Book International Indictments for crimes of mass murder in Darfur

Download or read book International Indictments for crimes of mass murder in Darfur written by Christopher King and published by GRIN Verlag. This book was released on 2013-10-09 with total page 16 pages. Available in PDF, EPUB and Kindle. Book excerpt: Seminar paper from the year 2012 in the subject Politics - Topic: Public International Law and Human Rights, grade: 1,0, Indiana University (Department of Political Science), course: Politics of Genocide, language: English, abstract: “Until now, when powerful men committed crimes against humanity, they knew that so long as they remained powerful, no earthly court could judge them.” (Annan, Kofi, 07.28.1998) These words of Kofi Annan, at that time secretary-general of the United Nations, were spoken shortly after the adoption of the Rome Statute of the International Criminal Court (ICC). They reflect the international effort to investigate and prosecute cruel crimes against humanity, war crimes, the crime of aggression and genocide. The intent of this paper is to present a stance on the question whether international indictments for crimes of mass murder in Darfur are appropriate and justified. It will be argued, that the international community has to punish perpetrators of mass violence under certain conditions, because of the following crucial points: (2.1) The international community has the moral and legal obligation to do so, (2.3) international justice should be pursued independently of regards to the peace process, (2.4) it may deter others and possibly produce domestic pressures and changes. Moreover, to be able to develop guidelines and policy recommendations the paper will also consider (2.2) the types of international punishment and who carries them out, as well as (2.5) examine the real capability of punishment and criteria of success. Before doing so, it is inevitable to (1.1) introduce the conflict, (1.2) the genocide debate and (1.3) the international response to the killings, because the stance on the use of international justice in Darfur is ultimately shaped by the interpretation of these issues.

Book Darfur and the Crime of Genocide

Download or read book Darfur and the Crime of Genocide written by John Hagan and published by Cambridge University Press. This book was released on 2008-10-13 with total page 379 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 2004, the State Department gathered more than a thousand interviews from refugees in Chad that verified Colin Powell's UN and congressional testimonies about the Darfur genocide. The survey cost nearly a million dollars to conduct and yet it languished in the archives as the killing continued, claiming hundreds of thousands of murder and rape victims and restricting several million survivors to camps. This book fully examines that survey and its heartbreaking accounts. It documents the Sudanese government's enlistment of Arab Janjaweed militias in destroying black African communities. The central questions are: why is the United States so ambivalent to genocide? Why do so many scholars deemphasize racial aspects of genocide? How can the science of criminology advance understanding and protection against genocide? This book gives a vivid firsthand account and voice to the survivors of genocide in Darfur.

Book Genocide in Darfur

Download or read book Genocide in Darfur written by Samuel Totten and published by Routledge. This book was released on 2013-01-11 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: In response to the ongoing mass murder of Black Sudanese groups in the Darfur region of Sudan by Sudanese government troops and Arab militias, the US government sent the Darfur Atrocities Documentation Team to various points along the Chad/Sudan in order to interview refugees from Darfur. Based on their investigation, US Secretary of State Colin Powell formally announced that ‘genocide has occurred in Darfur and may still be occurring.’ The United States officially accused the government of Sudan of perpetrating genocide - the first time that any government has officially and publicly accused another government of genocide. As a result the United States played a key role in pressuring the United Nations Security Council to pass a resolution calling for several measures, including an official UN Commission of Inquiry to conduct a genocide investigation in Sudan itself. This was the first time that any signatory of the Genocide Convention actually triggered provisions of the Convention requiring a UN Security Council response while genocide was occurring. This book is comprised of essays from contributors who were involved in designing the project and hiring and training investigators, interpreters, and support personnel; US government and nongovernmental organization (NGO) officials involved in the genesis of the project as well as the analysis of the data; and numerous scholars, not all of whom were directly involved with the project, who critique aspects of the documentation project as well as its significance.

This militia was known for its brutal attacks on civilians, including killings, ambushes, the razing of villages, and the burning of homes. The Darfur conflict has led to the deaths of thousands of people, including many innocent civilians. More than two million people have been displaced as a result of the violence and conflict. Download or read book Justice in Conflict written by Mark Kersten and published by Oxford University Press. This book was released on 2016-08-04 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: What happens when the international community simultaneously pursues peace and justice in response to ongoing conflicts? What are the effects of interventions by the International Criminal Court (ICC) on the wars in which the institution intervenes? Is holding perpetrators of mass atrocities accountable a help or hindrance to conflict resolution? This book offers an in-depth examination of the effects of interventions by the ICC on peace, justice and conflict processes. The 'peace versus justice' debate, wherein it is argued that the ICC has either positive or negative effects on 'peace', has spawned in response to the Court's propensity to intervene in conflicts as they still rage. This book is a response to, and a critical engagement with, this debate. Building on theoretical and analytical insights from the fields of conflict and peace studies, conflict resolution, and negotiation theory, the book develops a novel analytical framework to study the Court's effects on peace, justice, and conflict processes. This framework is applied to two cases: Libya and northern Uganda. Drawing on extensive fieldwork, the core of the book examines the empirical effects of the ICC on each case. The book also examines why the ICC has the effects that it does, delineating the relationship between the interests of states that refer situations to the Court and the ICC's institutional interests, arguing that the negotiation of these interests determines which side of a conflict the ICC targets and thus its effects on peace, justice, and conflict processes. While the effects of the ICC's interventions are ultimately and inevitably mixed, the book makes a unique contribution to the empirical record on ICC interventions and presents a novel and sophisticated means of studying, analyzing, and understanding the effects of the Court's interventions in Libya, northern Uganda - and beyond.

