Internet use has become ubiquitous in the past two decades, but governments, legislators, and their regulatory agencies have struggled to keep up with the rapidly changing Internet technologies and uses. In this groundbreaking collaboration, regulatory lawyer Christopher Marsden and computer scientist Ian Brown analyze the regulatory shaping of “code”—the technological environment of the Internet—to achieve more economically efficient and socially just regulation. They examine five “hard cases” that illustrate the regulatory crisis: privacy and data protection; copyright and creativity incentives; censorship; social networks and user-generated content; and net neutrality. The authors describe the increasing “multistakeholderization” of Internet governance, in which user groups argue for representation in the closed business-government dialogue, seeking to bring in both rights-based and technologically expert perspectives. Brown and Marsden draw out lessons for better future regulation from the regulatory and interoperability failures illustrated by the five cases. They conclude that governments, users, and better functioning markets need a smarter “prosumer law” approach. Prosumer law would be designed to enhance the competitive production of public goods, including innovation, public safety, and fundamental democratic rights.

Book excerpt: The regulation of pornography has always been a contentious issue, which has sparked wide-ranging debates surrounding the acceptability and place of pornography in society. The use of the internet to distribute and access pornography has magnified this debate and has presented a number of challenges for the law in terms of effective and proportionate regulation. Following unsuccessful attempts by states to transpose traditional laws to cyberspace, a new and radical regulatory framework eventually evolved for regulating internet pornography. In this process, the focus of the law has changed from merely controlling the publication and distribution of obscene material to a model that aims to deter private consumption of illegal content. In addition, various self- and co-regulatory initiatives have been introduced with the involvement of non-state actors, imposing a certain degree of de facto liability on intermediaries, all of which raise interesting issues. This book examines the relevant regulatory responses to internet pornography, with particular reference to the UK, but also drawing comparisons with other countries where relevant. It argues that the internet has fundamentally, and in many ways irreversibly, changed the regulation of pornography. Classifying internet pornography into three broad categories – child pornography, extreme pornography, and adult pornography – the book provides an in-depth analysis of the legal issues involved in regulating internet pornography, and argues that the notions of obscenity and indecency on their own will not provide an adequate basis for regulating online pornography. The book identifies the legitimising factors that will lend credibility and normative force to the law in order to successfully regulate pornography in cyberspace. The suggestion has been that the problem can be resolved by either introducing greater competition, or closely policing conditions for vertically integrated service, such as VOIP. However, that is not the whole story, and ISPs as a whole have incentives to discriminate between content for matters such as network management of spam, to secure and maintain customer experience at current levels, and for economic benefit from new Quality of Service standards. This includes offering a 'priority lane' on the network for premium content types such as video and voice service. The author considers market developments and policy responses in Europe and the United States, draws conclusions and proposes regulatory recommendations.

Book excerpt: This Phase 2 Report is a deliverable element of the study being conducted by a team led by RAND Europe into 'Options for and Effectiveness of Internet Self- and Co-Regulation'. The main objective of the study is to assist the Commission in development of a coherent and effective approach to future self- and co-regulation initiatives in the Information Society beyond 2007. In this report, we detail the Phase 2 work. In Phase 2, we assess 21 case studies, and in our further analysis in Phase 3 we will synthesise these findings with other approaches designed to provide gap analysis and reveal emerging and developing areas of regulatory concern. In Phase 1 we mapped existing regulatory and co- and self-regulatory institutions, against a series of case studies and other approaches designed to reveal emerging and developing areas of regulatory concern. There is substantial state of the art in this area and our aim was limited to reviewing, updating and amending where necessary this 'state of the art'. This report consists of six chapters. Chapter 1 explains the choice of specific SROs for the Phase 2 focussed evaluations, and the methodology we adopt (as in the Inception Report). We set the examples against a common set of criteria, and selected and tabulated against these criteria. The substantive Chapters 2-5 contain case studies arranged by four categories: infrastructure and critical resources (Chapter 2); issues affecting content rating (Chapter 3), Internet filtering and reporting of illegal content (Chapter 4); issues that are emerging (Chapter 5). This provides the basis for examination of standards, infrastructure, ISP self-regulation, mass media content, and user-derived content. It also provides the framework to examine personal Internet security, DRM and e-commerce standards. Finally, Chapter 6 details the comparative analysis across case studies, in order to develop patterns, especially with regard to the dynamic evolution of case studies identified in the study period June-September 2007. Further gap analysis bridges the Phase 1 mapping exercise, and Phase 2 detailed examination of a representative and strategically chosen universe of case studies, is to identify the continually emerging environment for new topics and/or sectoral areas of regulatory and/or legislative interest. This concise gap analysis provides the background for the final report explanation of potential areas for further research. In the final section, we detail the work to be undertaken subsequently to complete the study. Appendix 1 details the schedule of interviews and other discussions conducted with stakeholders and experts. Appendix 2 details web survey responses.

Self- and co-regulation responds to many of the same issues and offers some advantages over traditional arrangements -- and some new risks. The evaluation and design (or facilitated evolution) of new regulatory structures further requires new methods of ex post and ex ante assessment. This paper places these developments in the European policy context, considers existing varieties of arrangements, analyses the conditions for their success and failure, and derives impact assessment guidelines that take self- and co-regulation into account.
