This book chronicles the legal battle waged toward that end by international law expert Francis A. Boyle on behalf of his Kanaka Maoli clients and friends that spans almost two and a half decades. As of this publication, that struggle has reached a decisive turning point which, if pursued following Boyle's strategy, will lead on to the victory of restoring the 1893 Kingdom of Hawaii by the Kanaka Maoli. This book serves as a guide for the pursuit of self-determination by occupied nations and indigenous peoples who can no longer claim numerical majorities over the whole of their native lands. It incorporates insights derived from legal work Boyle has done for Palestine, Lithuania, Bosnia and Herzegovina, Puerto Rico, Ireland and elsewhere around the world. Francis Boyle outlines what the Kanaka Maoli have done and must do to restore their state's independence, de facto and de jure. He details the arduous process of self-organization by disempowered peoples necessary to replicate the sovereign status of governments and states in today's world, from setting up governing structures and an economic system, to the sophisticated process of embarking on establishing relationships with and gaining recognition by states. Book excerpt: Reclaiming Kalākaua: Nineteenth-Century Perspectives on a Hawaiian Sovereign examines the American, international, and Hawaiian representations of David La‘amea Kamananakapu Mahinulani Nalaiaehuokalani Lumialani Kalākaua in English- and Hawaiian-language newspapers, books, travelogues, and other materials published during his reign as Hawai‘i’s mō‘ī (sovereign) from 1874 to 1891. Beginning with an overview of Kalākaua’s literary genealogy of misrepresentation, Tiffany Lani Ing surveys the negative, even slanderous, portraits of him that have been inherited from his enemies, who first sought to curtail his authority as mō‘ī through such acts as the 1887 Bayonet Constitution and who later tried to justify their parts in overthrowing the Hawaiian kingdom in 1893 and annexing it to the United States in 1898. A close study of contemporary international and American newspaper accounts and other narratives about Kalākaua, many highly favorable, results in a more nuanced and wide-ranging characterization of the mō‘ī as a public figure. Most importantly, virtually none of the existing nineteenth-, twentieth-, and twenty-first-century texts about Kalākaua consults contemporary Kanaka Maoli (Native Hawaiian) sentiment for him. Offering examples drawn from hundreds of nineteenth-century Hawaiian-language newspaper articles, mele (songs), and mo‘olelo (histories, stories) about the mō‘ī, Reclaiming Kalākaua restores balance to our understanding of how he was viewed at the time—by his own people and the world. This important work shows that for those who did not have reasons for injuring or trivializing Kalākaua’s reputation as mō‘ī, he often appeared to be the antithesis of our inherited understanding. The mō‘ī struck many, and above all his own people, as an intelligent, eloquent, compassionate, and effective Hawaiian leader.

Book excerpt: In the Hawaiian Homes Commission Act (HHCA) of 1921, the U.S. Congress defined “native Hawaiians” as those people “with at least one-half blood quantum of individuals inhabiting the Hawaiian Islands prior to 1778.” This “blood logic” has since become an entrenched part of the legal system in Hawai‘i. Hawaiian Blood is the first comprehensive history and analysis of this federal law that equates Hawaiian cultural identity with a quantifiable amount of blood. J. Kēhaulani Kauanui explains how blood quantum classification emerged as a way to undermine Native Hawaiian (Kanaka Maoli) sovereignty. Within the framework of the 50-percent rule, intermarriage “dilutes” the number of state-recognized Native Hawaiians. Thus, rather than support Native claims to the Hawaiian islands, blood quantum reduces Hawaiians to a racial minority, reinforcing a system of white racial privilege bound to property ownership. Kauanui provides an impassioned assessment of how the arbitrary correlation of ancestry and race imposed by the U.S. government on the indigenous people of Hawai‘i has had far-reaching legal and cultural effects. With the HHCA, the federal government explicitly limited the number of Hawaiians included in land provisions, and it recast Hawaiians’ land claims in terms of colonial welfare rather than collective entitlement. Moreover, the exclusionary logic of blood quantum has profoundly affected cultural definitions of indigeneity by undermining more inclusive Kanaka Maoli notions of kinship and belonging. Kauanui also addresses the ongoing significance of the 50-percent rule: Its criteria underlie recent court decisions that have subverted the Hawaiian sovereignty movement and brought to the fore charged questions about who counts as Hawaiian.

Book excerpt: Selected as a 2017 CHOICE Outstanding Academic Title Bayonets in Paradise recounts the extraordinary story of how the army imposed rigid and absolute control on the total population of Hawaii during World War II. Declared immediately after the Pearl Harbor attack, martial law was all-inclusive, bringing under army rule every aspect of the Territory of Hawaii's laws and governmental institutions. Even the judiciary was placed under direct subservience to the military authorities. The result was a protracted crisis in civil liberties, as the army subjected more than 400,000 civilians—citizens and alien residents alike—to sweeping, intrusive social and economic regulations and to enforcement of army orders in provost courts with no semblance of due process. In addition, the army enforced special regulations against Hawaii's large population of Japanese ancestry; thousands of Japanese Americans were investigated, hundreds were arrested, and some 2,000 were incarcerated. In marked contrast to the well-known policy of the mass removals on the West Coast, however, Hawaii's policy was one of "selective," albeit preventive, detention. Army rule in Hawaii lasted until late 1944—making it the longest period in which an American civilian population has ever been governed under martial law. The army brass invoked the imperatives of security and "military necessity" to perpetuate its regime of censorship, curfews, forced work assignments, and arbitrary "justice" in the military courts. Broadly accepted at first, these policies led in time to dramatic clashes over the wisdom and constitutionality of martial law, involving the president, his top Cabinet officials, and the military. The authors also provide a rich analysis of the legal challenges to martial law that culminated in Duncan v. Kahanamoku, a remarkable case in which the U.S. Supreme Court finally heard argument on the martial law regime—and ruled in 1946 that provost court justice and the military's usurpation of the civilian government had been illegal. Based largely on archival sources, this comprehensive, authoritative study places the long-neglected and largely unknown history of martial law in Hawaii in the larger context of America's ongoing struggle between the defense of constitutional liberties and the exercise of emergency powers.
