Book Policing Scotland

Download or read book Policing Scotland written by Daniel Donnelly and published by Routledge. This book was released on 2012-09-10 with total page 574 pages. Available in PDF, EPUB and Kindle. Book excerpt: This fully updated and expanded second edition of Policing Scotland takes account of recent developments in Scottish policing and criminal justice against the backdrop of a dynamic political landscape and looming fiscal constraints in public services. The book offers contributions from both academics and practitioners, and not only shows police at work in contemporary Scotland, but also gives some insight into those areas where policing is carried out by non-police people and organisations. It seeks to identify what it is about Scottish policing that is distinctly Scottish, the main characteristics of modern policing in Scotland, how these have developed over the recent past, and what they have become today. In answering these questions, the book analyses policing in Scotland in the context of the new and emerging ideas about the nature, purposes and methods of policing that are developing elsewhere in the world, and seeks to determine how far Scottish policing is maintaining its own traditions, or simply becoming a localised example of wider global trends. The second edition of this popular text introduces new chapters on crime investigation, police unionism, ethnic minorities, policing violence and forensic science, as well as incorporating a major new theme which seeks to explain how those responsible for policing Scotland set about dealing with current issues such as terrorism and organised crime. This book makes a significant contribution to the current debate on policing in Scotland, and as such is an essential text for academics and those interested in policing issues.

Book Scotland s constitutional future

Download or read book Scotland s constitutional future written by Great Britain: Scotland Office and published by The Stationery Office. This book was released on 2012-01-10 with total page 28 pages. Available in PDF, EPUB and Kindle. Book excerpt: This consultation document discusses how to deliver a referendum that is legal, fair and decisive. The Scottish Government is aware of the limits of its powers. It acknowledged those limits in 2007. Since the Scottish National Party's success in May 2011, the Scottish Government has provided no new explanation of how it would deliver its manifesto commitment to hold a referendum, despite the limits to its power. The UK Government has therefore considered the proposals put forward by the Scottish Government in February 2010 but those cannot be legally delivered by the Scottish Parliament. The UK Government does not believe that Scotland's constitutional future should be decided in court. The referendum must be legally watertight and that can only be provided by legislation involving the UK Parliament although this can be done in different ways. For the referendum to be fair as well as legal it should be overseen by those who have both the demonstrable neutrality and proven expertise. Finally, for the referendum to be also decisive, it is the UK Government's view that there must be a single, straightforward question; and that question must be asked as soon as possible

  • Release : 2011-05-05
  • ISBN : 9780105901808

Download or read book Double Jeopardy Scotland Act 2011 written by Scotland: Scottish Parliament and published by The Stationery Office. This book was released on 2011-05-05 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: The existing common law rule against double jeopardy generally prevents someone from being tried twice for the same crime. The Act restates that rule in statute. In doing so, it seeks to clarify and reform certain aspects of the current rule - in particular, providing for a number of exceptions to the rule. The Act provides for a general rule against double jeopardy comprising two elements: a core rule preventing a second prosecution for offences which a person could have been convicted of in the original case; a broader principle aimed at preventing the improper splitting of charges by a prosecutor seeking multiple chances of convicting an accused in relation to a single set of acts. It also provides for three exceptions to the general rule against double jeopardy, allowing an acquitted person to be tried again: tainted acquittals - the original acquittal is tainted by an offence against the course of justice (eg one involving the intimidation of witnesses); new evidence of admissions - the prosecutor has new evidence that the accused admitted committing the offence; general new evidence - the prosecutor has other new evidence of guilt. The Act is based on proposals put forward by the Scottish Law Commission in its Report on Double Jeopardy (Scot. Law Com. 218, 2009, ISBN 9780108882425). However, the Act departs from the Commission's recommendations in a number of important respects.
