This book has its genesis in a symposium of the International Water and Resource Economics Consortium held at Annapolis, Maryland, April 13-16, 1997. The symposium was organized by the editors and the book contains papers presented at the symposium with subsequent revisions. The symposium brought together both economists and agency management personnel for the purpose of discussing not only how economic tools apply to trans-boundary water management, but also of identifying the obstacles to making such tools useful and informative to politicians and negotiators in public decision making roles. INTERNATIONAL VERSUS DOMESTIC TRANS-BOUNDARY PROBLEMS Trans-boundary water problems arise in many dimensions. The two most important types of problems emphasized in this book are international and domestic interstate or interregional problems. Cooperation on international problems is especially difficult because enforcement must be voluntary given the sovereignty of nations and the absence of an effective legal enforcement mechanism. Agreements must be sustainable and self-enforced if they are to have lasting benefits. Every negotiating country must be convinced it will receive benefits before it gives its consent to cooperation. Hillel replied, ‘Love your neighbour as yourself. That is the entire Torah. The rest is simply an explanation. Go and learn it!’ In much the same way, Jewish law can be described in one word—Torah. All the rest is simply an explanation. The Torah, also known as the Bible, the five books of Moses, and the Pentateuch, was written over 3,000 years ago. Since then, Jewish law has developed various interpretations and applications of the Torah, interpretations of those interpre- tions, and so on. Jewish law contains civil dictates as well as religious protocol. Problems that arose in the framework of religious life and problems surrounding civil relationships both found solutions in the same legal source—the Torah and the Halacha, the Jewish legal interpretations and rulings. This chapter on water law in the Jewish tradition provides insight into Jewish law and custom in general, and rules related to the protection of water sources in particular. One should not look, however, to find a written code of Jewish law, as there is none.

This book provides an understanding of water security in Asia by investigating how shared water resources affect China’s relationships with neighbouring countries in South, East, Southeast and Central Asia. Since China is an upstream state on most of its shared transboundary rivers, the country’s international water policy is at the core of Asia’s water security. These water disputes have had strong implications for China’s interstate relations, and also influenced its international water policy alongside domestic concerns over water resource management. This book investigates China’s policy responses to domestic water crises and examines China’s international water policy as well as its strategy in dealing with international cooperation. The authors describe the key elements of water diplomacy in Asia which demonstrate varying degrees of effectiveness of environmental agreements. However, we need to move beyond defining cooperation to understand better measures of the quality and effectiveness of cooperative processes. The Weighted Model of Effective Cooperation presents a first step in qualitatively evaluating the effectiveness of transboundary water cooperation. This model defines effective transboundary water cooperation and operationalizes a method to evaluate the effectiveness of cooperative processes over internationally shared waters. Effective cooperation emphasizes the relational and outcome frames of cooperation while working towards equitability and sustainability. Together, the Four Frames of Cooperation and the Weighted Model of Effective Cooperation will improve the understanding of cooperation and encourage a detailed evaluation of the quality, success, and effectiveness of cooperative processes. This book will be of great interest to students and scholars of water resource management, water governance, and environmental politics. It will also appeal to policymakers and professionals working in the fields of water conflict, water diplomacy, and international cooperation.

Nepal is not able to harness its water resources, while India is seeking cooperation in order to utilise the shared water. Lack of trust, negotiations and compromise along with vested political interests have affected the degree of cooperation over shared rivers between India and Nepal. To make cooperation more fruitful, the two countries first need to build trust, identify the merits and demerits, compromise for the sake of the common good, share information with each other and implement the mutually agreed upon cooperation package. The essays in this volume bring together a spectrum of viewpoints on this issue. This volume is the outcome of an international conference on this subject organised by the Maulana Abul Kalam Azad Institute of Asian Studies, Kolkata (MAKAIAS) in collaboration with the B. P.
