Book Interprovincial Mobility Rights Under the Charter

Download or read book Interprovincial Mobility Rights Under the Charter written by Martha Jackman and published by . This book was released on 2013 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The mobility rights provisions under section 6 of the Canadian Charter of Rights and Freedoms, require the courts to adjudicate between the interests of the community at large and those of smaller provinces or regions. This article explores the constitutional background and political context in which section 6 was introduced; the treatment of mobility rights in Australia and the United States; the specific language of section 6; and its judicial reception to date. The article suggest that the long-term impact of section 6 will depend on how widely the right, and how narrowly the internal limitations on the right, are interpreted by the courts. The article concludes that assessing section 1 justifications for section 6 violations is an inherently political exercise; requiring the courts to balance competing evidence, opinions and values concerning the benefits of an economic union and of maintaining regional diversity and autonomy.

Book excerpt: Because Canada is a vast country with various economic opportunities distributed throughout its length and breadth, it is important that the right to move, both inside and outside Canada, be reflected in the Canadian Charter of Rights and Freedoms. Section 6, giving every citizen the right to enter, remain in, and leave Canada, recognizes this. It also gives both citizens and permanent residents the right to move into any province and pursue an economic livelihood. This document examines these latter rights which can be reduced by certain types of laws and programs such as extradition or restrictions imposed by provincial legislation on the ability to work in a province.

Book excerpt: Although economic union and free trade among the provinces were major reasons for Confederation, the provisions of the Constitution itself proved defective in ensuring such an outcome. By the beginning of the 1980s, concerns were increasingly raised as to the state of the Canadian economic union. This document puts these matters in an historical context. It also provides an interpretation of section 121 of the Constitution Act of 1867, and includes a debate on economic union prior to 1982.

Book The Charter of Rights and Freedoms

Download or read book The Charter of Rights and Freedoms written by Ian Greene and published by James Lorimer & Company. This book was released on 2014-11-18 with total page 610 pages. Available in PDF, EPUB and Kindle. Book excerpt: Canadas Charter of Rights and Freedoms has transformed Canadian life since it was adopted as part of the Canadian constitution in 1982. The Charter requires judges to make decisions on a wide range of issues that affect all Canadians. In doing so, the courts play a major role in citizens lives. Because of the Charter: - The law against prostitution was struck down. - The Harper government"s treatment of child soldier Omar Khadr was found to violate his rights. - Vancouvers Insite safe injection site was kept open, overriding a federal government decision requiring it to shut down. Ian Greene is a political scientist, and his focus in this book is to highlight the many significant ways the Charter shapes Canadian life. After providing background on the creation and implementation of the Charter, he describes its impact on a wide range of issues aboriginal affairs, voting rights, freedom of religion, the right to strike, and language rights, among others. Greene describes key decisions in these areas and comments on the often-conflicting views of the judges deciding them. Even though the Charter is a legal document, debated by lawyers and decided by judges, Greene approaches his subject with an eye on the political impact the Charter has on governments and ordinary citizens. Public discussion of the Charter is often framed around the question of who should make these important decisions elected politicians or unelected judges. This book provides a clear understanding of how the Charter works and how ordinary citizens have succeeded or failed to win change from the courts. It offers information that people on every side of public discussion can use regarding the role of the Charter in Canadian life.

Book Canadian Charter of Rights and Freedoms

Download or read book Canadian Charter of Rights and Freedoms written by Joseph W. Jacob B.A., M.P.A. and published by Trafford Publishing. This book was released on 2007-02-05 with total page 60 pages. Available in PDF, EPUB and Kindle. Book excerpt: Canada currently has the fairest and most comprehensive charter of rights and freedoms in the world. It is the most important set of laws in Canada, as it overrides all other Canadian laws, including all municipal and provincial statutes. And, the charter was intentionally designed to be difficult to change. With this charter, truthful, proven and demonstrable harm just occur before punishment may be legally imposed (demonstrable justification). This is similar to the charter's guaranteed right of liberty (doing non-harmful actions). A law that has the potential of convicting a person who has not really done anything wrong offends the principles of fundamental justice; and such a law violates a person's right to liberty, under section 7 of the Canadian Charter of Rights and Freedoms. Each person is the proper guardian of their own health, whether bodily, or mental and spiritual. The right most valued by civilized man is the right to be let alone. Specific charter rights also apply to arrest, detention, and bail requirements.

This book was released on 2021-04-30 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: As the law and politics of migration become increasingly intertwined, this thought-provoking Research Handbook addresses the challenge of analysing their growing relationship. Discussing the evolving theoretical approaches to migration, it explores the growing attention given to the legal frameworks for migration and the expansion of regulation, as migration moves to the centre of the political global agenda. The Research Handbook demonstrates that the overlap between law and politics puts the rule of law at risk in matters of migration.
