Book The Multinational Enterprise and Legal Control

Download or read book The Multinational Enterprise and Legal Control written by Cynthia Day Wallace and published by Martinus Nijhoff Publishers. This book was released on 2002-04-02 with total page 1364 pages. Available in PDF, EPUB and Kindle. Book excerpt: This long-awaited new book from Cynthia Day Wallace picks up the thread of her best-selling "Legal Control of the Multinational Enterprise: National Regulatory Techniques and the Prospects for International Controls," In the present work she applies herself to legal and pragmatic aspects of control surrounding MNE operations. The primary focus is on legal and administrative techniques and measures practised by host states to control - transparently or less so - foreign MNE activity within their territories, or even extraterritorially when effects are felt within national boundaries. The primary geographic focus is the six most investment-intensive industrialized states (namely, Canada, France, Germany, Japan, the United States and the United Kingdom). At the same time an important message of the present study is precisely the implication for the developing countries as well as for the emerging market economies of central and eastern Europe - and even Asian nations besides Japan, because it is the sharing of this very 'experience of years' that can best serve to facilitate a fuller participation on the part of the up-and-coming economies in the same global market place.

Book The Economics of European Integration

Download or read book The Economics of European Integration written by Willem Molle and published by Routledge. This book was released on 2017-07-12 with total page 524 pages. Available in PDF, EPUB and Kindle. Book excerpt: This title was first published in 2001. As economic integration touches ever more areas of society, more and more people are confronted by the bewildering complexity of the functioning of the European Union. Rather than merely focusing on the description of EU policies, this study of the economics of European integration seeks to: select the most relevant aspects and developments; place the wide variety of issues in a robust conceptual structure; integrate theoretical developments with the results of empirical research and of policy analysis; explain the logic of the dynamic processes; describe the structural features of the European economy; highlight the response of private companies to changes in the regulatory environment; depict the historical developments so as to give a sound basis for the understanding of the present situation and the likely future development; and set the European developments in the light of global developments. In practice Western Europe is the focus of major parts of this book.

Book Stocks for All People s Capitalism in the Twenty First Century

Download or read book Stocks for All People s Capitalism in the Twenty First Century written by Petri Mäntysaari and published by Walter de Gruyter GmbH & Co KG. This book was released on 2021-12-31 with total page 1037 pages. Available in PDF, EPUB and Kindle. Book excerpt: Public stock markets are too small. This book is an effort to rescue public stock markets in the EU and the US. There should be more companies with publicly-traded shares and more direct share ownership. Anchored in a broad historical study of the regulation of stock markets and companies in Europe and the US, the book proposes ways to create a new regulatory regime designed to help firms and facilitate people’s capitalism. Through its comparative and historical study of regulation and legal practices, the book helps to understand the evolution of public stock markets from the nineteenth century to the present day. The book identifies design principles that reflect prior regulation. While continental European company law has produced many enduring design principles, the recent regulation of stock markets in the EU and the US has failed to serve the needs of both firms and retail investors. The book therefore proposes a new set of design principles to serve contemporary societal needs.

Book EC Free Movement of Capital Corporate Income Taxation and Third Countries

Download or read book EC Free Movement of Capital Corporate Income Taxation and Third Countries written by B.J. Kiekebeld and published by Kluwer Law International B.V.. This book was released on 2008-02-20 with total page 258 pages. Available in PDF, EPUB and Kindle. Book excerpt: Free movement of capital is at the heart of the Single Market and is one of its “four freedoms”. It enables integrated, open, competitive and efficient European financial markets and services. For citizens it means the ability to perform many operations abroad, as diverse as opening bank accounts, buying shares in non-domestic companies, investing where the best return is, and purchasing real estate. For companies it principally means being able to invest in and own other European companies and take an active part in their management. With all its benefits, the free movement of capital brings with it an array of thorny issues. This timely work explores several of the most critical, focusing on the practical ability of national law to satisfy the relevant EU requirements

Book The Legal Framework of EU China Investment Relations

Download or read book The Legal Framework of EU China Investment Relations written by Wenhua Shan and published by Bloomsbury Publishing. This book was released on 2005-10-21 with total page 414 pages. Available in PDF, EPUB and Kindle. Book excerpt: EU investment in China has increased dramatically since the early 1990s and is poised to increase further in light of Chinas recent accession to the World Trade Organisation. This book explores and critically appraises the existing legal framework governing EU-China investment relations, particularly EU investment in China. The current legal framework is composed of Chinese law, EU law and applicable international law, but the Chinese law is unsystematic and hard to discover and the EU has acquired only shared external investment competence which is vaguely defined. The applicable international treaties are incomplete, incoherent, or either too general or too specialised. Besides this, the international fora to settle investment disputes are still not readily available. Furthermore while law has played a very important role in decision-making by EU investors, the Chinese legal system is generally perceived as ineffective and lacking in effective enforcement of court and arbitration decisions. What the book demonstrates is that the time is ripe for a new international legal framework for foreign investment in China, and that as EU-China economic and political relations continue to improve, construction of such a framework is not only necessary, but also possible.

Book The New Economic Diplomacy

Download or read book The New Economic Diplomacy written by Nicholas Bayne and published by Routledge. This book was released on 2016-10-04 with total page 345 pages. Available in PDF, EPUB and Kindle. Book excerpt: The New Economic Diplomacy explains how states conduct their external economic relations in the 21st century: how they make decisions domestically, how they negotiate internationally and how these processes interact. Although the previous edition, published in 2011, was able to reflect the impact of the financial crisis and the immediate reaction to it, a lot has happened since then, and the atmosphere of economic diplomacy has darkened. To capture the emergence of new trends and the intensification of old ones, the salient features of this new edition are: The advance of China and other emerging powers at the expense of G7 governments, despite some setbacks; Much greater activity in negotiating regional and plurilateral trade agreements, while the multilateral system struggles; The persistence of problems exposed by the financial crisis, notably the long-running euro-zone crisis. The interaction between domestic and external forces: the balance has shifted towards the domestic axis, with international agreement more difficult to achieve. This edition goes further in comparing the practice of different players, to reflect the greater diversity of economic diplomacy. Based on the authors' work in the field of International Political Economy, it is suitable for students interested in the decision-making processes in foreign economic policy, including those studying international relations, government, politics and economics. It will also appeal to politicians, bureaucrats, business people, NGO activists, journalists and the informed public.
