At the same time, EU enlargment and the ongoing rise in the rate of migration into and across Europe suggest that these issues will continue to grow in importance. This book raises the level of discussion to take account of international developments and to promote a more coherent and soundly based debate. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy.

The legal relationship between a person and a state is becoming increasingly blurred in our mobile, transnational world. This volume deals with the membership dimension of citizenship, specifically the formal rules that states use to attribute citizenship. These nationally-specific rules determine how and under what conditions citizenship is attributed by states to individuals: how one can acquire formal citizenship status, but also how this status can be lost. Migration and Citizenship Attribution observes various trends in citizenship policies since the early 1980s, analysing historical patterns and recent changes across Western Europe as well as examining specific developments in individual countries. Authors explore the equal treatment of women and men with regard to descent-based citizenship attribution, along with the process of convergence between countries with ‘ius soli’ and ‘ius sanguinis’ traditions with regard to birthright provisions. They consider how the increasing acceptance of multiple citizenship is reflected in a dual trend to abolish, or at least to moderate, the renunciation of the citizenship of origin as a condition for naturalisation, and also to restrict provisions of loss of citizenship due to voluntary acquisition of a foreign citizenship. Another trend observed and discussed is the introduction by many countries of language tests and integration conditions in the naturalisation procedure, with some countries now concluding the naturalisation process by means of a US-styled citizenship ceremony. Contributors also explore the various things taken into account under state citizenship laws such as statelessness, or membership of the European Union. Book excerpt: Explanations of naturalization and jus soli citizenship have relied on cultural, convergence, racialization, or capture theories, and they tend to be strongly affected by the literature on immigration. This study of naturalization breaks with the usual immigration theories and proposes an approach over centuries and decades toward explaining naturalization rates. First, over centuries, it provides consistent evidence to support the long-term existence of colonizer, settler, non-colonizer, and Nordic nationality regime types that frame naturalization over centuries. Second, over three and a half decades, it shows how left and green parties, along with an index of nationality laws, explain the lion's share of variation in naturalization rates. The text makes these theoretical claims believable by using the most extensive data set to date on naturalization rates that include jus soli births. It analyzes this data with a combination of carefully designed case studies comparing two to four countries within and between regime types, and tests them with cross-sectional pooled regression techniques especially suitable to slow-moving but dynamic institutions.
