Book excerpt: This book contends that the right of access to justice (at national and international levels) constitutes a basic cornerstone of the international protection of human rights, and conforms a true right to the Law. It amounts, lato sensu, to the right to the realization of justice. In such understanding, it comprises not only the formal access to a tribunal or judge, but also respect for the guarantees of due process of law, the right to a fair trial, and to reparations (whenever they are due), and the faithful execution of judgments. On its part, the right to an effective domestic remedy is a basic pillar of the rule of law in a democratic society. In its part, the right of international individual petition, together with the safeguard of the integrity of international jurisdiction, constitute the basic foundations of the emancipation of the individual vis-à-vis his own State. This is a domain that has undergone a remarkable development in recent years. It is submitted that the right of access to justice belongs today to the domain of jus cogens. Without it, there is no legal system at all. The protection of the human person in the most adverse circumstances has evolved amongst considerations of ordre public. Such recent evolution has been contributing to the gradual expansion of the material content of jus cogens. Furthermore, the very notion of "victim" (encompassing direct, indirect and potential victims) has been the subject of a considerable international case-law. Victims have had their cause vindicated in situations of utmost adversity, if not defencelessness (e.g., abandoned or "street children", undocumented migrants, members of peace communities in situations of armed conflict, internally displaced persons, individuals in infra-human conditions of detention, surviving victims of massacres).

The reinterpre tation of the development of science in the seventeenth century, now widely influential, receives at Freudenthal's hand its most persuasive statement, most significantly because of his attention to the theoretical form which is charac teristic. of classical Newtonian mechanics. He pursues the sources of the parallels that may be noted between that mechanics and the dominant philosophical systems and social theories of the time; and in a fascinating development Freudenthal shows how a quite precise method - as he descriptively labels it, the 'analytic-synthetic method' - which underlay the Newtonian form of theoretical argument, was due to certain interpretive premisses concerning particle mechanics. If he is right, these depend upon a particular stage of con ceptual achievement in the theories of both society and nature; further, that the conceptual was generalized philosophically; but, strikingly, Freudenthal shows that this concept-formation itself was linked to the specific social relations of the times of Newton and Hobbes.

Think of carpooling and playing tennis. In the past two or three decades it has become increasingly popular to analyze such collective actions in terms of collective intentions. This volume brings together ten new philosophical essays that address issues such as how individuals succeed in maintaining coordination throughout the performance of a collective action, whether groups can actually believe propositions or whether they merely accept them, and what kind of evidence, if any, disciplines such as cognitive science and semantics provide in support of irreducibly collective states. The theories of the Big Four of collective intentionality -- Michael Bratman, Raimo Tuomela, John Searle, and Margaret Gilbert -- and the Big Five of Social Ontology -- which in addition to the Big Four includes Philip Pettit -- play a central role in almost all of these essays. Drawing on insights from a wide range of disciplines including dynamical systems theory, economics, and psychology, the contributors develop existing theories, criticize them, or provide alternatives to them. Several essays challenge the idea that there is a straightforward dichotomy between individual and collective level rationality, and explore the interplay between these levels in order to shed new light on the alleged discontinuities between them. These contributions make abundantly clear that it is no longer an option simply to juxtapose analyses of individual and collective level phenomena and maintain that there is a discrepancy.
