Cayman Islands, Gibraltar and the Isle of Man have been set out, with detailed references to the appropriate regulatory sources in Chapters 23-26. Due to the central role of the MLC's Title 5 on compliance and enforcement, this is set out in full (in Part VIII, Appendix 1), annotated with references to the relevant sections of the ILO's guidelines on flag state control and port state control. HS2 Ltd's report concludes that there is a strong business case for a new London to Birmingham line, and sets out detailed recommendations for the design of its route, together with a range of options for how it might be extended to serve other conurbations. The Government has evaluated these proposals in respect of their costs and benefits for enhancing capacity and connectivity in a sustainable way, which is its key strategic objective for inter-city transport. It has also considered other realistic options for meeting the UK's inter-urban capacity needs over the next 30 years, including carrying out a detailed analysis of the potential costs and benefits of major improvements to existing rail and road networks. This Command Paper sets out both the Government's response to HS2 Ltd's recommendations and its assessment of the case for an initial core British high speed rail network. The Government proposes to begin formal public consultation in the autumn, to cover three key issues: HS2 Ltd's detailed recommendations for a high speed line from London to the West Midlands; the strategic case for high speed rail in the UK; the Government's proposed strategy for an initial core high speed rail network.
