It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy.

Yet many of the current practices surrounding these issues were developed decades ago, and are ill-suited to the dynamics of today's global economies and immigration patterns. At the core of much policy debate is the inherent paradox whereby immigrant populations are frequently perceived as posing a potential security threat yet bolster economies by providing an inexpensive workforce. Strict attention to border controls and immigration quotas has diverted focus away from perhaps the most significant dilemma: the integration of existing immigrant groups. Often restricted in their civil and political rights and targets of xenophobia, racial profiling, and discrimination, immigrants are unable or unwilling to integrate into the population. These factors breed distrust, disenfranchisement, and hatred-factors that potentially engender radicalization and can even threaten internal security.The contributors compare policies on these issues at three relational levels: between individual EU nations and the U.S., between the EU and U.S., and among EU nations. What emerges is a timely and critical examination of the variations and contradictions in policy at each level of interaction and how different agencies and different nations often work in opposition to each other with self-defeating results. As a result, some international law scholars believe that a new world order is emerging based on a complex web of transnational networks. Such a transnational legal order requires sufficient dialogue between national courts. This 2010 book explores the prospects for such an order in the context of refugee law in Europe, focusing on the use of foreign law in refugee cases. Judicial practice is critically analysed in nine EU member states, with case studies revealing a mix of rational and cultural factors that lead judges to rarely use each others' decisions within the EU. Conclusions are drawn for the prospects of a Common European Asylum System and for international refugee law.

Cuando algún grupo de personas sufre su violación, otras personas (en esta hipótesis, muchos ciudadanos de la Unión) no se dan cuenta de que se cuestiona, sufre y peligra la misma esencia de la democracia.

Book excerpt: Because of severe domestic labor shortages, Japan has recently joined the increasing number of advanced industrialized nations that have begun importing large numbers of immigrant workers since the 1980s. Although the citizenship status of foreign workers is the most precarious in such recent countries of immigration, the national governments of these countries have become increasingly preoccupied with border enforcement, forcing local municipalities and organizations to offer basic rights and social services to the foreign residents who are settling in their local communities. This book analyzes the development of local citizenship in Japan by examining the role of local governments and NGOs as well as grass-roots political and judicial activism in the expansion of immigrant rights. In this manner, localities are emerging as important sites for the struggle for immigrant citizenship and social integration, enabling foreign workers to enjoy substantive rights even in the absence of national citizenship. The possibilities and limits of such local citizenship in Japan are then compared to three other recent countries of immigration (Italy, Spain, and South Korea).
