This book investigates legal disputes between religious communities in the world’s largest majority-Muslim, democratic country, Indonesia. It considers how the interaction between state and religion has influenced relations between religious communities in the transition to democracy. The book presents original case studies based on empirical field research of court disputes in West Java, a majority-Muslim province with a history of radical Islam. These include criminal court cases, as well as cases of judicial review, relating to disputes concerning religious education, permits for religious buildings and the crime of blasphemy. The book argues that the democratic law reform process has been influenced by radical Islamists because of the politicization of religion under democracy and the persistence of fears of Christianization. It finds that disputes have been localized through the decentralization of power and exacerbated by the central government’s ambivalent attitude towards radical Islamists who disregard the rule of law. Examining the challenge facing governments to accommodate minorities and manage religious pluralism, the book furthers understanding of state-religion relations in the Muslim world. In recent years, however, there has been a rise in "majoritarianism", with resurgent Islamist groups pushing hard to impose conservative values on public life – in many cases with considerable success. This has sparked growing fears for the future of basic human rights, and, in particular, the rights of women and sexual and ethnic minority groups. There have, in fact, been more prosecutions of unorthodox religious groups since the fall of Soeharto in 1998 than there were under the three decades of his authoritarian rule. Some Indonesians even feel that the pluralism they thought was constitutionally guaranteed by the national ideology, the Pancasila, is now under threat. This book contains essays exploring these issues by prominent scholars, lawyers and activists from within Indonesia and beyond, offering detailed accounts of the political and legal implications of rising resurgent Islamism in Indonesia. And in Indonesia, lauded today as the region’s only democracy still standing, the government’s writ over the security forces has remained weak, with military commanders nestling in unaccountable domains, there to conduct their shadowy business dealings. Elsewhere, dominant single parties persist in Malaysia, Singapore, Vietnam, Cambodia, and Laos, while a military junta perpetuates its brutal control over Burma. This volume, the first to bring together a series of country cases and comparative narratives about the recent revival of authoritarian rule in Southeast Asia, identifies the structural and voluntarist dynamics that underlie this trend and the institutional patterns that are taking shape. Drexler argues that the creation and persistence of impunity for the perpetrators of the Cold War Indonesian genocide (1965–66) is not only a legal status but also a cultural and social process. Impunity for the initial killings and for subsequent acts of political violence has many elements: bureaucratic, military, legal, political, educational, and affective. Although these elements do not always work at once—at times some are dormant while others are ascendant—together they can be described as a unified entity, a dynamic infrastructure, whose existence explains the persistence of impunity. For instance, truth telling, a first step in many responses to state violence, did not undermine the infrastructure but instead bent to it. Creative and artistic responses to revelations about the past, however, have begun to undermine the infrastructure by countering its temporality, affect, and social stigmatization and demonstrating its contingency and specific actions, policies, and processes that would begin to dismantle it. Drexler contends that an infrastructure of impunity could take hold in an established democracy.

The extent of Indonesia?s progress in this area has been the subject of heated debate, both in Indonesia and in Western capitals. Human rights organizations and critical academics, on the one hand, have argued that the reforms implemented so far have been largely superficial, and that Indonesia?s armed forces remain a highly problematic institution. Foreign proponents of military assistance to Indonesia, on the other hand, have asserted that the military has undergone radical change, as evidenced by its complete extraction from political institutions. This study evaluates the state of military reform eight years after the end of authoritarian rule, pointing to both significant achievements and serious shortcomings. Although the armed forces in the new democratic polity no longer function as the backbone of a powerful centralist regime and have lost many of their previous privileges, the military has been able to protect its core institutional interests by successfully fending off demands to reform the territorial command structure. As the military?s primary source of political influence and off-budget revenue, the persistence of the territorial system has ensured that the Indonesian armed forces have not been fully subordinated to democratic civilian control. This ambiguous transition outcome so far poses difficult challenges to domestic and foreign policymakers, who have to find ways of effectively engaging with the military to drive the reform process forward.This is the twenty-third publication in Policy Studies, a peer-reviewed East-West Center Washington series that presents scholarly analysis of key contemporary domestic and international political, economic, and strategic issues affecting Asia in a policy relevant manner.
