Book excerpt: Excerpt from Irrigation Under the Provisions of the Carey Act After a time practically all land which could be reclaimed cheaply was brought under irrigation and the construction of irrigation sys tems became increasingly difficult and costly. It then became appar ent that the homestead and desert-land laws alone were not applicable to the reclamation of land in large units, since under those laws the landowner was not compelled to purchase a water right from the company which constructed the irrigation works intended to reclaim his holding. A law was needed which would offer reasonable assur ance to the construction company that the settlers who filed on the land to be served by the canal system would pay a just proportion of the cost of providing the water supply and at the same time provide for the transfer of title to the land from the Government to the settler when the land had been reclaimed. In presenting this subject to my classes at the State Agricultural College of Colorado, I have been obliged to use the lecture method because of the want of a text properly prepared to reach the grade of students that we find in these schools. As far as I have been able to learn, the books written upon the subject of Irrigation Law have been prepared by lawyers for the use of lawyers and abound in discussion which though useful to the legal profession is confusing and of little value to the mind untrained in legal technicalities. The monumental work of Kinney and the scholarly volumes of Wiel have left little to be desired by the lawyer upon this important subject, and in the preparation of the lectures which are here published I have made liberal quotations from these authors. I have also gone to the original sources of information, such as the reported cases, bulletins and Rules and Regulations issued by different governments. Book excerpt: Excerpt from A Treatise on the Law of Irrigation, Covering All the States and Territories: With an Appendix of Statutory Law In this volume I have endeavored to present, concisely and yet fully, the American law of irrigation. My aim has been to state the law as it is rather than the law as it should be. It would have been easier to make a larger book by including in the text long extracts from judges opinions, as is sometimes done, leaving the reader to work out the law for himself from this mass of material, but I have preferred to give instead the result of my own study of the cases. This course has meant more work for myself, but, I hope, not without a corresponding increase in the usefulness of the book. A conscientious attempt has been made to cite all the cases on the subject, and I believe the collection is practically complete. Except where otherwise noted, only irrigation cases have been included. Cases from other branches of the law of water rights might frequently have been cited in support of the text, but so far as possible I have chosen to confine myself strictly to the subject indicated by the title of the work. But although this book treats of the law of irrigation only, it may be not without interest to those concerned with other phases of the general subject of water rights, for in many respects the law is the same, whatever the particular use to which the water is put. This is especially true of the doctrine of appropriation, which is fully treated in this work. In the Appendix the full text of the irrigation statutes of general interest and application has been given, with the substance of or reference to other statutes pertaining to the subject.
