These writings are available for the first time in authoritative form in Panopticon versus New South Wales and other writings on Australia, a volume in The Collected Works of Jeremy Bentham published by UCL Press. In the present collection, a distinguished group of authors reflect on Bentham’s Australian writings, making original contributions to existing debates and setting agendas for future ones. In the first part of the collection, the works are placed in their historical contexts, while the second part provides a critical assessment of the historical accuracy and plausibility of Bentham’s arguments against transportation from the British Isles. In the third part, attention turns to Bentham’s claim that New South Wales had been illegally founded and to the imperial and colonial constitutional ramifications of that claim. Here, authors also discuss Bentham’s work of 1831 in which he supports the establishment of a free colony on the southern coast of Australia. In recent years, we have witnessed an unseen popularity of apologies, with numerous politicians, managers and clergymen being eager to apologise and atone for the wrong-doings of their countries or institutions. Public apologies, thus, are a new and highly interesting, while nevertheless still puzzling phenomenon, the precise role and meaning of which in international politics remains to be explored. This book sets out to do exactly this. Focusing in particular on state apologies, it assembles twelve detailed empirical case studies which deal with the two questions raised above. In the first part, the case studies reconstruct the processes in which state representatives react to calls for public atonement, and in the second part the case studies explore the reactions to the apology and evaluate signs for its success or failure. All case studies are based on a theoretical framework which is outlined in the introduction to the book and helps develop tentative assumptions about the emergence and the effects of state apologies, drawing on different strands of literature, such as political science, philosophy, sociology or psychology. Courts, legislatures, and scholars disagree about how the right to security of person should be defined. This book investigates the meaning of the right to security of person through an analysis of its constituent parts. Applying an original conceptual analysis of 'security', the right to security of person imposes both positive and negative duties. Also, identifying the interests to be protected by the right requires a theory of personhood or wellbeing such as Amartya Sen and Martha Nussbaum's 'capabilities approach'. It is accepted that any existing legal rights to security of person must be artificially delineated in order not to overstep the boundaries of other rights. In recognition of the naturally broad meaning of the right to security of person, it is proposed that human rights law as a whole should be seen as a mechanism to further security of person: rights as security.

In this book, Isaac Nakhimovsky reveals the Enlightenment origins of this post-Napoleonic initiative, explaining why it was embraced at first by many contemporary liberals as the birth of a federal Europe and the dawning of a peaceful and prosperous age of global progress. Examining how the Holy Alliance could figure as both an idea of progress and an emblem of reaction, Nakhimovsky offers a novel vantage point on the history of federative alternatives to the nation state. The result is a clearer understanding of the recurring appeal of such alternatives—and the reasons why the politics of federation has also come to be associated with entrenched resistance to liberalism’s emancipatory aims. Nakhimovsky connects the history of the Holy Alliance with the better-known transatlantic history of eighteenth-century constitutionalism and nineteenth-century efforts to abolish slavery and war. He also shows how the Holy Alliance was integrated into a variety of liberal narratives of progress. From the League of Nations to the Cold War, historical analogies to the Holy Alliance continued to be drawn throughout the twentieth century, and Nakhimovsky maps how some of the fundamental political problems raised by the Holy Alliance have continued to reappear in new forms under new circumstances. Time will tell whether current assessments of contemporary federal systems seem less implausible to future generations than initial liberal expectations of the Holy Alliance do to us today.
