While subjective influences have been powerful, Professor Trigger argues that the gradual accumulation of archaeological data has exercised a growing constraint on interpretation. Book excerpt: A nation's cultural heritage represents its past, its present and its path to the future, but for many years, the cultural heritage in or adjacent to war and conflict zones has been subject to continual assault, both deliberate and unintended. This book presents papers delivered at the NATO Advanced Research Workshop entitled “Cultural heritage’s safety and security in zones of war or instability”, hosted online by the University of Rome from 25 to 27 November 2020. NATO has always been a leading player in the protection of cultural property (CPP) in the areas in which it intervenes, indeed, the protection of cultural property and common heritage is part of NATO’s core values. In addition to this, the illicit trade in antiquities and archaeological finds represents another danger to cultural heritage and can help to finance the terrorist groups that manage to seize these assets. The workshop aimed to explore ways to protect and safeguard cultural heritage in war zones or from terrorist attacks, and a group of international experts were invited to contribute presentations on selected topics of direct relevance to the processes in NATO with regard to CPP. Topics included: the experiences of international institutions; conservation and restoration; and countermeasures, technologies and examples of successful interventions. The book raises awareness of the importance of safeguarding cultural heritage and sets out ways of tackling the problem. It will be of interest to all those working in the field of protecting cultural heritage in unstable areas.

Book excerpt: Almost fifty years have passed since the adoption of the Convention Concerning the Protection of the World Cultural and Natural Heritage (the UNESCO World Heritage Convention). With its 194 States Parties, it is the most widely ratified convention within the family of UNESCO treaties on the protection of cultural heritage. The success of this Convention and its almost universal acceptance by the international community of states is due to the great appeal that recognising certain properties as "world heritage" has for national governments. Since the publication of the first Commentary, new problems have arisen in the management of world heritage sites. It has become increasingly difficult to properly monitor the conservation of the ever-growing mass of sites inscribed in the World Heritage List, and to resolve disputes over the formal designation of contested world heritage properties - a problem that has led to the withdrawal of the United States and Israel from UNESCO. New frontiers are now being explored for the expansion of the world heritage idea over marine areas beyond national jurisdiction, and the monopoly of the State in the identification, delineation, and presentation of world heritage properties is being increasingly challenged in the name of indigenous peoples' rights and by local communities claiming ownership over contested cultural sites. At the same time, the regime of world heritage protection has infiltrated other areas of international law, especially international economic law, investment arbitration, and the area of international criminal law. This second edition critically examines the World Heritage Convention against this dynamic evolution of international heritage law to help academics, lawyers, diplomats, and officials interpret and apply the norms of the Convention after half a century of uninterrupted implementing practice by State Parties and Treaty Bodies.

Book excerpt: This book aims to determine UNESCO's capability to facilitate heritage protection measures pre-conflict, emergency response measures during conflict and reconstruction efforts post-conflict. The book employs document analysis to ascertain UNESCO's legal obligations when it comes to facilitating cultural heritage protection in its Member States' territories in the condition of armed conflict, while drawing comparisons with the reality of the organisation's presence and involvement in Yemen, Syria and Iraq. This study maps shifts in UNESCO's level of communication with each country's respective government and civil authorities; allocation of financial, human and material resources; and implementation of heritage safeguarding and reconstruction initiatives. Both quantitative and qualitative data shows UNESCO to exhibit great inequity in engagement, at times, closing communications entirely with Syria, due to the political standpoints of other UNESCO Member States. This political gridlock is often shown to result in the organisation overstating its ability to safeguard or restore heritage, with promises not being followed up with action. Since 2015, UNESCO has expressed a stronger intent to be a key player in heritage protection during armed conflict, however as long as cultural heritage protection is not considered a humanitarian concern, UNESCO will not be able to circumvent much of the political and bureaucratic barriers facing intergovernmental organisations during conflict, which prevent emergency action from being implemented. In order to ensure heritage safeguarding is permitted during periods of significant unrest, regardless of political discord, it is crucial that UNESCO promote a people-centred approach to its cultural heritage protection initiatives. This book evidences that focusing on livelihoods and meaningful and practical connections between populations and their local heritage to be UNESCO's optimal methodological approach for justifying cultural heritage protection as a humanitarian necessity. The book's readership includes academics, researchers, and practitioners in the fields of political science, law and heritage studies.
