Within epistemology, it is standardly assumed that a subject who knows that p, or justifiably believes that p, can lose this knowledge or justified belief by acquiring a so-called 'defeater', whether that is evidence that not-p, evidence that the process that produced her belief is unreliable, or evidence that she has likely misevaluated her own evidence. Within ethics and practical reasoning, it is widely accepted that a subject may initially have a reason to do something although this reason is later defeated by her acquisition of further information. However, the traditional conception of defeat has recently come under attack. Some have argued that the notion of defeat is problematically motivated; others that defeat is hard to accommodate within externalist or naturalistic accounts of knowledge or justification; and still others that the intuitions that support defeat can be explained in other ways. This volume presents new work re-examining the very notion of defeat, and its place in epistemology and in normativity theory at large.

Torbjörn Tännsjö examines three theories on the ethics of killing in this book: deontology, a libertarian moral rights theory, and utilitarianism. The implications of each theory are worked out for different kinds of killing: trolley-cases, murder, capital punishment, suicide, assisted death, abortion, killing in war, and the killing of animals. These implications are confronted with our intuitions in relation to them, and our moral intuitions are examined in turn. Only those intuitions that survive an understanding of how we have come to hold them are seen as 'considered' intuitions. The idea is that the theory that can best explain the content of our considered intuitions gains inductive support from them. We must transcend our narrow cultural horizons and avoid certain cognitive mistakes in order to hold considered intuitions. In this volume, suitable for courses in ethics and applied ethics, Tännsjö argues that in the final analysis utilitarianism can best account for, and explain, our considered intuitions about all these kinds of killing.

These theories significantly advance the case for coherentism in law. Nonetheless, there remain a number of problems in the coherence theory in law. This ambitious new work makes the first concerted attempt to develop a coherence-based theory of legal reasoning, and in so doing addresses, or at least mitigates these problems. The book is organized in three parts. The first part provides a critical analysis of the main coherentist approaches to both normative and factual reasoning in law. The second part investigates the coherence theory in a number of fields that are relevant to law: coherence theories of epistemic justification, coherentist approaches to belief revision and theory-choice in science, coherence theories of practical and moral reasoning and coherence-based approaches to discourse interpretation. Taking this interdisciplinary analysis as a starting point, the third part develops a coherence-based model of legal reasoning. While this model builds upon the standard theory of legal reasoning, it also leads to rethinking some of the basic assumptions that characterize this theory, and suggests some lines along which it may be further developed. Thus, ultimately, the book not only improves upon the current state of coherence theory in law, but also contributes to the larger debate about how to articulate a theory of legal reasoning that results in better decision-making.

What makes reliable evidence in fundamental moral convictions? And what are the associated problems of using testimony as a source of moral knowledge? Sarah McGrath provides novel answers to these questions and many others, as she investigates the possibilities, sources, and characteristic vulnerabilities of moral knowledge. She also considers whether there is anything wrong with simply outsourcing moral questions to a moral expert and evaluates the strengths and weaknesses of the method of equilibrium as an account of how we make up our mind about moral questions. Ultimately, McGrath concludes that moral knowledge can be acquired in any of the ways in which we acquire ordinary empirical knowledge. Our efforts to acquire and preserve such knowledge, she argues, are subject to frustration in all of the same ways that our efforts to acquire and preserve ordinary empirical knowledge are.
