Tomando como punto de partida la evolución del sistema estadounidense desde la implantación de la responsabilidad penal de las personas jurídicas y ahondando en la problemática constatada de que en EE.UU. el sistema de responsabilidad penal de las empresas está mercantilizando el Derecho penal empresarial enmascarando a los auténticos artífices de una gran actividad delictiva, la autora explica profusamente, de un modo inédito en nuestro idioma, y con una perspectiva crítica, cómo esto fue el inicio de una tendencia creciente sobre la que la dogmática estadounidense ya manifestó su preocupación décadas atrás y sobre la que recientemente también se ha pronunciado la propia Fiscalía General de EE.UU. En este sentido, la autora propone, a partir de los criterios jurisprudenciales que desde hace décadas se están utilizado en EE.UU. para el levantamiento del velo y la individualización de la responsabilidad de los distintos sujetos que intervienen en la delincuencia empresarial, la potenciación y mejora también en nuestro sistema, de la individualización de la responsabilidad en la empresa. Así, partiendo de la práctica penal estadounidense propone el empleo en nuestro sistema de distintos criterios para la atribución de la responsabilidad de los altos directivos, los trabajadores y los asesores externos a la propia empresa; que encuentran en la presente obra, un sugerente planteamiento que no pasará desapercibido para la práctica y la Dogmática penal.

In particular, at the beginning of the 1900s, the rehabilitative ideal was enthusiastically trumpeted and helped to direct the renovation of the correctional system (e.g., implementation of indeterminate sentencing, parole, probation, a separate juvenile justice system). For the next seven decades, offender treatment reigned as the dominant correctional philosophy. Then, in the early 1970s, rehabilitation suffered a precipitous reversal of fortune. The larger disruptions in American society in this era prompted a general critique of the “state run” criminal justice system. Rehabilitation was blamed by liberals for allowing the state to act coercively against offenders, and was blamed by conservatives for allowing the state to act leniently toward offenders. In this context, the death knell of rehabilitation was seemingly sounded by Robert Martinson's (1974b) influential “nothing works” essay, which reported that few treatment programs reduced recidivism. This review of evaluation studies gave legitimacy to the antitreatment sentiments of the day; it ostensibly “proved” what everyone “already knew”: Rehabilitation did not work. In the subsequent quarter century, a growing revisionist movement has questioned Martinson's portrayal of the empirical status of the effectiveness of treatment interventions. Through painstaking literature reviews, these revisionist scholars have shown that many correctional treatment programs are effective in decreasing recidivism. More recently, they have undertaken more sophisticated quantitative syntheses of an increasing body of evaluation studies through a technique called “meta-analysis.” These meta-analyses reveal that across evaluation studies, the recidivism rate is, on average, 10 percentage points lower for the treatment group than for the control group. However, this research has also suggested that some correctional interventions have no effect on offender criminality (e.g., punishment-oriented programs), while others achieve substantial reductions in recidivism (i.e., approximately 25 percent). This variation in program success has led to a search for those “principles” that distinguish effective treatment interventions from ineffective ones. There is theoretical and empirical support for the conclusion that the rehabilitation programs that achieve the greatest reductions in recidivism use cognitive-behavioral treatments, target known predictors of crime for change, and intervene mainly with high-risk offenders. “Multisystemic treatment” is a concrete example of an effective program that largely conforms to these principles. In the time ahead, it would appear prudent that correctional policy and practice be “evidence based.” Knowledgeable about the extant research, policymakers would embrace the view that rehabilitation programs, informed by the principles of effective intervention, can “work” to reduce recidivism and thus can help foster public safety. By reaffirming rehabilitation, they would also be pursuing a policy that is consistent with public opinion research showing that Americans continue to believe that offender treatment should be an integral goal of the correctional system.

This volume brings together for the first time across three continents - Africa, Latin America and Asia - an intellectually consistent set of original investigations into this new generation of rural social movements. These country studies seek to identify their social composition, strategies, tactics, and ideologies; to assess their relations with other social actors, including political parties, urban social movements, and international aid agencies and other institutions; and to examine their most common tactic, the land occupation, its origins, pace and patterns, as well as the responses of governments and landowners. At a more fundamental level, this volume explores the ways in which two decades of neoliberal policy - including new land tenure arrangements intended to hasten the commodification of land, and new land uses linked to global markets -- have undermined the social reproduction of the rural labour force and created the conditions for popular resistance. The volume demonstrates the longer-term potential impact of these movements. In economic terms, they raise the possibility of tackling immiseration by means of the redistribution of land and the reorganisation of production on a more efficient and socially responsible basis. And in political terms, breaking the power of landowners and transnational capital with interests in land could ultimately open the way to an alternative pattern of capital accumulation and development.

The book is a hedgehog view of the research but points the way to needed research on topics such as fear of terrorism and how social context shapes perceptions of crime. However, African American, Asian American, and Chicano people experience the same stretch of city sidewalk with varying degrees of safety, visibility, and surveillance. The Ruptures of American Capital examines two key social formations—women of color feminism and racialized immigrant women’s culture—in order to argue that race and gender are contradictions within the history of U.S. capital that should be understood not as monolithic but as marked by its crises. Hong shows how women of color feminism identified ways in which nationalist forms of capital, such as the right to own property, were repressive. The Ruptures of American Capital demonstrates that racialized immigrant women’s culture has brought to light contested modes of incorporation into consumer culture. Interweaving discussion of U.S. political economy with literary analyses (including readings from Booker T. Washington to Jessica Hagedorn) Hong challenges the individualism of the United States and the fetishization of difference that is one of the markers of globalization.
