Book excerpt: The effects on national welfare and market access of two important public procurement practices (discrimination and non-transparency) are analyzed with an eye to the ongoing discussions on procurement reform in the Doha Round. The analysis suggests that the welfare payoffs of adopting mechanisms that foster domestic competition and transparency are likely to be greater than the return to efforts to ban international discrimination. However improved transparency, which may well reduce corruption, is unlikely to also result in significant enhancements in market access. This in turn raises questions about the likely enforceability of a WTO agreement on transparency in procurement.

The 'plurilateral' WTO Agreement on Government Procurement, with its challenging accession procedures and limited number of signatories, cannot be said to succeed in its efforts to liberalize this area of trade activity–more than 10 percent of gross domestic product in most countries. Book excerpt: GAO reviewed the government's implementation of the multilateral Agreement on Government Procurement, which was meant to limit signatory governments' use of discriminatory procurement practices as barriers to trade. GAO found that, while the agreement was an important step toward less restrictive trade, it has had less commercial value than originally anticipated because: (1) foreign signatory governments opened a smaller value of procurements to international competition than was projected; (2) some foreign signatory governments did not comply with the agreement; (3) previous agreements and national practices had already opened to American competition procurements covered by the agreement; and (4) American firms were unable to competitively sell products demanded by foreign governments. The U.S. Government opened a greater value of procurements to foreign competition than did all other signatories. GAO also found that the Department of Commerce's efforts to familiarize American firms with the agreement were ineffective because: (1) budgetary constraints and an internal reorganization hampered such efforts; (2) Commerce did not make an effort to reach the firms most capable of benefiting from the agreement through their overseas representatives; and (3) of inefficiencies in Commerce's Trade Opportunities Program (TOP). In addition, GAO found that: (1) embassies devoted little time to efforts to monitor compliance with the agreement because they were unsure about what actions to take regarding noncompliance; and (2) information collection difficulties have prevented the U.S. Government from fully assessing the benefits of the agreement.

Book excerpt: The authors examine the effects on national welfare and market access of two public procurement practices-discrimination against foreign suppliers of goods and services and nontransparency of the procedures used to allocate government contracts to firms. Both types of policies have become prominent in international trade negotiations, including the Doha Round of the World Trade Organization (WTO) trade talks. Traditionally, the focus of international trade agreements has been on market access. However, many developing countries have opposed the launch of negotiations to extend the principle of nondiscrimination to procurement. As a result, the current focus in the Doha Round is on an effort to launch discussions on agreeing to principles of transparency in procurement. While transparency will not constrain the ability of governments to discriminate in favor of domestic firms, it could nonetheless improve market access by reducing corruption. The authors assess and compare the impact of eliminating discrimination and fostering greater domestic competition in procurement markets and enhancing transparency in state contracting. Their analysis concludes that greater domestic competition on procurement markets and greater transparency will improve economic welfare. But there is no clear-cut effect on market access of ending discrimination or improving transparency. This mismatch between market access and welfare effects may account for the slower progress in negotiating procurement disciplines in trade agreements than for traditional border measures such as tariffs, given that market access is the driving force behind trade agreements.

A concerted effort to substantially add to the knowledge base on public procurement reforms in developing countries, through targeted research and international exchange of information on implemented procurement policies and outcomes, is critical to identifying areas where further binding multilateral disciplines may be beneficial.

Book excerpt: Governments are significant buyers of goods and services, and these markets represent immense opportunities for international trade. Government procurement accounts for a substantial proportion of Gross Domestic Product (15-20% or more in most countries). According to OECD data, the world total government procurement is estimated to amount to US$5550 billion in 1998, which is equivalent to 82.3% of the world merchandise and commercial services exports in 1998. The world value of government procurement that is potentially opened up to international trade is estimated at US$2083 billion, which is equivalent to 7.1% of the world Gross Domestic Product (GDP) or 30.1% of the world merchandise and commercial services exports. For the OECD countries as a whole, the ratio of total procurement for all levels of government is estimated at 19.96% of GDP in 1998 or US$4733 billion, and for non-OECD countries, it is estimated at 14.48% of GDP or US$816 billion. However, despite governments being among the largest purchasers of goods and services in individual countries, this market has nevertheless been one of the most protected in respect of international trade. Most countries enforce some level of control over government procurement practices that discriminates against foreign suppliers in favour of domestic entities. This paper traces the evolution of the GATT and WTO multilateral disciplines with regard to government procurement since the last 25 years and attempts to address some of the fears and myths about the WTO Government Procurement Agreement (GPA) so as to provide a better understanding of the benefits arising from improved multilateral disciplines in government procurement and the gains to be derived from membership in the GPA.
