Book excerpt: Policy makers and academics alike have mistakenly promoted an agenda which takes well-governed democratic and consolidated 'Weberian' states as the model for the world and the goal of development programs. Whilst Western industrial democracies are the exception, areas of limited statehood where state institutions are weak and ineffective, are everywhere, and, this books argues, can still be well-governed. Three factors explain effective governance in areas of limited statehood: Fair and transparent institutions 'fit for purpose,' legitimate governors accepted by the people, and social trust among the citizens. Effective and legitimate governance in the absence of a functioning state is not only provided by international organizations, foreign aid agencies, and non-governmental organizations but also by multi-national companies, rebel groups and other violent non-state actors, 'traditional' as well as religious leaders, and community-based organizations. Börzel and Risse base their argument on empirical findings from over a decade of research covering Latin America, the Middle East, Sub-Saharan Africa, and Asia.

Other models of governance, such as China's "autocratic capitalism", rest on technocratic command and control methods that are disdained in the West but whose global appeal is growing mostly due to their perceived ability to deliver. In a world ravaged by pandemics and climate crises, migration flows and cyberwars, rigid rule-making imparted from above or populist over-simplifications brewing from below can only represent the extremes of a more sophisticated picture of governing processes. In this book, Fabrizio Tassinari seeks to rediscover the methods, practices and limits of good governance. By taking inspiration from the Nordic region, where democratic governance has delivered some of its most impressive feats, he shows that populism and technocracy are not the causes of our political malaise; they represent skewed by-products of the most basic instincts in our body politic. In this important work, Marc Moore critically analyses the core dimensions of corporate governance law in these two countries, seeking to determine the fundamental nature of corporate governance as a subject of legal enquiry. In particular, Moore examines whether Anglo-American corporate governance is most appropriately understood as an aspect of 'private' (facilitative) law, or as a part of 'public' (regulatory) law. In contrast to the dominant contractarian understanding of the subject, which sees corporate governance as an institutional response to investors' market-driven private preferences, this book defines corporate governance as the manifestly public problem of securing the legitimacy – and, in turn, sustainability – of discretionary administrative power within large economic organisations. It emphasises the central importance of formal accountability norms in legitimating corporate managers' continuing possession and exercise of such power, and demonstrates the structural necessity of mandatory public regulation in this regard. The Regional Assistance Mission to Solomon Islands (RAMSI) has been an intensive peacekeeping operation, concentrating on building 'core pillars' of the modern state. It did not take adequate notice of a variety of shadow sources of power in the Solomon Islands, for example logging and business interests, that continue to undermine the state's democratic foundations. At first RAMSI's statebuilding was neither very responsive to local voices nor to root causes of the conflict, but it slowly changed tack to a more responsive form of peacebuilding. The craft of peace as learned in the Solomon Islands is about enabling spaces for dialogue that define where the mission should pull back to allow local actors to expand the horizons of their peacebuilding ambition.
