Book excerpt: Abstract: This report provides a conceptual foundation for the analysis of international regulatory co-operation (IRC) and its potential benefits through reduced trade costs. Different forms of IRC aiming to reduce specification, conformity assessment and information costs - which can arise from regulatory heterogeneity, costly conformity assessment procedures and insufficient regulatory transparency - are addressed. The report argues that trade costs need to be balanced against the regulatory objectives of mitigating various market imperfections. Integrating these two elements often allows significant gains in terms of national welfare, gains that can be augmented by negotiated outcomes among trading partners. IRC may also have important effects on trade with third countries. Related welfare implications are, however, ambiguous and depend on the specifics of the IRC outcome as well as on third countries' own regulations

Governments generally do not pursue domestic regulation or design trade agreements with a view to support the trade as production model by reducing regulatory differences that have the effect of impeding trade. This paper proposes several mechanisms to help make policy more supportive of regulatory cooperation initiatives that are aimed at reducing excess costs that negatively affect supply chain trade and investments, and that can be incorporated into trade agreements. While the analysis and suggestions are general, specific context and examples are provided by recent trade agreements and regulatory cooperation initiatives involving Canada, the EU and the US.

However, neither of these perspectives offers an adequate understanding of the ways in which international regulatoryrelations are managed or may be managed more effectively. While the one risks overstating the readiness of states to cede regulatory authority to international institutions, the other risks ignoring the reality of and prospects for cooperative behavior.Transatlantic regulatory cooperation comprises a highly differentiated "bundle" of techniques for reconciling the needs of international trade with the diversity of national regulatory environments and public demands. The processes involved are still poorly understood, due partly to the fact thatthey have been very largely improvisational, with the result that the framework of regulatory cooperation is still very much a work in progress. Moreover, the main protagonists in this arena -- the US and EU -- have their own well-established domestic regulatory processes with which internationalinitiatives may not readily be integrated, either in terms of values or institutions. While focusing on illustrative sectoral examples of transatlantic regulatory cooperation, this book thus also explores the more general challenge of accommodating regulatory cooperation with domestic legal andpolitical institutions. The volume closes both by calling attention to inescapable legitimacy questions (e.g. reconciliation with principles of democracy and demands for public accountability) and by exploring certain strategic directions and institutional implications for the future.
