Book The Competing Jurisdictions of International Courts and Tribunals

Download or read book The Competing Jurisdictions of International Courts and Tribunals written by Yuval Shany and published by Oxford University Press on Demand. This book was released on 2004 with total page 348 pages. Available in PDF, EPUB and Kindle. Book excerpt: Recent years have witnessed a sharp increase in the number of international courts and tribunals (WTO, NAFTA, ITLOS, ICC, etc.) and greater willingness on the part of states and other international actors to subject themselves to the compulsory jurisdiction of international adjudicative mechanisms. However, because of the uncoordinated nature of these developments, overlaps between the jurisdictional ambits of the different judicial bodies might occur, i.e., the same dispute could fall under the jurisdiction of more than one forum. This raises both theoretical and practical issues of coordination between the various jurisdictions. The purpose of this book is to explore the implications of jurisdictional competition and to identify standards that may alleviate problems associated with the phenomenon, which arguably threatens the unity of international law. The first part of the book examines the jurisdictional ambits of the principal international courts and tribunals and delineates areas of overlap between their respective jurisdictions. There follows a discussion of some of the potential systematic and practical problems that arise out of jurisdictional competition (such as forum shopping and multiple proceedings) and a consideration of the expediency of mitigating them. The book concludes by identifying existing rules of international law, which govern inter-jurisdictional competition, and by considering the desirability of introducing additional norms and arrangements.

Book Political Competition Innovation and Growth

Download or read book Political Competition Innovation and Growth written by Peter Bernholz and published by Springer. This book was released on 2012-01-21 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume confronts an important historical hypothesis with empirical evidence from selected periods of history. The hypothesis in question states that competition among political and legal organisations in developing rules has been a crucial condition for liberty, innovation and growth in the history of mankind. It is due to Immanuel Kant, Edward Gibbon and Max Weber and has been revived and further developed by Nobel-Laureate Douglass C. North who contributes the first chapter. The volume brings together political economists, historians and legal scholars to discuss the role of political competition in the rise and decline of nations - both in theory and in a large number of case studies.

Download or read book Law Enforcement Intelligence written by David L. Carter and published by Createspace Independent Pub. This book was released on 2012-06-19 with total page 318 pages. Available in PDF, EPUB and Kindle. Book excerpt: This intelligence guide was prepared in response to requests from law enforcement executives for guidance in intelligence functions in a post-September 11 world. It will help law enforcement agencies develop or enhance their intelligence capacity and enable them to fight terrorism and other crimes while preserving community policing relationships. The world of law enforcement intelligence has changed dramatically since September 11, 2001. State, local, and tribal law enforcement agencies have been tasked with a variety of new responsibilities; intelligence is just one. In addition, the intelligence discipline has evolved significantly in recent years. As these various trends have merged, increasing numbers of American law enforcement agencies have begun to explore, and sometimes embrace, the intelligence function. This guide is intended to help them in this process. The guide is directed primarily toward state, local, and tribal law enforcement agencies of all sizes that need to develop or reinvigorate their intelligence function. Rather than being a manual to teach a person how to be an intelligence analyst, it is directed toward that manager, supervisor, or officer who is assigned to create an intelligence function. It is intended to provide ideas, definitions, concepts, policies, and resources. It is a primera place to start on a new managerial journey. Every law enforcement agency in the United States, regardless of agency size, must have the capacity to understand the implications of information collection, analysis, and intelligence sharing. Each agency must have an organized mechanism to receive and manage intelligence as well as a mechanism to report and share critical information with other law enforcement agencies. In addition, it is essential that law enforcement agencies develop lines of communication and information-sharing protocols with the private sector, particularly those related to the critical infrastructure, as well as with those private entities that are potential targets of terrorists and criminal enterprises. Not every agency has the staff or resources to create a formal intelligence unit, nor is it necessary in smaller agencies. This document will provide common language and processes to develop and employ an intelligence capacity in SLTLE agencies across the United States as well as articulate a uniform understanding of concepts, issues, and terminology for law enforcement intelligence (LEI). While terrorism issues are currently most pervasive in the current discussion of LEI, the principles of intelligence discussed in this document apply beyond terrorism and include organized crime and entrepreneurial crime of all forms. Drug trafficking and the associated crime of money laundering, for example, continue to be a significant challenge for law enforcement. Transnational computer crime, particularly Internet fraud, identity theft cartels, and global black marketeering of stolen and counterfeit goods, are entrepreneurial crime problems that are increasingly being relegated to SLTLE agencies to investigate simply because of the volume of criminal incidents. Similarly, local law enforcement is being increasingly drawn into human trafficking and illegal immigration enterprises and the often associated crimes related to counterfeiting of official documents, such as passports, visas, driver's licenses, Social Security cards, and credit cards. All require an intelligence capacity for SLTLE, as does the continuation of historical organized crime activities such as auto theft, cargo theft, and virtually any other scheme that can produce profit for an organized criminal entity. To be effective, the law enforcement community must interpret intelligence-related language in a consistent manner. In addition, common standards, policies, and practices will help expedite intelligence sharing while at the same time protecting the privacy of citizens and preserving hard-won community policing relationships.~

