Book excerpt: In this paper we seek to assesses the stance of Islamic perspective with respect to Intellectual Property Rights. The significance of tackling this issue at this particular time is that there have been increasing calls in Western societies for the implementation of Sharia in their own western Territories. The paper aims to situate the argument within the course of criminal protection of shari'a protection of intellectual property Rights, so as to prove that intellectual Property Rights, are one aspect of Shari'a which do not conflict with the western principles of protection. The paper assesses the extent to which the Islamic law and its sophisticated tools have an impact on the protection of Intellectual Property. First it Presents the sharia's main sources, The Quran, Sunnah, Ijma and Qiyas. Then it presents the Islamic laws Supporting, protecting and enforcing the Intellectual property Rights. The arguments presented in this paper reveal that a Sharia based system is flexible and adoptable and that is this flexibility is to be used in order to face economic reality.

Book excerpt: For over a century, intellectual property (IP) regimes have been justified using Western philosophical theories rooted in the idea that IP must reward talent and maximize global stocks of knowledge and cultural products. Reframing IP in a context of legal pluralism, Ezieddin Elmahjub brings an Islamic and comparative narrative to the appropriate design and scope of IP rights, and in doing so criticizes the dominance of Western influence on a global regime that impacts the ability of people to access medicine, to read, to imagine, and to reshape popular culture. The Islamic vision of IP, which is based on a broad theory of social justice, maintains that IP cannot simply be seen as a reward for effort or tool to maximize economic efficiency but as one legal right within a complicated distributive scheme affecting fundamental human rights, equal opportunities, and human capabilities.

Book excerpt: Islam from the very beginning has encouraged all those who claimed to have acquired new forms of knowledge and at the same time has stressed its dissemination in a fair system. Islam does not allow any violation against people's rights, whether material or intellectual. Therefore, it does not allow that the efforts of others be taken away from them or be used without their consent. But, both in analogy (fiqh) and related Islamic legal literature on property here is no specific mention of the term "Intellectual Property". However, some scholars contend that intellectual property rights were not directly regulated by Sharia but the others say that the principles of Sharia can be construed to provide support for such protection. Nevertheless, an analysis of the definitions and classifications of property under principles of Islamic law reveals that the concept of intellectual property is not alien to Islamic law of property; rather it is an integral part of it. General principles extracted from the sources of Islamic law and outlined by Muslim jurists have squarely encompassed it as a usufruct (manãfi') property, which is recognized as object of right (haqq) that could be exclusive only to the individual that has right over it.This article assesses the stance of Islamic Law, known as Sharia, concerning the protection and enforcement of intellectual property rights in Islamic Law and culture, focusing specifically on Iran. Also, this paper examines additional principles of Islamic law that may constitute hurdles to intellectual property protection.In this paper, the brief history of the Iranian intellectual property law and its upcoming changes are described. The main goal of this research is to obtain more knowledge about Iranian law regarding to Legitimacy of intellectual property rights in Iran Law.IP-considerations in Iran's Development Plans have been presented in this respect, to show the orientation of the Iranian officials in IPRs policy making.

Book excerpt: Copyright in Islamic Law is the first work in English to systematically discuss the ideas of intellectual property and copyright from an Islamic perspective. The author, Dr Mohamed Ali Ahdash, builds a framework from within Shari'a law to address the concepts of intellectual property and copyright. In so doing, he adopts the classical usul al-fiqh approach by firstly defining the key terms associated with the field, namely: right (haqq), ownership (milkiyya), wealth (mal) and utility (manfa'a). Dr Ahdash then analyses how these terms are used in the Qur'an and in the Hadith, before looking at how the secondary sources of analogy (qiyas), public interest (maslaha), custom ('urf) and legal maxims (qawa'id fiqhiyya) can be applied to copyright. The result of this study is a framework wherein the concept of copyright is defined and understood in an Islamic manner. This gives a consistent approach from which specific rulings can be derived. Copyright in Islamic Law is both a ground-breaking study in Shari'a law and a valuable contribution to the ongoing debates on copyright in general.
