The recent changes in the plans of work at the War College have made necessary some modifications in the method of treatment of the subjects in the conferences. It has seemed best, however, that the printed volume should in the main correspond to the earlier volumes. Book excerpt: Excerpt from International Law Topics and Discussions The Navy Department, as has been the practice in recent years, assembled at the Naval War College on June 1, 1905, a conference of officers, a majority of whom were of high rank and long experience, to occupy four months in the discussion of the battle tactics and strategy of the fleet, and of those unsettled questions of international law which at times have seemed to threaten universal war. The topics considered in this volume are of vital interest, and it is desirable to make clear the manner in which the work was performed. They were formulated before the opening of the conference by the lecturer, Mr. George Grafton Wilson, professor in Brown University, in consultation with the president and staff of the War College. The officers were divided into committees when the conference assembled, and at stated intervals the committees submitted reports upon the several topics; the reports were then fully and freely discussed in a general conference participated in by the lecturer, the president and staff of the college, and all the officers in attendance. The conclusions published are those accepted in the general conference and may be fairly held to be without bias, since it is evident that in the future the United States may be affected either as neutral or as belligerent, and since the topics do not relate to questions pending. The field is wide and the time limited, but the work is justified, if besides increasing our knowledge it has contributed in any degree to the formulation of agreements tending to avert or ameliorate war. The Naval War College has planned from year to year to consider some of these problems. Book excerpt: Excerpt from The American Journal of International Law, 1914, Vol. 8 The principle of international law is, of course, not regarded as depend ent on the will of any particular state: some further authorization is necessary. This is well recognized by the United States in the fulfillment of its obligation with regard to hostile expeditions. The American courts, in so far as they are not bound by statute, apply the law derived from the practice of all nations and are not restricted to purely American authorities.' But in the absence of clear and definite rules developed by long custom in the world at large, we are compelled to resort to the evidence of the most extensive precedents. In one sense the practice of the United States is to be regarded as a source of the principle of international law. It is that most extensive practice wherein the best evidence of the law is likely to be found. Furthermore, since this is a country which has had much to do with expeditions, the consensus of international opinion is incomplete without large regard for the American attitude toward the subject. The principles with regard to the present subject have come to be recognized largely through their application by the. Book excerpt: Excerpt from International Law Topics: Neutrality Proclamations and Regulations; With Notes, 1916 In view of the communications received by the executive power from the imperial and royal legation of Austria-Hungary on July 26, making known the rupture of relations between that country and Serbia; from the diplomatic representatives of Russia and Germany under dates of August 2 and 3, respectively, making known the state of war existing between the two countries; from the German legation on August 4, declaring that the Empire finds itself in a state of war with France; from the legation of His Britannic Majesty on the present date declaring that the United Kingdom finds itself at war with the German Empire; from the legation of Belgium of the present date giving notice that the German troops have penetrated into its territory and that its Government has decided to resist by force, and considering: That the state of war existing between nations friendly to the Argentine Republic imposes the necessity of determining the criterion and the rules of conduct which it is proper to adopt to maintain the neutrality of the Republic during the conflict, That the principles of international law consecrated by the opinion of authors and by the practice of nations have been condensed in the clauses of the convention signed at The Hague October 18, 1907, That although this convention, signed by the Argentine plenipotentiaries, has not yet been approved by the congress, this circumstance does not diminish the value which it possesses as a body of doctrine for determining the duties and the rights of neutral nations in case of war, That it is indispensable in order to conform to the sentiments of the Argentine Government, to assure the greatest uniformity of treatment toward all the belligerent nations, The Vice President of the Argentine nation decrees: Article 1. While the state of war between the nations above mentioned or between any of them shall continue, the Government of the Argentine Republic will maintain the strictest neutrality.
