Book excerpt: The European Union's history exhibits numerous episodes in which Member States have sought to re-enforce their national autonomy in the face of deepening integration. Efforts to re-gain autonomy, however, are often accompanied by legitimate concerns that autonomy will lead to dis-integration or will have wider destructive consequences. The EU thus faces a dilemma. Calls for autonomy cannot all be dismissed as mere populist rhetoric or national egoism but instead represent a legitimate questioning of the degree of uniformity that EU law and politics presently carry. At the same time, the fear that greater autonomy may carry dis-integrative effects is also legitimate -uniformity is not an accidental by-product of the EU's construction but intrinsically related to its policy goals. Giving too much room for autonomy might create an opportunity structure for the loss of collective goods, deficits in problem-solving, and perhaps even to self-destruction. The EU requires autonomy, but in doing so, it must also avoid collapse. Can it achieve it, and if so, how? Autonomy without Collapse is devoted to exploring innovative answers to this question. It draws together scholars in law and political science interested in exploring how to overcome the central dilemma of preserving sustainable yet real autonomy in the future European Union.

La prima tende a considerare tale processo come una forma particolarmente evoluta di cooperazione internazionale. In questa concezione, gli Stati membri dell’Unione avrebbero inteso dar vita a un modello integrato di governo delle rispettive comunità territoriali al fine di far fronte alla crescente complessità dei fenomeni economici e sociali. Questo modello replica l’organizzazione giuridica e politica degli Stati membri. I trattati istitutivi dell’Unione stabiliscono un sistema istituzionale, un sistema normativo e un sistema giudiziario. Con ciò, però, non si sarebbe dato vita a un nuovo ordinamento politico e giuridico che incorpora quelli degli Stati membri. L’Unione europea non sarebbe, quindi, una sorta di super-Stato, ma solo uno strumento per realizzare politiche comuni degli Stati membri. Questa visione del processo di integrazione può essere definita come “realista”. L’Unione europea non sconvolgerebbe, insomma, la concezione classica dello Stato come monopolista del potere politico e giuridico. Essa andrebbe invece qualificata come una complessa e sofisticata esperienza di cooperazione, nell’ambito della quale gli Stati membri, i veri protagonisti del processo di integrazione, assicurano per mezzo dell’Unione il governo della propria comunità territoriale. Lo studio del diritto dell’Unione europea consisterebbe quindi nell’analisi delle modalità di “esternalizzazione” di talune funzioni che gli Stati membri esercitano attraverso l’Unione, mantenendo, però, costantemente il controllo del processo decisionale. Attraverso tali forme di controllo, le comunità nazionali, le loro forme di organizzazione politica, i loro ordinamenti giuridici, conserverebbero la propria identità nell’ambito del processo di integrazione. A questa visione, di carattere realista, si oppone una diversa concezione che guarda al processo di integrazione europea come a un modello utopico. Vi sono, in effetti, vari elementi nella costruzione europea che potrebbero essere valorizzati in questa direzione. Non solo, come ormai abbondantemente noto, il processo di integrazione europea è difficilmente inquadrabile nelle usuali categorie della scienza dell’organizzazione sociale. Non solo esso sfugge a ogni tentativo di catturare le sue modalità di funzionamento e illustrarle in una dottrina coerente e completa. L’integrazione europea sembra addirittura postulare un mutamento radicale delle condizioni sociologiche di base sulle quali tali categorie sono fondate. Vi è, infatti, una radicale opposizione filosofica fra i tradizionali modelli di organizzazione sociale sui quali si fondano le classiche nozioni di comunità, di Stato, di ordinamento giuridico, e quelli presupposti dalla costruzione europea. Con un notevole grado di semplificazione, si può indicare come le nozioni classiche siano fondate sulla chiusura e sulla autosufficienza degli ordinamenti statali, atti, quindi, a governare in maniera esclusiva le dinamiche della propria comunità territoriale. Di converso, il processo di integrazione europea ci pone davanti a un modello fondato sulla apertura e sulla interazione fra ordinamenti inter-dipendenti.

Book excerpt: The existence of a structured enforcement system is an inherent feature of national legal orders and one of the core elements of State sovereignty. The very limited power to issue sanctions has often been deemed a gap in the EC legal order. Over the years, the situation has progressively changed. The Union’s institutional setting is growing in complexity and a variety of agencies has been or is expected to be endowed with law enforcement responsibilities. In addition, the so-called competence creep has led the EU to play an increasingly prominent role in several areas of EU law enforcement, including the issuing of sanctions. This book examines these developments, focusing on both the general features of the EU legal order and the analysis of key-substantive areas, such as banking and monetary union, environmental law, and data protection. The work thus presents a general framework for understanding EU sanctioning based on structural features and general legal principles. Part I develops an analytical framework, tracking the most significant evolutive patterns of EU sanctioning powers. Part II adopts a more practical approach focusing on specific issues and policy areas.
