Book excerpt: In this pioneering work Siraj Sait and Hilary Lim address Islamic property and land rights, drawing on a range of socio-historical, classical and contemporary resources. They address the significance of Islamic theories of property and Islamic land tenure regimes on the 'webs of tenure' prevalent in the Muslim societies. They consider the possibility of using Islamic legal and human rights systems for the development of inclusive, pro-poor approaches to land rights. They also focus on Muslim women's rights to property and inheritance systems. Engaging with institutions such as the Islamic endowment (waqf) and principles of Islamic microfinance, they test the workability of 'authentic' Islamic proposals. Located in human rights as well as Islamic debates, this study offers a well researched and constructive appraisal of property and land rights in the Muslim world.

Book Nigerian Land Law and Custom

Download or read book Nigerian Land Law and Custom written by T. Olawale Elias and published by Taylor & Francis. This book was released on 2024-10-31 with total page 301 pages. Available in PDF, EPUB and Kindle. Book excerpt: Originally published in 1951, Nigerian Land Law and Custom (now with a new preface by Olusoji Elias), the first of its kind, is an excellent comparative study of the whole system of land tenure in Nigeria. There are, of course, a few anthropological attempts, almost invariably designed as or inspired by Government Reports on some specific areas of the country, and their aim is therefore often administrative or fiscal. This book is accordingly an attempt to create a legal order out of the chaos of lay approaches and to examine and systematize, as far as possible, such principles of indigenous tenure as are discernible in available materials in the light of the growing body of case-law. This book will be of value to students and researchers of African law and custom, and of comparative jurisprudence.

Book The Acquisition of Africa 1870 1914

Download or read book The Acquisition of Africa 1870 1914 written by Mieke van der Linden and published by BRILL. This book was released on 2016-10-05 with total page 364 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over recent decades, the responsibility for the past actions of the European colonial powers in relation to their former colonies has been subject to a lively debate. In this book, the question of the responsibility under international law of former colonial States is addressed. Such a legal responsibility would presuppose the violation of the international law that was applicable at the time of colonization. In the ‘Scramble for Africa’ during the Age of New Imperialism (1870-1914), European States and non-State actors mainly used cession and protectorate treaties to acquire territorial sovereignty (imperium) and property rights over land (dominium). The question is raised whether Europeans did or did not on a systematic scale breach these treaties in the context of the acquisition of territory and the expansion of empire, mainly through extending sovereignty rights and, subsequently, intervening in the internal affairs of African political entities.

Book Understanding African Real Estate Markets

Download or read book Understanding African Real Estate Markets written by Aly Karam and published by Taylor & Francis. This book was released on 2022-04-28 with total page 308 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book brings together a broad range of research that interrogates how real estate market analysis, finance, planning, and investment for residential and commercial developments across the African continent are undertaken. In the past two decades, African real estate markets have rapidly matured, creating the conditions for new investment opportunities which has increased the demand for a deeper understanding of the commercial and residential markets across the continent. The chapters consider issues that pertain to formal real estate markets and the critical relationship between formal and informal property markets on the continent. With contributing authors from South Africa, Ghana, Nigeria, Uganda, Kenya, and Tanzania, the book considers the achievements of African real estate markets while also highlighting the complex central themes such as underdeveloped land tenure arrangements, the availability of finance in both the commercial and residential sectors, rapidly growing urban areas, and inadequate professional skills. This book is essential reading for students in real estate, land management, planning, finance, development, and economics programs who need to understand the nuances of markets in the African context. Investors and policy makers will learn a lot reading this book too.
