Book excerpt: The following declaration by the Chairman of the Revolutionary Council of the Union of Burma is published for general information: WHEREAS international Law has always recognised that the sovereignty of a State extends to a belt of sea adjacent to its coast, AND WHEREAS international practice is not uniform as regards the extent of this sea belt commonly known as the territorial sea of the State, and consequently it is necessary to make a declaration as to the extent of the territorial sea of the Union of Burma, the Chairman of the Revolutionary Council of the Union of Burma hereby declares--That notwithstanding any rule of law or practice to the contrary which may have been observed in the past relating to the Union of Burma or any part thereof, the territorial sea of the Union of Burma shall extend into the sea to a distance of twelve nautical miles measured from the appropriate base line. Except as provided for in paragraph 3, the low-water line along the coast, as marked on large-scale charts officially recognised by the Government of the Union of Burma, shall be the base line for measuring the breadth of the territorial sea of the Union of Burma. That where it is necessary by reason of the geographical conditions prevailing on the Union of Burma coasts, and for the purpose of safeguarding the vital economic interest of the inhabitants of the coastal regions, to establish the system of straight base lines drawn between fixed points on the mainland, on islands or rocks, the breadth of the territorial sea shall be measured from such base lines. The fixed points between which such straight base lines shall be drawn are indicated in detail in the schedule annexed to this declaration.

Book International Boundary Study Series A Limits in the Seas Number 42 Straight Baselines Ecuador

Download or read book International Boundary Study Series A Limits in the Seas Number 42 Straight Baselines Ecuador written by DEPARTMENT OF STATE WASHINGTON DC BUREAU OF INTELLIGENCE AND RESEARCH. and published by . This book was released on 1972 with total page 14 pages. Available in PDF, EPUB and Kindle. Book excerpt: Ecuadorean straight baselines were proclaimed most recently by Supreme Decree No. 959-A on June 28, 1971 (Official Register No. 265 of July 13, 1971). The Decree established straight baselines adjacent to the mainland and around the Galapagos Islands (Archipelago de Colon). However, the existence of straight baselines around the Galapagos Islands has been inferred since 1950. Neither the inferred 1950 nor the 1971 straight baselines have been published on official Ecuadorean charts. Ecuador claims a 200-nautical-mile territorial sea measured seaward from the straight baselines. The 200-nautical-mile claim was promulgated by Decree 1542 of November 10, 1966. Waters within the baselines of both the mainland and the Galapagos Islands are considered to be internal waters. Ecuador is not a party to the four 1958 Geneva conventions on the law of the sea. These conventions concern (1) the territorial sea and contiguous zone, (2) the high seas, (3) the continental shelf, and (4) fishing and conservation of living resources of the high seas. (Author).

Book International Boundary Study Series A Limits in the Seas Number 44 Straight Baselines Argentina

Download or read book International Boundary Study Series A Limits in the Seas Number 44 Straight Baselines Argentina written by DEPARTMENT OF STATE WASHINGTON DC BUREAU OF INTELLIGENCE AND RESEARCH. and published by . This book was released on 1972 with total page 6 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Government of Argentina, by declaration and legislation, has created a system of straight baselines. The system, however, appears to relate more to claims based on the historic bay theory than to the articles of the Geneva Convention on the territorial sea, which apply to straight baselines. The system enclosed the estuary of the Rio de la Plata, which is shared geographically with Uruguay, and the gulfs of San Matias, Nuevo, and San Jorge. The Rio de la Plata estuary was included in the United Nations document (A/CONF. 13/1) 'Memorandum Concerning Historic Bays' prepared for the 1958 Geneva Conference on the law of the sea. The bases for the claims to historicity for the remaining bays are not known. (Author).

Book International Boundary Study Series A Limits in the Seas Number 45 Maritime Boundary Mexico United States

Download or read book International Boundary Study Series A Limits in the Seas Number 45 Maritime Boundary Mexico United States written by DEPARTMENT OF STATE WASHINGTON DC BUREAU OF INTELLIGENCE AND RESEARCH. and published by . This book was released on 1972 with total page 8 pages. Available in PDF, EPUB and Kindle. Book excerpt: On November 23, 1970, the Governments of Mexico and the United States signed a treaty for the clarification of the Rio Grande boundary and the creation of maritime boundaries between the claimed 12-nautical-mile Mexican territorial sea and the territorial sea and contiguous zone of the United States. The treaty delimits, in principle, the lines of separation in the Gulf of Mexico and in the Pacific Ocean. The two governments then established the final lines which were represented, at reduced scales, on two maps affixed to the treaty. (Author).

