Available in PDF, EPUB and Kindle. Book excerpt: The establishment of Intellectual Property Rights is of utmost importance for the functioning of the market mechanism in a modern economy based more and more on trade in services and software products. Most Central and Eastern European Countries already dispose on systems of Intellectual Property Rights protection. The law enforcement mechanism in a series of countries, however, must still be strengthened. In one section of the book, the authors give an overview on the institutionalisation of Intellectual Property Rights in Central and Eastern Europe and in some successor states of the former Soviet Union with special regard to Russia. Moreover, Intellectual Property Rights systems in the United States and Western Europe are compared and the rules of WTO were taken under consideration in order to find out their potential for fostering (or hampering) the central and eastern European process of transition. Finally, a deliberation on the historical grounds and theoretical foundations of individual and common property rights with regard to economic and technological innovation is included into the collection. The volume gives a comprehensive overview on the state of Intellectual Property Rights institutionalisation in the course of the process of transition in Central and Eastern Europe.

Available in PDF, EPUB and Kindle. Book excerpt: The edited volume deals with the expansion and institutionalization of intellectual property norms in the twentieth century, with a European focus. Its thirteen chapters revolve around the transfer, adaptation and the ambivalence of legal transplants in the interface between national and international projects, trends and contexts.ÿ The first part discusses the institutionalization of copyright and patent law in the framework of the bigger political and economic projects of the twentieth century. The second and third parts of the collection review relevant processes in the communist regimes and the post-communist societies, respectively. The essays refl ect on the concept and the mechanisms of expansion of intellectual property rights by pointing at processes of enculturation, transnationalization and universalization of norms, as well as practices of incorporation and resistance. The contributors lay a particular emphasis on the role and activity of social actors in the establishment and validation of intellectual property norms and regimes, from the function of experts and creation of expert cultures to the compelling power of popular street protests.

Book REVIEW OF AGRICULTURAL TRADE POLICIES IN POST SOVIET COUNTRIES 2015 2016

Download or read book REVIEW OF AGRICULTURAL TRADE POLICIES IN POST SOVIET COUNTRIES 2015 2016 written by Food and Agriculture Organization of the United Nations and published by Food & Agriculture Org.. This book was released on 2018-11-05 with total page 60 pages. Available in PDF, EPUB and Kindle. Book excerpt: The document is based on the publication “Review of Agricultural Trade Policies in former Soviet Union countries 2015-16” available in Russian. The main economic and political factors influencing the patterns of agrifood trade in the region during 2014 generally continued to have an impact in 2015 and 2016. In particular, a further slowdown in economic growth was observed in all countries during 2015. In addition, the depreciation of all the national currencies against the US dollar and the euro , which began in 2014, continued in 2015 and, in some cases, in 2016. Due to weaker national currencies and falling consumer demand, the total value of imports of agrifood products in dollar terms decreased in many countries. The decline in demand for agrifood products in the region and lower international prices also contributed to the reduction in the value of agrifood exports from the region. At the same time, the last two years have been marked by stronger integration processes affecting agr ifood trade among several countries in the region.

Book The EU s Approach to Human Rights Conditionality in Practice

Download or read book The EU s Approach to Human Rights Conditionality in Practice written by Elena Fierro and published by BRILL. This book was released on 2021-10-18 with total page 448 pages. Available in PDF, EPUB and Kindle. Book excerpt: Human rights in the external relations of the EU may manifest itself in different manners; one of them is the conditionality policy that the EU applies to third countries. This study intends to explore the modalities of this conditionality policy, as well as its nature and reach. It also analyzes how the policy could be improved and be made more coherent and effective. The point of departure is the division made between two modes of conditionality: ex ante and ex post. In the first case the EU issues conditions, which must be fulfilled before the negotiation or conclusion of a given agreement or an action with a view to strengthening the relations. The second case, conditionality ex post , is when conditions are allready part of an agreement or an established relation. The so-called human rights clause, or democratic clause, incarnates the second modality. This study explores both types of conditionality, but puts a special emphasis on the second, given its legal nature, its reciprocity, and its systematic inclusion in all framework agreements. It is argued here that this clause could represent the basis of a fully-fledged human rights policy of EU. At present, however, the implementation of the clause has been fragmentary. The interpretation that has prevailed (the human rights clause being a mechanism of exclusively punitive nature), has constituted an obstacle for its implementation. In addition, the clause has been activated only as a response to breaches of democratic principles (and not human rights) in the ACP countries ( and not other regions). The human rights clause has been the victim of the 'sectorial approaches' where policy choices were determined by the instrument at issue. It is about time for the EU to revisit the interpretation of the clause in order to make of it a dynamic instrument, integrated in a global and coherent external human rights policy.
