Download or read book Gowers Review of Intellectual Property written by Andrew Gowers and published by The Stationery Office. This book was released on 2006-12-06 with total page 152 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report examines the importance of intellectual property (IP), ranging from patents, copyright, design and trade marks, and whether in the age of globalization, digitization and increasing economic specialization it still creates incentives for innovation, without unduly limiting access to consumers and stifling further innovation. The report does recommend a radical overhaul of the system, with the review concentrating on three areas, and setting out the following recommendations: (i) strengthening enforcement of IP rights, whether through clamping down on piracy or trade in counterfeit goods; (ii) reducing costs of registering and litigating IP rights for businesses large and small; (iii) improving the balance and flexibility of IP rights to allow individuals, businesses and institutions to use content in ways consistent with the digital age.

Chapter 3 discusses reasons advanced for and against class proceedings, including access to justice, efficient use of judicial resources, windfalls for lawyers, and the effects on Manitobans of class proceedings in other jurisdictions. Chapter 4 proposes and discusses the features of a class proceedings regime, including general objectives, certification, class membership, costs and fees, and conduct of proceedings. The final chapter summarizes recommendations for reform and a proposed Class Proceedings Act is appended.

Book Making Commercial Law Through Practice 1830 1970

Download or read book Making Commercial Law Through Practice 1830 1970 written by Ross Cranston and published by Cambridge University Press. This book was released on 2021-05-27 with total page 529 pages. Available in PDF, EPUB and Kindle. Book excerpt: Making Commercial Law Through Practice 1830–1970 adds a new dimension to the history of Britain's commerce, trade manufacturing and financial services, by showing how they have operated in law over the last one hundred and forty years. In the main law and lawyers were not the driving force; regulation was largely absent; and judges tended to accommodate commercial needs, so that market actors were able to shape the law through their practices. Using legal and historical scholarship, the author draws on archival sources previously unexploited for the study of commercial practice and the law's role in it. This book will stimulate parallel research in other subject areas of law. Modern commercial lawyers will learn a great deal about the current law from the story of its evolution, and economic and business historians will see how the world of commerce and trade operated in a legal context.

At the same time, an emerging cultural emphasis on truth-telling drove the development of new ways of inhibiting perjury. Strikingly original and drawing on a broad array of archival research, Wendie Schneider’s examination of the Victorian courtroom charts this period of experimentation and how its innovations shaped contemporary trial procedure. Blending legal, social, and colonial history, she shines new light on cross-examination, the most enduring product of this time and the “greatest legal engine ever invented for the discovery of truth.”

Book The Rise of Extreme Porn

Download or read book The Rise of Extreme Porn written by Alexandros K. Antoniou and published by Springer. This book was released on 2017-02-13 with total page 372 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the criminalisation of the possession of extreme pornography through ss 63-68 of the Criminal Justice and Immigration Act 2008. It documents the legislative history of the offence and offers a criminological perspective on the role of the media in the construction of the extreme pornography problem. It evaluates the elements of the s 63 offence and critically reflects upon their weaknesses. Moreover, the book presents an up-to-date account of the number of prosecutions initiated and convictions obtained under s 63 since it came into force, alongside an exploration into the corresponding sentencing trends. The first study of its kind in England and Wales since the controversial legal provisions at issue came into effect in 2009, this book contributes new evidence to the application of the extreme pornography provisions and will play an important role in shaping debates on the prosecution of similar offences in the coming years. This book will serve as an invaluable resource to all those with an interest in law, criminology, sociology of deviance, sexuality and pornography studies.
