Book excerpt: In the early twentieth century, two wealthy white sisters, cousins to a North Carolina governor, wrote identical wills that left their substantial homeplace to a black man and his daughter. Maggie Ross, whose sister Sallie died in 1909, was the richest woman in Union County, North Carolina. Upon Maggie's death in 1920, her will bequeathed her estate to Bob Ross--who had grown up in the sisters' household--and his daughter Mittie Bell Houston. Mittie had also grown up with the well-to-do women, who had shown their affection for her by building a house for her and her husband. This house, along with eight hundred acres, hundreds of dollars in cash, and two of the white family's three gold watches went to Bob Ross and Houston. As soon as the contents of the will became known, more than one hundred of Maggie Ross's scandalized cousins sued to break the will, claiming that its bequest to black people proved that Maggie Ross was mentally incompetent. Revealing the details of this case and of the lives of the people involved in it, Gene Stowe presents a story that sheds light on and complicates our understanding of the Jim Crow South. Stowe's account of this famous court battle shows how specific individuals, both white and black, labored against the status quo of white superiority and ultimately won. An evocative portrait of an entire generation's sins, Inherit the Land: Jim Crow Meets Miss Maggie's Will hints at the possibility for color-blind justice in small-town North Carolina.

While the individualization of land rights creates incentives for poor farmers in marginal areas to adopt agroforestry, not much is known about its impact on women's land rights. Land, Trees, and Women examines the evolution of customary land tenure institutions in areas of Western Ghana and Western Sumatra where traditional matrilineal inheritance systems have been changing. In these two areas, the authors find that individualization of land tenure has contributed to both increased gender equity and greater efficiency in agroforestry management. While property rights institutions are moving toward providing proper incentives for efficient natural resource management, the authors conclude that any program or legal framework that assigns rights to resources must be evaluated for barriers to women's participation.

Book excerpt: This book investigates the migration of nearly 20% of the population from the village of Frauenstein-Wiesbaden (Germany) in the mid nineteenth century (1852-54) to Australia, using the letters and diaries of the towns-people, as well as official records and documentation. These migrants were imported as indentured workers for the developing wine industry, being sponsored by the Australian colonial authorities, and their stories make a significant contribution to both the migration debate as well as early Australian history. Using the voices of ordinary people revealed in their writing to and from Europe (the Frauenstein Letters) gives new insights into the migration process: What urged these people to migrate? What did they think about migration and how were they affected by it? Much of this migration correspondence has been generated by the female members of the family and, as treasured possessions, the letters have survived a century and a half and provide a window onto the experiences of ordinary working women whose voices from that period were seldom heard. The female construct of memory, and hence of history, is different and this book shows how important female migrant letters are in enhancing our knowledge of history and human migration.

Book excerpt: Michael Otsuka sets out to vindicate left-libertarianism, a political philosophy which combines stringent rights of control over one's own mind, body, and life with egalitarian rights of ownership of the world. Otsuka reclaims the ideas of John Locke from the libertarian Right, and shows how his Second Treatise of Government provides the theoretical foundations for a left-libertarianism which is both more libertarian and more egalitarian than the Kantian liberal theories of John Rawls and Thomas Nagel. Otsuka's libertarianism is founded on a right of self-ownership. Here he is at one with 'right-wing' libertarians, such as Robert Nozick, in endorsing the highly anti-paternalistic and anti-moralistic implications of this right. But he parts company with these libertarians in so far as he argues that such a right is compatible with a fully egalitarian principle of equal opportunity for welfare. In embracing this principle, his own version of left-libertarianism is more strongly egalitarian than others which are currently well known. Otsuka argues that an account of legitimate political authority based upon the free consent of each is strengthened by the adoption of such an egalitarian principle. He defends a pluralistic, decentralized ideal of political society as a confederation of voluntary associations. Part I of Libertarianism without Inequality concerns the natural rights of property in oneself and the world. Part II considers the natural rights of punishment and self-defence that form the basis for the government's authority to legislate and punish. Part III explores the nature and limits of the powers of governments which are created by the consensual transfer of the natural rights of the governed. Libertarianism without Inequality is a book which everyone interested in political theory should read.