Book International Boundary Study Series A Limits in the Seas Number 36 National Claims to Maritime Jurisdictions

Download or read book International Boundary Study Series A Limits in the Seas Number 36 National Claims to Maritime Jurisdictions written by DEPARTMENT OF STATE WASHINGTON DC BUREAU OF INTELLIGENCE AND RESEARCH. and published by . This book was released on 1972 with total page 144 pages. Available in PDF, EPUB and Kindle. Book excerpt: The following list of national claims to maritime jurisdictions has been compiled and collated from the latest available official sources. The document is intended to be a research and reference tool and it does not necessarily constitute an official acceptance or recognition by the United States Government of the claims or of the specific principles or practices involved therein. While every effort has been made to insure the accuracy and reliability of the list, there may be mistakes and the user is requested to note any errors of omission or commission. Corrections should be forwarded to the Office of the Geographer, Department of State, Washington, D.C. 20520. As a cautionary note, the sections concerned with (a) bilateral and multilateral fishing agreements, and (b) maritime pollution legislation and agreements are considered to be of a lower degree of accuracy and completeness than the other portions of the study. As new data become available, correction sheets for the individual countries will be issued. Original recipients of the National Claims to Maritime Jurisdictions should receive these change sheets automatically. Inquiries on their status may be made to the address listed in the paragraph above. (Author).

Book Law of the Sea in South East Asia

Download or read book Law of the Sea in South East Asia written by Donald R Rothwell and published by Routledge. This book was released on 2019-07-19 with total page 323 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United Nations Convention on the Law of the Sea (LOSC) represents one of the most successful examples of multilateral treaty making in the modern era. The convention has 168 States parties, and most non-signatory States recognise nearly all of its key provisions as binding under customary international law, including the United States. Nevertheless, there remain significant differences in interpretation and implementation of the LOSC among States as well as calls, on occasion, for its amendment. This book analyses the impact, influence and ongoing role of the LOSC in South East Asia, one of the most dynamic maritime regions in the world. Maritime security is a critical issue within the region, and it is separately assessed in light of the LOSC and contemporary challenges such as environmental security and climate change. Likewise, navigational rights and freedoms are a major issue and they are evaluated through the LOSC and regional state practice, especially in the South China Sea. Special attention is given to the role of navies and non-state actors. Furthermore, the book looks at regional resource disputes which have a long history. These disputes have the potential to increase into the future as economic interests and concerns over food security intensify. Effective LNG and fisheries resource management is therefore a critical issue for the region and unless resolved could become the focal point for significant maritime disputes. These dynamics within the region all require extensive exploration in order to gauge the effectiveness of LOSC dispute resolution mechanisms. The Law of the Sea in South East Asia fills a gap in the existing literature by bringing together a holistic picture of contemporary maritime issues affecting the region in a single volume. It will appeal to academic libraries, government officials, think-tanks and scholars from law, strategic studies and international relations disciplines.

Book Deep Currents and Rising Tides

Download or read book Deep Currents and Rising Tides written by John Garofano and published by Georgetown University Press. This book was released on 2013-04-29 with total page 351 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Indian Ocean region has rapidly emerged as a hinge point in the changing global balance of power, and the geographic nexus of economic and security issues with vital global consequences. The security of energy supplies, persistent poverty and its contribution to political extremism, piracy and related threats to seaborne trade, competing nuclear powers, and possibly the scene of future clashes between rising great powers India and China—all are dangers in the waters or in the littoral states of the Indian Ocean region. This volume, one of the first attempts to treat the Indian Ocean Region in a coherent fashion, captures the spectrum of cooperation and competition in the Indian Ocean Region. Contributors discuss points of cooperation and competition in a region that stretches from East Africa, to Singapore, to Australia, and assess the regional interests of China, India, Pakistan, and the United States. Chapters review possible “red lines” for Chinese security in the region, India’s naval ambitions, Pakistan’s maritime security, and threats from non-state actors—terrorists, pirates, and criminal groups—who challenge security on the ocean for all states. This volume will interest academics, professionals, and researchers with interests in international relations, Asian security, and maritime studies.

Book excerpt: This series brings together the most significant published journal articles in international law as determined by the editors of each volume in the series. The proliferation of law, specialist journals, the increase in international materials and the use of the internet has meant that it is increasingly difficult for students and legal scholars to have access to all the relevant articles. Many valuable older articles are unable to be obtained readily. In addition each volume contains an informative introduction which provides an overview of the subject matter and justification of why the articles were collected. This series contains collections of articles in a manner that is of use for both teaching and research.

Book The Maritime Political Boundaries of the World

Download or read book The Maritime Political Boundaries of the World written by Victor Prescott and published by BRILL. This book was released on 2005-01-01 with total page 680 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses the often vexed question of national maritime claims and the delimitation of international maritime boundaries. The number of undelimited international maritime boundaries is much larger than the number of agreed lines. The two boundaries that define the marine domain of coastal states are examined. First, the baselines along the coast may consist of low-water lines or straight lines or a combination of both. When straight lines are used they define the seaward limit of the state's internal waters. Second, the outer limits of claims to territorial seas, contiguous zones and exclusive economic zones are measured from the baselines. All states will have to delimit at least one international boundary with a neighbouring state, whether adjacent or opposite. In confined seas no state can claim the full entitlement and must negotiate international boundaries with all neighbours. Many states bordering oceans can claim the full entitlement seawards, although they will need to delimit national boundaries with adjacent neighbours.
