Book excerpt: In Canada, women's rights organizations have successfully mobilized the law to foster gender equality. In doing so, they have been constrained by legal understandings of equality and discrimination which have shaped their strategies to seek justice. In return, their mobilization, mainly through litigation, has contributed to craft or to alter legal categories (such as "substantive equality", "women", "sexual harassment" etc.) which in turn sustain their identities and their interests. However, claims made in the name of gender equality raise two issues: they tend to overlook the intersection of gender with other grounds of discrimination such as religion or race/ethnicity, and they tend to conflict with multiculturalism, a value enshrined in Canadian Law. The recent decision taken by the Province of Ontario to ban religious arbitration for family matters offers an illuminating case study of this tension between gender equality and religious rights in the Canadian context. This paper analyzes women's rights activists' legal understandings of gender equality and religious/ethnic discrimination, to explain how these representations have influenced women's mobilization against religious arbitration in Ontario. Bringing together the insights developed by critical legal studies about intersectionality and the study of legal mobilization, this paper explores through a concrete example the tension between feminism and multiculturalism.

In Province Building and the Federalization of Immigration in Canada, Mireille Paquet shows that, between 1990 and 2010, all ten provinces became closely involved in immigrant selection and integration. This considerable change to the Canadian model of immigration governance corresponds to a broader process of federalization of immigration, by which both orders of government became active in the management of immigration. While Canada maintains its overall positive approach to newcomers, the provinces developed, and continue to develop, their own formal immigration strategies and implement various selections and integration policies. This book argues that the process of federalization is largely the result of provincial mobilization. In each province, mobilization occurred through a modern iteration of province building, this time focused on immigrants as resources for provincial economies and societies. Advocating for a province-centred analysis of federalism, Province Building and the Federalization of Immigration in Canada provides key lessons to understanding the contemporary governance of immigration in Canada.

When these factors are not optimal in a community, it does not mean they are intractable: such inequities can be mitigated by social policies that can shape health in powerful ways. In this book, the eminent feminist Susan Moller Okin and fifteen of the world's leading thinkers about feminism and multiculturalism explore these unsettling questions in a provocative, passionate, and illuminating debate. Okin opens by arguing that some group rights can, in fact, endanger women. She points, for example, to the French government's giving thousands of male immigrants special permission to bring multiple wives into the country, despite French laws against polygamy and the wives' own bitter opposition to the practice. Okin argues that if we agree that women should not be disadvantaged because of their sex, we should not accept group rights that permit oppressive practices on the grounds that they are fundamental to minority cultures whose existence may otherwise be threatened. In reply, some respondents reject Okin's position outright, contending that her views are rooted in a moral universalism that is blind to cultural difference. Others quarrel with Okin's focus on gender, or argue that we should be careful about which group rights we permit, but not reject the category of group rights altogether. Although this conception has been challenged in recent years, it has not been completely dispelled. In Colour-Coded, Constance Backhouse illustrates the tenacious hold that white supremacy had on our legal system in the first half of this century, and underscores the damaging legacy of inequality that continues today. Backhouse presents detailed narratives of six court cases, each giving evidence of blatant racism created and enforced through law. The cases focus on Aboriginal, Inuit, Chinese-Canadian, and African-Canadian individuals, taking us from the criminal prosecution of traditional Aboriginal dance to the trial of members of the 'Ku Klux Klan of Kanada.' From thousands of possibilities, Backhouse has selected studies that constitute central moments in the legal history of race in Canada. Opposition to "gender" has become a key element of the rise of right-wing populism, which successfully harnesses the anxiety, shame and anger caused by neoliberalism and threatens to destroy liberal democracy. Anti-Gender Politics in the Populist Moment offers a novel conceptualization of the relationship between the ultraconservative anti-gender movement and right-wing populist parties, examining the opportunistic synergy between these actors. The authors map the anti-gender campaigns as a global movement, putting the Polish case in a comparative perspective. They show that the anti-gender rhetoric is best understood as a reactionary critique of neoliberalism as a socio-cultural formation. The book also studies the recent wave of feminist mass mobilizations, viewing the transnational revolt of women as a left populist movement.