Book The Responsibility to Protect

Download or read book The Responsibility to Protect written by Gareth Evans and published by Rowman & Littlefield. This book was released on 2009-08-01 with total page 369 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Never again!" the world has vowed time and again since the Holocaust. Yet genocide, ethnic cleansing, and other mass atrocity crimes continue to shock our consciences—from the killing fields of Cambodia to the machetes of Rwanda to the agony of Darfur. Gareth Evans has grappled with these issues firsthand. As Australian foreign minister, he was a key broker of the United Nations peace plan for Cambodia. As president of the International Crisis Group, he now works on the prevention and resolution of scores of conflicts and crises worldwide. The primary architect of and leading authority on the Responsibility to Protect ("R2P"), he shows here how this new international norm can once and for all prevent a return to the killing fields. The Responsibility to Protect captures a simple and powerful idea. The primary responsibility for protecting its own people from mass atrocity crimes lies with the state itself. State sovereignty implies responsibility, not a license to kill. But when a state is unwilling or unable to halt or avert such crimes, the wider international community then has a collective responsibility to take whatever action is necessary. R2P emphasizes preventive action above all. That includes assistance for states struggling to contain potential crises and for effective rebuilding after a crisis or conflict to tackle its underlying causes. R2P's primary tools are persuasion and support, not military or other coercion. But sometimes it is right to fight: faced with another Rwanda, the world cannot just stand by. R2P was unanimously adopted by the UN General Assembly at the 2005 World Summit. But many misunderstandings persist about its scope and limits. And much remains to be done to solidify political support and to build institutional capacity. Evans shows, compellingly, how big a break R2P represents from the past, and how, with its acceptance in principle and effective application in practice, the promise of "Never

Download or read book Blood and Soil written by Ben Kiernan and published by Yale University Press. This book was released on 2008-10-01 with total page 735 pages. Available in PDF, EPUB and Kindle. Book excerpt: A book of surpassing importance that should be required reading for leaders and policymakers throughout the world For thirty years Ben Kiernan has been deeply involved in the study of genocide and crimes against humanity. He has played a key role in unearthing confidential documentation of the atrocities committed by the Khmer Rouge. His writings have transformed our understanding not only of twentieth-century Cambodia but also of the historical phenomenon of genocide. This new book—the first global history of genocide and extermination from ancient times—is among his most important achievements. Kiernan examines outbreaks of mass violence from the classical era to the present, focusing on worldwide colonial exterminations and twentieth-century case studies including the Armenian genocide, the Nazi Holocaust, Stalin’s mass murders, and the Cambodian and Rwandan genocides. He identifies connections, patterns, and features that in nearly every case gave early warning of the catastrophe to come: racism or religious prejudice, territorial expansionism, and cults of antiquity and agrarianism. The ideologies that have motivated perpetrators of mass killings in the past persist in our new century, says Kiernan. He urges that we heed the rich historical evidence with its telltale signs for predicting and preventing future genocides.

Book Stalin s Genocides

  • Author : Norman M. Naimark
  • Publisher : Princeton University Press
  • Release : 2010-07-19

Download or read book Stalin s Genocides written by Norman M. Naimark and published by Princeton University Press. This book was released on 2010-07-19 with total page 176 pages. Available in PDF, EPUB and Kindle. Book excerpt: The chilling story of Stalin’s crimes against humanity Between the early 1930s and his death in 1953, Joseph Stalin had more than a million of his own citizens executed. Millions more fell victim to forced labor, deportation, famine, bloody massacres, and detention and interrogation by Stalin's henchmen. Stalin's Genocides is the chilling story of these crimes. The book puts forward the important argument that brutal mass killings under Stalin in the 1930s were indeed acts of genocide and that the Soviet dictator himself was behind them. Norman Naimark, one of our most respected authorities on the Soviet era, challenges the widely held notion that Stalin's crimes do not constitute genocide, which the United Nations defines as the premeditated killing of a group of people because of their race, religion, or inherent national qualities. In this gripping book, Naimark explains how Stalin became a pitiless mass killer. He looks at the most consequential and harrowing episodes of Stalin's systematic destruction of his own populace—the liquidation and repression of the so-called kulaks, the Ukrainian famine, the purge of nationalities, and the Great Terror—and examines them in light of other genocides in history. In addition, Naimark compares Stalin's crimes with those of the most notorious genocidal killer of them all, Adolf Hitler.
