This book was released on 2013-09 with total page 126 pages. Available in PDF, EPUB and Kindle. Book excerpt: This historic book may have numerous typos and missing text. Purchasers can usually download a free scanned copy of the original book (without typos) from the publisher. Not indexed. Not illustrated. 1891 edition. Excerpt: ... CHAPTER III. THE AUCTIONEER AND THE LAW. (1) The Contract of Sale. As the sales conducted in the auction-room constantly include lands and houses, and as the value of many a " lot" of goods put up for sale will often exceed 10 in value, it is important that an auctioneer should be familiar with certain provisions of the Act of Parliament (29 Charles II. c. 3) known as the Statute of Frauds (so called because it was passed "for the prevention of many fraudulent practices which are commonly endeavoured to be upheld by perjury and subornation of perjury "), so far as they relate to contracts of sale. And in the case of Pierce v. Corf (see next page), a high judicial authority, Mr. Justice (now Lord) Blackburn laid it down as the "duty of the auctioneer" to take reasonable and proper care that a contract of sale of which he has the charge is binding under the statute. The two sections of the statute which mainly concern the auctioneer are the 4th and the 17th. By s. 4 it was enacted "that no action shall be brought, whereby to charge any person upon any contract or sale of lands, tenements, or hereditaments, or any interest in or concerning them, unless the agreement upon which such action shall be brought, or some memorandum or note thereof, shall be in writing, and signed by the party to be charged therewith, or some other person thereunto by him lawfully authorized." By s. 17, "no contract for the sale of any goods, wares, or merchandises for the price of 10 sterling or upwards, shall be allowed to be good except (1) the buyer shall accept part of the goods so sold and actually receive the same; or (2) give something in earnest to bind the bargain or in part of payment; or (3) that some note or memorandum in writing of the said...

Book Indiana Notary Public Guide

Download or read book Indiana Notary Public Guide written by Indiana Secretary of State and published by Lulu.com. This book was released on 2019-04-06 with total page 80 pages. Available in PDF, EPUB and Kindle. Book excerpt: A notary is a public official responsible for independently verifying signatures and oaths. Depending on how a document is written, a notarization serves to affirm the identity of a signer and the fact that they personally executed their signature. A notarization, or notarial act, officially documents the identity of a party to a document or transaction and the occasion of the signing that others can rely upon, usually at face value. A notary's authentication is intended to be reliable, to avoid the inconvenience of having to locate a signer to have them personally verify their signature, as well as to document the execution of a document perhaps long after the lifetime of the signer and the notary. An oath is a sworn statement. In most cases a person will swear that a written statement, oral statement, or testimony they are about to give is true. A notary can document that the notary administered an oath to an individual.

Book Auction 1916 Manual

Download or read book Auction 1916 Manual written by Boston Bridge Club and published by Forgotten Books. This book was released on 2017-12-10 with total page 50 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Auction, 1916 Manual: The Laws, Conventions and Principles of Bidding and Play Auction Bridge is deservedly considered the greatest of card games. It seems to combine opportunities for all the purely intellectual skill of Whist, the chances and the psychological intuitions of Poker, and the effective team work of Football. Its character and associa tions make it, eminently, a gentleman's game - and a lady's. Unfortunately, almost annual changes in the rules have necessitated substantial changes in the play, and rendered practically valueless the several exhaustive books published since 1908. It is reasonably hoped that the code of 108 laws adopted by the New York Whist Club in 1915 will remain unchanged. The principal changes in these laws to be noted by players accustomed to the older customs, are as follows: Low Spades have been eliminated; Spade now means Royal or Lily, and the latter terms are not used.