Book Labor Mobility and the World Economy

Download or read book Labor Mobility and the World Economy written by Federico Foders and published by Springer Science & Business Media. This book was released on 2011-09-18 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: An increasing number of landings of illegal migrants on the coast of Italy and Spain, but also the recent riots, car-burnings, and street battles that occurred all across France and that have been attributed to the migrant community, seem to indicate that migration is likely to stay high on the European policy agenda for some time. The flow of migrants from poor to rich countries does not, however, constitute a typically European problem. V. S. public policy has also been facing a continued (legal and illegal) inflow of labor from different regions, notably Mexico and other Latin American countries. And similar developments in other advanced countries (Australia, Canada) as weil as in selected fast-growing emerging markets in Eastern Europe and East Asia imply that these countries too are being compelled to adjust their public policies in order to relieve migratory pressures and deal with their consequences. The world economy already saw rising cross-border labor flows in the 1990s and most forecasts predict that South-North and South-South migration will re main at relatively high levels over the next decades and possibly even turn into a major global challenge for policy makers in the 21st century.

Book The Theory of Capitalism in the German Economic Tradition

Download or read book The Theory of Capitalism in the German Economic Tradition written by Peter Koslowski and published by Springer Science & Business Media. This book was released on 2013-11-11 with total page 576 pages. Available in PDF, EPUB and Kindle. Book excerpt: The theory of capitalism and of the economic order is the central topic of the German economic tradition in the 20th century. Capitalism has not only been the topic for Marxist economics and for the Frankfurt School but also for the Historical School and for the postmarxist theory of capitalism in Ordo- and Neo-Liberalism as well as in Solidarism. The question of the foundations of the economic order of the market economy and of capitalism as well as the problem whether a third path between capitalism and social ism is possible occupied this tradition from the Historical School to Ordo Liberalism and the theory of the social market economy. The theory of capitalism and of the social market economy as well as the critique and reform developed in this theoretical tradition is important for the theory of economic systems as well as for today's problems of the eco nomic order. Its relevance for the present world economy is visible in the discussions whether there exist different models of capitalism and whether they can be described as the Anglo-American and as the Rhenish model of capitalism influenced by the thought of the German economic tradition. Michel Albert, the author of this classification, gave the key-word in his book Capitalism against Capitalism. The papers of this book can help to clarify this debate by giving a first hand introduction to some of the main economic thinkers of capitalism.

Download or read book Sovereignty for Survival written by James Robert Allison and published by Yale University Press. This book was released on 2015-10-20 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the years following World War II many multi-national energy firms, bolstered by outdated U.S. federal laws, turned their attention to the abundant resources buried beneath Native American reservations. By the 1970s, however, a coalition of Native Americans in the Northern Plains had successfully blocked the efforts of powerful energy corporations to develop coal reserves on sovereign Indian land. This challenge to corporate and federal authorities, initiated by the Crow and Northern Cheyenne nations, changed the laws of the land to expand Native American sovereignty while simultaneously reshaping Native identities and Indian Country itself. James Allison makes an important contribution to ethnic, environmental, and energy studies with this unique exploration of the influence of America’s indigenous peoples on energy policy and development. Allison’s fascinating history documents how certain federally supported, often environmentally damaging, energy projects were perceived by American Indians as potentially disruptive to indigenous lifeways. These perceived threats sparked a pan-tribal resistance movement that ultimately increased Native American autonomy over reservation lands and enabled an unprecedented boom in tribal entrepreneurship. At the same time, the author demonstrates how this movement generated great controversy within Native American communities, inspiring intense debates over culturally authentic forms of indigenous governance and the proper management of tribal lands.

Book Tiger Economies Under Threat

Download or read book Tiger Economies Under Threat written by Shahid Yusuf and published by World Bank Publications. This book was released on 2009-10-01 with total page 308 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years, growth rates in the so-called 'Tiger economies' of Southeast Asia have been above the average not only for developing countries but for the world as a whole. Yet they fall short of the economic growth experienced during 1975 95. The underlying worry for policy makers is that the decrease presages the beginning of a downward trend, a worry that has been sharpened by the global recession. But are the Tiger economies under threat? And if so, what are the causes and how can they be addressed? This book employs a comparative analysis of the Southeast Asian Tiger economies, centered on Malaysia, to tackle these questions. The findings presented will be of particular interest to policy makers, academics, business people, and researchers.
