Programm, language: English, abstract: This Dissertation aims to assess the effectiveness and suitability of European regulation in respect to E-Commerce. Taking the European 'Lisbon Strategy' as set out in 2000 as a starting point, this paper examines whether Europe is on the right track to becoming "the most competitive and dynamic knowledge-based economy (...) by 2010". Hereby, the scope of this paper is limited to E-Commerce only as one essential part of a 'knowledge-based economy' and an 'e-ready' Europe. After outlining the special nature of E-Commerce, the rationale behind regulation and the historical background of European regulation in this field, this paper concentrates on four issues where the EU has become active in regulating E-Commerce, namely, the essential prerequisite of an existing 'e-infrastructure', e-signatures, privacy and consumer protection. The European approach to each of these issues is assessed to reveal its strengths and weaknesses. Moreover, this European way of regulating E-Commerce is then compared with other regulative attempts. Hereby, special attention is paid to the US approach to regulating E-Commerce which is mostly based on self-regulation. Thus, this paper comes to the conclusion that Europe is on the right track to becoming 'e-ready' in respect to E-Commerce. Basic regulatory decisions have the potential to lead in the right direction, although they do not always provide the most effective solution. Often European Directives do not reach far enough and are outdated. Thus, they do not address E-Commerce sufficiently, give too much discretion to the Member States and leave prevalent gaps or do not interoperate properly. Book excerpt: This book critically evaluates the EU regulatory framework for the liability of host Internet Service Providers (ISPs) for copyright and trade mark infringements and provides a cluster of novel recommendations for its improvement. The book recommends the imposition of a duty of care to host ISPs to curb the dissemination of unauthorised works and counterfeit goods, the ascription of a transparency obligation to host ISPs towards their users, and the establishment of a supervisory authority for host ISPs. Host ISPs have facilitated the dissemination of content amongst users and the purchase of goods online, enabling copyright holders and brand owners to attract a greater audience for their works and goods. However, their services have attracted a high number of copyright and trade mark violations, too. Neither Article 14 of the e-Commerce Directive nor Article 17 of the Copyright in the Digital Single Market Directive provide a solid response to the issue of host ISPs' liability. This book is a valuable resource for researchers in IT and IP law and offers a new perspective for resolving online IP disputes.

This conference was an outgrowth of the two successful TrustBus inter- tional workshops, held in 2002 and 2003 in conjunction with the DEXA conferences in Aix-en-Provence and in Prague. Being the first of a planned series of successful conferences it was our goal that this event would initiate a forum to bring together researchers from academia and commercial developers from industry to discuss the state of the art of technology for establishing trust and privacy in digital business. We thank you all the attendees for coming to Zaragoza to participate and debate the new emerging advances in this area. The conference program consisted of one invited talk and nine regular technical papers sessions. The invited talk and keynote speech was delivered by Ahmed Patel from the Computer Networks and Distributed Systems Research Group, University College Dublin, Ireland on “Developing Secure, Trusted and Auditable Services for E-Business: An Autonomic Computing Approach”. A paper covering his talk is also contained in this book. The regular paper sessions covered a broad range of topics, from access control - sues to electronic voting, from trust and protocols to digital rights management. The conference attracted close to 100 submissions of which the program committee - cepted 29 papers for presentation and inclusion in the conference proceedings.
