Book excerpt: El presente trabajo describe un Plan de prevención de riesgos laborales para una empresa ficticia de mantenimiento de jardines, que permite integrar la prevención de riesgos laborales en el sistema de gestión general de la empresa, ya que se incluye una descripción general de la misma, la estructura organizativa, la modalidad preventiva elegida, la política preventiva, se describen los procedimientos organizativos existentes en la misma (formación, información, comunicación, consulta y participación de los trabajadores, equipos de protección individual, adquisición de equipos de trabajo y sustancias químicas, coordinación de actividades empresariales, etc.) y el plan de actuación ante emergencias. Los instrumentos esenciales para aplicar el Plan de prevención son la evaluación de riesgos, realizada según el método del Instituto Nacional de Seguridad e Higiene en el Trabajo, y la planificación de la actividad preventiva, en la que el empresario deberá realizar las actividades preventivas necesarias para la eliminación o reducción y control de los riesgos que no hayan podido evitarse, incluyendo plazos para llevarlas a cabo, responsables y medios para su ejecución. Se pretende así minimizar los riesgos del trabajo, para prevenir y evitar todo tipo de situaciones que puedan afectar a la salud de los trabajadores y conseguir unas condiciones de trabajo óptimas.

Book excerpt: La cultura preventiva llegó a España con la introducción de Ley de prevención de riesgos laborales, con ella se dispuso que la prevención de riesgos se integrara en el sistema general de gestión de la empresa artículo 1.1.pfo 1o del RSP, a través de la implantación y aplicación de un plan de prevención de riesgos laborales. El empresario será el encargado de garantizar la seguridad y la salud de sus trabajadores art. 14.2 de la LPRL, con lo que debe de cumplir con una serie de obligaciones preventivas que le impone la legislación, para ello el reglamento en su art. 10.1 le da libertad para poder organizar la prevención de las siguientes maneras, así, podrá asumir el empresario personalmente la actividad preventiva, podrá designar a trabajadores para que se ocupen de tal labor, podrá constituir un servicio de prevención propio o concertar la prevención con un servicio de prevención ajeno. Tales modalidades se pueden combinar entre sí cuando fuese necesario. Sin embargo, el empresario no siempre podrá optar por cualquiera de ellas cuando lo desee, existen unos límites que vendrán marcados por el tamaño de empresa, los tipos de riesgos a los que estén expuestos los trabajadores y la peligrosidad de las actividades desarrolladas, criterios que son dados con el fin de adecuarlo lo mejor posible a las distintas organizaciones existentes. Hay que tener en cuenta también la figura de los recursos preventivos para paliar algunos defectos que se puedan presentar. Como medio de control cuando el empresario utilice recursos propios, se realizarán auditorías para comprobar su eficacia.
