To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. She shows how liberalizing authoritarian countries and transitional democracies may experience more shifting patterns and greater levels of violence than less developed and democratic countries, due to changes and uncertainties in economic and political structures. Accordingly, Brysk analyzes the experience of semi-liberal, developing countries at the frontiers of globalization--Brazil, India, South Africa, Mexico, the Philippines, and Turkey--to map out patterns of gender violence and what can be done to change those patterns. As the book shows, gender violence is not static, nor can it be attributed to culture or individual pathology--rather it varies across a continuum that tracks economic, political, and social change. While a combination of international action, law, public policy, civil society mobilization, and changes in social values work to decrease gender violence, Brysk assesses the potential, limits, and balance of these measures. Brysk shows that a human rights approach is necessary but not sufficient to address gender violence, and that insights from feminist and development approaches are essential.

Book excerpt: This book introduces the human right to adequate food and nutrition as evolving concept and identifies two structural "disconnects" fueling food insecurity for a billion people, and disproportionally affecting women, children, and rural food producers: the separation of women’s rights from their right to adequate food and nutrition, and the fragmented attention to food as commodity and the medicalization of nutritional health. Three conditions arising from these disconnects are discussed: structural violence and discrimination frustrating the realization of women’s human rights, as well as their private and public contributions to food and nutrition security for all; many women’s experience of their and their children’s simultaneously independent and intertwined subjectivities during pregnancy and breastfeeding being poorly understood in human rights law and abused by poorly-regulated food and nutrition industry marketing practices; and the neoliberal economic system’s interference both with the autonomy and self-determination of women and their communities and with the strengthening of sustainable diets based on democratically governed local food systems. The book calls for a social movement-led reconceptualization of the right to adequate food toward incorporating gender, women’s rights, and nutrition, based on the food sovereignty framework.

The vast number of extensive reservations to the Convention bear witness to the fact that this is possibly one of the most contentious topics at the international level. Few other core universal human rights conventions have attracted a comparable number of reservations. This unique Guide is an attempt to create a picture of the legal--political background to the Convention. Its basic layout follows the style of a classical commentary with annotations to the individual provisions. These annotations draw on documentary sources from the years of preparatory discussions and negotiations (the travaux préparatoires). It primarily covers the genesis of the Convention, i.e. the drafting and negotiating process up to its adoption in 1979. To enhance the Guide's usefulness, a number of more recent documents have been incorporated, for example, the General Recommendations issued by the Committee on Elimination of Discrimination against Women have been reproduced and references to relevant recommendations have been inserted in the annotations to each provision in question. In addition to this, a number of other documents relative to the interpretation of the Convention have been reproduced in Part III, including lists of ratifications of and reservations to the Convention. Furthermore, lists of relevant global and regional instruments and case law have been compiled.
