Never truly having receded into a romanticized past, seaborne banditry’s rapid growth was stimulated by low risks and increasingly high rewards. Currently, obsolete, incomplete and complicating structures and norms of governance, together with advances in technology, enable a lucrative business model for pirates, as they effectively operate with impunity and claim increasing ransoms. Beginning with an overview and historical development of piracy and the relevant maritime governance structures, this work progresses to examine how 20th century shifts in global governance norms and structures eventually left the high seas open for predatory attacks on one of the worlds fastest growing and essential industries. Moving through contemporary debates about how to best combat piracy, the work concludes that the solution to a chronic global problem requires a long-term, holistic, and inclusive approach. Much attention has focused on Somalia, but piracy is a problem worldwide. Recent coordination efforts among states in South East Asia appear to have helped in the area, but elsewhere piracy has expanded. Interestingly, international law has long recognized piracy as a crime and provided tools for universal suppression, yet piracy persists. In this book, a handpicked group of leading experts in the field of International Relations use maritime piracy as a means to expose the incongruities in our understanding of global governance. Using broadly constructivist approaches to understand international actors’ responses to the challenges created by maritime piracy, the contributors question a number of myths and misconceptions around piracy and analyze the various ways that international law and organizations channel actors’ understandings of maritime piracy and their efforts to respond to it. In doing so, they expose some shaky foundations for IR theorists: how do we conceive of governance and legitimacy when they are delinked from the territorial aspect of the modern nation-state? What happens to prospects for cooperation when we get to the nitty-gritty questions of practice related to paying for trials, imprisoning and maintaining captured pirates, bearing the burden of policing sea-lanes, or even determining what constitutes a pirate? Does anyone have a monopoly on the legitimate use of force at sea, and how is that legitimacy constructed? Maritime Piracy and the Construction of Global Governance offers an improved theoretical understanding of the response of the international community to maritime piracy and broadens our understanding of the complex and sometimes countervailing motivations of all the actors involved, from international organizations and states down to the pirates themselves.

Book excerpt: International counter-piracy efforts have so far been focused on containing rather than solving the problem of piracy off the coast of East Africa. An effective strategy for resolving the threat of piracy in the long-term will require the international community to engage in extensive development efforts on land; to work with African partner nations to increase the capacity and capabilities of national and regional governments; and to provide viable economic alternatives to would-be pirates. Many of these strategies are already underway in West Africa, where the United States government in particular has undertaken a broadly holistic approach to maritime security. The security and political situation in Somalia has so been far less conducive to a land-based approach: but it is certainly within the US interest to explore development- and governance-based counter-piracy initiatives as circumstances allow. Unless the international community becomes willing to invest in a land-based solution to Somalia's dire political, economic, and humanitarian distress, the plague of Somali piracy will continue.

This book originates from the NATO Advanced Research Workshop (ARW) Counter-Terrorism Lessons from Maritime Piracy and Narcotics Interdiction, held in Copenhagen, Denmark, in May 2019. Participants in the three-day workshop included policymakers, senior military officers, and academics from NATO member states, international organizations, and two partner nations: Colombia and Israel. Their extensive discussions focused on methods for protecting critical maritime infrastructure, such as ports, supplies, and personnel, from seaborne terrorist attacks. Presentations and roundtables also addressed the human and social factors that contribute to the defense against terrorism in the maritime domain. The book is divided into three sections: organized crime and narcotrafficking; maritime piracy; and terrorism, and aims to bridge the gaps between these three substantive areas of maritime security research. These have remained largely separate areas of research in the past, with the result that valuable maritime security lessons from counter-piracy and counter-narcotics operations have not been fully incorporated into counter-terrorism best practice. The book facilitates the transmission of lessons learned from counter-piracy and counter-narcotic operations to formulate recommendations for best practice and technological innovations to manage maritime terrorism, and will be of interest to all those working in the field.

Our Policy provides that we shall “continue to lead and support international efforts to repress piracy and urge other States to take decisive action both individually and through international efforts.”5 Through this Plan, the United States will seek to involve all nations, international organizations, industry, and other entities that have an interest in maritime security to take steps to repress piracy and related maritime crime. An integrated and comprehensive approach, through international coordination and cooperation, will advance objectives that enhance the global economy and promote freedom of the seas. The nations of the world have long considered pirates to be universal enemies of mankind. Under customary international law, as reflected in the 1982 Law of the Sea Convention, every nation has jurisdiction to prosecute a suspected pirate for the crime of piracy, regardless of any connection between the State and the suspected pirate, the vessel, or the victims. Our interdependent and interconnected global society revolves around a world economy that depends upon maritime shipping. Governments must collaborate with international organizations and the shipping industry to confront and repress any persistent threat to global commerce.Piracy and related maritime crime continue to plague mariners throughout the world and will continue to pose obstacles to the lawful use of the maritime domain. Due to changing conditions around the world, this Plan and its annexes will be periodically reviewed and updated to reflect United States Government policy regarding countering piracy and related maritime crime. As required, scalable, flexible annexes will be developed to address regional maritime criminal activities and coordinate U.S. and international policies to prevent, suppress, and prosecute these crimes effectively. Flag, victim, and coastal States all have a stake in repressing piracy and related maritime crime. The United States will continue to foster international cooperation and integration among nations, international organizations, and industry, and to support and encourage affected States to exercise jurisdiction, including efforts to build justice-sector capacities. The United States will provide appropriate investigative and logistical support and assistance to other foreign States involved in response to acts of piracy and related maritime crime. When appropriate, the United States will prosecute persons or entities involved in piracy and related maritime crime.

Collaborative human-centric information support systems can significantly improve the ability of every nation to predict and prevent pirate attacks, or to recognize the nature and size of an attack rapidly when prevention fails, and improve the collective response to an emergency. This book presents the papers delivered at the NATO Advanced Study Institute (ASI) Prediction and Recognition of Piracy Efforts Using Collaborative Human-Centric Information Systems, held in Salamanca, Spain, in September 2011. A significant observation from previous NATO Advanced Study Institutes and Workshops was that domain experts responsible for maritime security were not fully aware of the wide variety of technological solutions available to enhance their support systems, and that although technology experts have a general understanding of the requirements in security systems, they often lacked knowledge concerning the operational constraints affecting those who implement security procedures. This ASI involved both technology and domain experts, as well as students from related fields of study. It offered an opportunity for them to discuss the issues surrounding the prediction, recognition and deterrence of maritime piracy, and will be of interest to all those whose work is related to this internationally important issue.
