Updated as of May 29, 2018 The U.S. Integrated Ocean Observing System Program Office, led by the National Oceanic and Atmospheric Administration (NOAA), issues this final rule to implement provisions of the Integrated Coastal and Ocean Observation System Act of 2009 (ICOOS Act). Among other things, the ICOOS Act directs the Interagency Ocean Observation Committee (IOOC) to develop and approve certification criteria and procedures for integrating regional information coordination entities (RICEs) into the National Integrated Coastal and Ocean Observation System (System). This rule accomplishes that goal. This rule also implements the provisions of the ICOOS Act establishing that certified entities integrated into the System are, for the purposes of determining liability arising from the dissemination and use of observation data, considered part of NOAA and therefore their employees engaged in the collection, management, and dissemination, of observation data in the System receive the same tort protections for use of that data as Federal employees. Consistent with the President's memo on Scientific Integrity (March 9, 2009) and NOAA Administrative Order 202-735D, the revised NS2 guidelines are intended to ensure the highest level of integrity and strengthen public confidence in the quality, validity and reliability of scientific information disseminated by the National Marine Fisheries Service (NMFS) in support of fishery management actions. This action provides guidance on what constitutes best scientific information available (BSIA) for the effective conservation and management of fisheries managed under Federal fishery management plans (FMPs), and adds new language to the NS2 guidelines regarding the advisory role of the Scientific and Statistical Committees (SSCs) of the Regional Fishery Management Councils (Councils) and the relationship of SSCs to the peer review process. The revised NS2 guidelines also clarify the content and purpose of the Stock Assessment and Fishery Evaluation (SAFE) Report and related documents. This action makes modest adjustments to current operating practices; it is intended to ensure that scientific information, including its collection and analysis, has been validated through peer review, as appropriate, is transparent to the public, and is used appropriately by SSCs, Councils, and NMFS in the conservation and management of marine fisheries. Participating partners included the Mid-Atlantic Coastal Ocean Observing Regional Association, U.S. Geological Survey, Rutgers University Coastal Ocean Observing Laboratory, and the New Jersey Sea Grant College. The workshop was designed to highlight the importance of ecological and human health linkages in the movement of materials, nutrients, organisms and contaminants along the Delaware Bay watershed-estuary-coastal waters gradient, and to address specific water quality issues in the mid-Atlantic region, especially the area comprising the Delaware River drainage and near-shore waters.

Book excerpt: Recreational fishing in the United States is an important social and economic component of many marine fisheries, with an estimated 14 million anglers making almost 82 million fishing trips in 2004. Although each individual angler typically harvests a small number of fish, collectively these sport fisheries can take a significant fraction of the yearly catch-in some cases more than commercial fisheries. For example, in 1999, recreational fishing accounted for 94% of the total catch of spotted sea trout, 76% of striped bass and sheephead, and 60 percent of king mackerel. It is important that systems used to monitor fishing catch are adequate for timely management of recreational fisheries. However, the large number of anglers and access points makes monitoring recreational fishing much more difficult than monitoring commercial fishing. This report reviews the types of survey methods used to estimate catch in recreational fisheries, including state/federal cooperative programs. The report finds that both telephone survey and onsite access components of the current monitoring systems have serious flaws in design or implementation. There are also several areas of miscommunication and mismatched criteria among designers of surveys, data collectors, and recreational fisheries. The report recommends that a comprehensive, universal sampling frame with national coverage should be established, and that improvements should be made in statistical analysis of the data collected and in the ways the data are communicated. A permanent and independent research group should be established and funded to evaluate the statistical design and adequacy of recreational fishery surveys and to guide necessary modifications or new initiatives.

The purpose of this final action is to facilitate enhanced communication with HMS vessels at sea, provide HMS fishery participants with an additional means of sending and receiving information at sea, ensure that HMS VMS units are consistent with the current VMS technology and type approval requirements that apply to newly installed units, and to provide NMFS enforcement with additional information describing gear onboard and target species.
