Book excerpt: Studienarbeit aus dem Jahr 2015 im Fachbereich Pädagogik - Heilpädagogik, Sonderpädagogik, Note: 1,0, Humboldt-Universität zu Berlin (Institut für Rehabilitationswissenschaften), Sprache: Deutsch, Abstract: In dieser Hausarbeit möchte ich Bezüge zwischen der Anerkennungstheorie des Frankfurter Sozialphilosophen Axel Honneth und professionstheoretischen Fragestellungen der Behindertenpädagogik aufzeigen. Dabei gehe ich auch auf das Ziel der Inklusion behinderter Menschen ein, das mit der UN-Behindertenrechtskonvention verfolgt wird. Zunächst kläre ich dazu den Anerkennungsbegriff, wie er in der Theorie Honneths zu verstehen ist. Im zweiten Teil möchte ich einige Fragestellungen beleuchten, die sich aus der Lesart der Behindertenpädagogik ergeben, und die in der Fachliteratur bearbeitet werden. Dazu zählt vor allem die Frage, inwieweit Menschen mit Behinderung überhaupt Anerkennung erlangen können, sofern wechselseitige Äußerungen von Anerkennung vorausgesetzt werden. Aber auch die Frage nach der Zugehörigkeit zur Gesellschaft als einer moralischen Gemeinschaft soll gestellt werden. Im Rahmen dieser Hausarbeit kann ich aber lediglich Paradoxien herausarbeiten. Eine abschließende Klärung der Fragen kann hier nicht erfolgen.

Dialog, Entwicklung, Atmosphäre, Respekt und Anerkennung zum Gegenstand dieser Diskussion. Orte für diese gesellschaftlichen und biographischen Entwicklungsprozesse sind die Kinder- und Jugendhilfe und Schulen. Die Hauptrolle spielen dabei die Kinder, Jugendlichen und Pädagogen. Nun ist hier, nach Hafeneger, eine Pädagogik gefordert, die mit Anerkennung von Autonomie auf zukunftsoffene und selbstbestimmungsfähige Menschen setzt. Die Thematisierung ab Mitte der 90er Jahre bezeichnet unterschiedliche Betrachtungsweisen und Problemstellungen und diese geraten in die Diskussion, weil das Gleichgewicht von Gesellschaft und Pädagogik aufgrund struktureller Veränderungen sich umformt und gefährdet ist. In dieser Arbeit möchte ich mich nun, darauf aufbauend, mit der Thematik beschäftigen, wo die Schwierigkeiten der Integration liegen (könnten) und inwieweit die Anerkennung dabei wichtig ist. Über verschiedene Ansatzpunkte möchte ich versuchen den Wichtigkeitsgrad der Anerkennung und die Integrationsmöglichkeiten in Verbindung zu bringen, um zu einer Lösung zu gelangen. Im Schwerpunkt werde ich mich bei einigen Ausführungen jedoch auf die schulische Integration von behinderten Menschen beschränken. Außerdem bitte ich zu berücksichtigen, dass ich zum leichteren Verständnis, beim Lesen, lediglich maskuline Formulierungen verwand habe.

Book excerpt: Transconstitutionalism is a concept used to describe what happens to constitutional law when it is emancipated from the state, in which can be found the origins of constitutional law. Transconstitutionalism does not exist because a multitude of new constitutions have appeared, but because other legal orders are now implicated in resolving basic constitutional problems. A transconstitutional problem entails a constitutional issue whose solution may involve national, international, supranational and transnational courts or arbitral tribunals, as well as native local legal institutions. Transconstitutionalism does not take any single legal order or type of order as a starting-point or ultima ratio. It rejects both nation-statism and internationalism, supranationalism, transnationalism and localism as privileged spaces for solving constitutional problems. The transconstitutional model avoids the dilemma of 'monism versus pluralism'. From the standpoint of transconstitutionalism, a plurality of legal orders entails a complementary and conflicting relationship between identity and alterity: constitutional identity is rearticulated on the basis of alterity. Rather than seeking a 'Herculean Constitution', transconstitutionalism tackles the many-headed Hydra of constitutionalism, always looking for the blind spot in one legal system and reflecting it back against the many others found in the world's legal orders.
