Book excerpt: This paper contains four distinct parts relating to the preparation for the Second International Conference on Indo-Chinese Refugees held in Geneva in June 1989. The Introduction presents the developments which led up to the decision to convene the Conference, beginning with the foreign ministers meeting of the Association of South-East Asian Nations (ASEAN) in Bangkok in 1988 and a Preparatory Conference in Kuala Lumpur in March 1989. It was during this latter meeting that a draft proposal for a Comprehensive Plan of Action for achieving durable solutions to the region's refugee problem was approved. The second section describes the refugee situation in South East Asia and the 1979 Geneva Meeting designed to establish the basic framework for responding to the exodus of refugees in the region. The breakdown of the system for handling the situation and the lack of a workable range of humane alternatives led, according to the report, to ASEAN's appeal. The third brief section describes the various conferences held and the preparation for the Comprehensive Plan of Action. The fourth section is the Plan itself, which includes a broad framework for attacking the root causes of mass exodus while more firmly establishing international responsibility. The Plan has four major areas: it moves towards a de-coupling of the provision of first asylum from a prerequisite by countries outside the region to large-scale resettlement of Vietnamese; it seeks more regular relationships with Viet Nam regarding departure and return; movements of people out of Viet Nam and Laos are to be handled in a humanitarian manner; the Plan suggests the possibility of alternatives to voluntary return of those who do not meet the criteria for consideration as refugees.

The report elaborates on the debates and activities which took place during the Conference. Appendices to the report contain the official Conference documents, a statement by the non-government community, a statement by the UN High Commissioner for Refugees, selected statements by participating governments (Australia, Britain, Hong Kong, Vietnam) and UNHCR Background papers.

Book excerpt: This statement, prepared for the International Conference on Indo-Chinese Refugees by the Advocacy Planning Task Force, an ad hoc group of Indo-Chinese-American community leaders based in the Washington DC area, and endorsed by 145 Indo-Chinese organizations in the United States, Canada and Europe, expresses the concern of the overseas Indo-Chinese community about the present treatment of asylum seekers from the Indo-Chinese region. The statement also reflects their concern regarding measures proposed at the International Conference. In the first part of the statement, the authors recommend, in particular, that any international arrangements and practices being worked out for Vietnamese should apply equally to asylum seekers from Laos and Kampuchea, and that Kampucheans should be given the status of refugees rather than 'displaced persons' as in the past. Section II is a 'Call to Action' to ensure safe refuge, genuine protection and timely resettlement for all Indo-Chinese asylum seekers. The third and final section offers specific recommendations regarding the implementation of elements contained in the Comprehensive Plan of Action adopted by the Conference. These elements consist of screening, orderly departure programmes, repatriation, resettlement and oversight and enforcement mechanisms.

Book excerpt: The flow of Indo-Chinese asylum seekers, and of Vietnamese boat people in particular, has been the focus of international concern for over a decade. In recent years the numbers of asylum seekers have risen dramatically, reaching some 90,000 in first-asylum camps in mid-1989. Hence the decision to convene an International Conference on Indo-Chinese Refugees in Geneva from 13-14 June 1989. The objective of the Conference was to reach agreement on a new, comprehensive approach to the problem of refugees and asylum seekers from Indo-China, in particular those from Viet Nam and Laos, and to establish a new set of arrangements which would safeguard the fundamental principles of refugee protection, while taking into account the countries of first asylum, of origin and of resettlement. The Conference adopted a Comprehensive Plan of Action, as proposed by a Preparatory Meeting held in Kuala Lumpur from 7-9 March 1989. The Plan of Action contains eight inter-related components, which are to be implemented simultaneously in an effort to find solutions to the ongoing problem of refugees and asylum seekers in the region. The Conference also took note of a series of documents prepared by UNHCR on modalities for the implementation of the various components of the Plan. The issues covered include national procedures for the determination of refugee status, refugee departures, repatriation, the question of unaccompanied minors, rescue at sea, resettlement plans and the special case of Laotian asylum seekers. Finally, the verbatim text of the closing statement delivered by the President of the Conference is included in this collection of papers.
