Grounded in Justin Richland’s extensive field research on the Hopi Indian Nation of northeastern Arizona—on whose appellate court he now serves as Justice Pro Tempore—this innovative work explains how Hopi notions of tradition and culture shape and are shaped by the processes of Hopi jurisprudence. Like many indigenous legal institutions across North America, the Hopi Tribal Court was created in the image of Anglo-American-style law. But Richland shows that in recent years, Hopi jurists and litigants have called for their courts to develop a jurisprudence that better reflects Hopi culture and traditions. Providing unprecedented insights into the Hopi and English courtroom interactions through which this conflict plays out, Richland argues that tensions between the language of Anglo-style law and Hopi tradition both drive Hopi jurisprudence and make it unique. Expanding on the idea of the elite literati—a widely studied pre-modern Chinese social group, influential in cultural production—the folk literati are defined as those who are skilled in classical Chinese, knowledgeable about local traditions, and capable of representing them in writing. The folk literati work to maintain cultural continuity, a concept that is expressed locally through the vernacular phrase: "incense is kept burning." You's research focuses on a few small villages in Hongtong County, Shanxi Province in contemporary China. Through a careful synthesis of oral interviews, participant observation, and textual analysis, You presents the important role the folk literati play in reproducing local traditions and continuing stigmatized beliefs in a community context. She demonstrates how eight folk literati have reconstructed, shifted, and negotiated local worship traditions around the ancient sage-Kings Yao and Shun as well as Ehuang and Nüying, Yao's two daughters and Shun's two wives. You highlights how these individuals' conflictive relationships have shaped and reflected different local beliefs, myths, legends, and history in the course of tradition preservation. She concludes her study by placing these local traditions in the broader context of Chinese cultural policy and UNESCO's Intangible Cultural Heritage program, documenting how national and international discourses impact actual traditions, and the conversations about them, on the ground.

From Geoffrey Chaucer’s associations with both his fellow writers in London and with his geographically distant French contemporaries, to Thomas Hoccleve’s emphatic insistence that he was “aqweyntid” with Chaucer even after Chaucer’s death, to John Lydgate’s formations of “virtual coteries” of a wide range of individuals alive and dead who can only truly come together on the page, the book traces how writers formed the English literary tradition by signaling social connections. By forming coteries, both real and virtual, based on shared appreciation of a literary tradition, these authors redefine what should be valued in that tradition, shaping and reshaping it accordingly. Perry shows how our notion of the English literary tradition came to be and how it could be imagined otherwise.

Book excerpt: This book is a first attempt to examine the thought of key contemporary Jewish thinkers on the meaning of tradition in the context of two models. The classic model assumes that tradition reflects lack of dynamism and reflectiveness, and the present’s unqualified submission to the past. This view, however, is an image that the modernist ethos has ascribed to the tradition so as to remove it from modern existence. In the alternative model, a living tradition emerges as open and dynamic, developing through an ongoing dialogue between present and past. The Jewish philosophers discussed in this work—Joseph B. Soloveitchik, Yeshayahu Leibowitz, David Hartman, and Eliezer Goldman—ascribe compelling canonic status to the tradition, and the analysis of their thought discloses the tension between these two models. The book carefully traces the course they have plotted along the various interpretations of tradition through their approach to Scripture and to Halakhah.
