Book excerpt: Trade liberalisation has the potential to increase certain unhealthy habits such as smoking and over-consumption of alcohol and unhealthy foods, leading to a corresponding increase in non-communicable diseases ('NCDs'). A range of measures designed to reduce consumption of these products may implicate international trade rules. For example, NCD risk factors may be addressed through: product bans; packaging and labelling requirements; import tariffs; sales taxes; subsidies; licences; restrictions on advertising, promotion or sponsorship; regulation of product content through disclosure or restriction of ingredients; restrictions on ages of sale or purchase; exclusion areas (eg no smoking or no alcohol areas); and education. To a greater or lesser degree, each of these measures could potentially infringe international trade rules and therefore needs to be crafted with those rules in mind. A key aim of this chapter is therefore to provide insights for public health officials and policy-makers in countries around the world on how regulation of NCD risk factors can be optimised to accord with the requirements of international trade law without compromising public health objectives. Despite some problematic examples of recent clashes between international trade law and NCD risk factor regulation (particularly in connection with tobacco), we firmly believe as international trade law scholars that international trade law need not impede sound health policy.

Book excerpt: The Global Community is aware of the imperative implementation of public strategies to reduce risk factors related with Non-Communicable Diseases (NCDs) such as those caused by tobacco, alcohol, and unhealthy food and beverage consumption, particularly those which are marketed towards children and adolescents. The International Set of Recommendations by the World Health Organization (WHO) to combat NCDs, have suggested, not only high income states but also middle and low income states, to face potential policy interventions to address the challenges in controlling this growing health concern. These domestic regulatory actions have sprout tension between public health objectives and WTO because of the potential inconsistency with those trade obligations whose objective is economic growth through freer trade, raising doubts about coherence within international law and state's autonomy. Moreover, the above-mentioned circumstance raises serious doubts about a possible integration between International Health Instruments and WTO-Covered Agreements. The main question is to what extent WTO rulings can take into account international rules or standards related with health to interpret trade obligations. Beneath this context, the Peruvian Government has adopted an Act with the goal of promoting healthy eating among children and adolescents and has disclosed a pre-publication of its regulation force that imposes mandatory health warnings to processed food and non-alcoholic beverages that exceed specific thresholds for sugar, sodium and saturated fats, establishing restrictions on the advertisement of these products focused on infants and adolescents, encouraging consumers to adopt healthier diets; however, this initiative has been extremely discussed by the food industry and health associations, focusing on whether this Act achieves their health goals or if it has negative effects on trade. This paper will analyze the health objectives of the Peruvian Government, examining principally the legal design of the health warnings set into force by the adoption of the Peruvian Junk Food Regulation and how it may collide with WTO obligations, especially under the TBT agreement.

It is the eighth leading risk factor for deaths globally, and harmful use of alcohol was responsible for almost 4% of all deaths in the world, according to the estimates for 2004. In addition to the resolution, a global strategy developed by WHO in close collaboration with Member States provides a portfolio of policy options and interventions for implementation at the national level with the goal to reduce the harmful use of alcohol worldwide. Ten recommended target areas for policy options include health services' responses, community action, pricing policies and reducing the public health impact of illicit alcohol and informally produced alcohol. WHO was also requested to support countries in implementing the strategy and monitor progress at global, regional and national levels.
